I i H c REQUESTED CONDITIONAL USE AND COMMENTS: The applicant is requesting a conditional use permit to amend the previously approved site plan of CU94-26(Ord. 94-83) for a planned commercial center along with the possession, storage,_retail sale,and on-premise consumption of alcoholic beverages (beer, wine and mixed beverages), in conjunction with a restaurant specifically to allow outside dining, outdoor speakers, and two pole signs. The applicant intends to open and operate a new restaurant concept in the former Don Pablo'sfTio Joe's building called '`Pluckers Wing Bar." This is primarily a restaurant that serves wings and similar chicken based fare as well as hamburgers., salads; and other standard menu items. A significant interior remodel is proposed to include the complete demolition of the second floor area of the restaurant and the addition of a patio area on the east side of the building that can accommodate 142 restaurant patrons. A large number of televisions will be provided throughout the dining area with ten of them provided on the patio. Eight parking spaces will be removed to create the patio area however elimination of the second floor has reduced the overall occupant load of the building. The proposed occupant load for the new concept is 465 persons with a parking requirement of 155 spaces; 155 spaces have been provided. The applicant intends to change the look of the 40-foot pole sign along the rear of the property and a new 20-foot pole sign is proposed along Cross Roads Drive. All the restaurants in the Cross Roads planned commercial center have at least one pole sign in excess of 2.0-feet in height; three have two pole signs (Tilted Kilt, Red Robin and the Original Pancake House). Five restaurants have outside dining (Red Robin, Boston's, Buffalo Wild Wings, Outback Steakhouse, Carrabba's, California Pizza Kitchen). See the attached letter. PRESENT ZONING AND USE: The property is currently zoned "CC" Community Commercial District with conditional use permits for a planned commercial center and on-premise alcoholic beverage sales and consumption in conjunction with a restaurant. This is the form site of Don Pablo's and Tio Joe's restaurants. HISTORY OF TRACT AND SURROUNDING AREA: The subject and surrounding property was zoned "I-1" Light Industrial District prior to the 1984 City Rezoning. The subject property was rezoned from "GU" Governmental Use District and "PI D" Planned Industrial Development District to"CC"Community Commercial District with a master site plan for a Planned Commercial Center in conjunction with an Outback Steakhouse(Z92-04 and CU92-14). TGI Fridays amended the approved site plan (CU92-20) at the December 15, 1992 joint public hearing and developed a restaurant with on-premise consumption of alcoholic beverages and a 40-foot pole sign. California Pizza Kitchen was approved at the January 18, 1994 joint public hearing (CU93-14) which also allowed for a restaurant with on-premise consumption of alcoholic beverages and a 40-foot pole sign. CU94-03 was approved by Council on March 22, 1994 and allowed TGI Fridays to consolidate two smoking areas into one area with an approved floor plan. CU94-10 was approved by Council on May 17, 1994 and allowed for the development of a Don Pablo's Restaurant with on-premise consumption of alcoholic beverages and a 40-foot pole sign. CU94-11 was also approved at the May 17, 1994 joint public hearing which established a Boston Chicken Restaurant with a 40-foot pole sign within the planned commercial center. CU94-25 and CU94-26 were heard and approved at the September 20, 1994 joint public hearing—CU94-25 established a Red Robin Restaurant with on-premise consumption of alcoholic beverages and CU94-26 allowed changes to the floor plan for Don Pablo's restaurant. CU94-36 was approved at the December 24, 1994 joint public hearing and allowed for additional wall signage for the California Pizza Kitchen. CU95-07 established Denny's Restaurant with a 40-foot pole sign and was approved at the May 16, 1995 joint public hearing. CU95-18 was approved at the August 15, 1995 joint public hearing which allowed for a 40-foot pole sign and a 20-foot pole sign for Red Robin Restaurant. CU98-08 was approved on April 21, 1998 at the joint public hearing,which allowed for a 781 square foot expansion to the existing restaurant. CU98-29 was approved in July 1998, approving a revision to the floor plan of TGI Friday's Restaurant. The Site Plan Review Committee 01MUICU10-20.4 1 September 14,2010(8:12AM) approved CU01-61 in October 2001 allowing interior and exterior renovations to TGI Friday's. The work was not started and the Conditional Use permit expired. At the May 20, 2003 Council approved a conditional use permit (CU03-12) to modify the floor plan and exterior elevations for TGI Friday's. Conditional Use Request CU04-18 was approved by Council at the May 18, 2004 meeting which allowed for on-premise alcohol beverages sales in conjunction with a restaurant (Buffalo Wild Wings) at the northeast corner of Crossroads Drive and William D. Tate Avenue. Conditional Use request (CU04-36) and Special Use (SU04-03) were approved by City Council at the October 19, 2004 meeting which allowed for on-premise alcohol beverages sales and consumption and one pool table in conjunction with a restaurant (Boston's The Pizza Gourmet). The Site Plan Review Committee approved CU05-34 on May 25, 2005 allowed a 159-square foot, 40-foot pole sign for Buffalo Wild Wings. The Site Plan Review Committee approved CU06-43 on September 28, 2006 allowing a 603 square foot outdoor ding in area for Buffalo Wild Wings. The Site Plan Review Committee approved CU06-57 on December 21, 2006 allowing a patio cover for Buffalo Wild Wings. A conditional use request (CU09-01) and special use request(SU09-01)was considered and denied by Council at their February 17, 2009 meeting in which the applicant was requesting to add outside dining, a new 40-foot pole sign and one billiard table to the former TGI Friday's for a new restaurant concept called the Tilted Kilt. To the west, Classic Chevrolet has be granted numerous conditional use permits (CU91- 01, CU92-01, CU92-16, CU94-02)for a car dealership with automobile repair, 40-foot pole signs, a used car showroom with eight service bays, parts storage, sales offices and a customer lounge area. CU95-15 was approved by Council on June 20, 1995 and allowed Classic Chevrolet a 6.354 acre expansion to develop a paint and body shop, a used car sales building, with display and inventory parking. CU96-31 was approved by Council on November 19, 1996 and allowed for an additional pole sign and the revision of sign copy on another. The City Council approved CU98-71 in January, 1999 permitting the installation of shade structures over the display parking area. The Site Plan Review Committee approved CU07-06 on February 28, 2007 permitting the installation of a 32-foot aluminum arched entry feature to the existing main showroom and additional wall signage. The Hayley Addition to the north, another planned commercial center also has several retail stores, 40-foot pole signs and numerous conditional use permits for restaurants with on-premise alcoholic beverage sales including Uncle Julio's which the City Council approved CU06-08 on April 18, 2008 on the site of a former movie theatre. Tired of eating pizza and Chinese food every night in their dorm rooms, Mark and Dave craved the chicken wings from their hometowns. From these cravings,became the idea of what is now Pluckers. In this profile, we hope to explain our business philosophy and ability to create a restaurant experience unlike others with the goal of giving you an understanding of our use for your city. Making Fun Happen/Marketing 101 o Our motto is to "Make Fun Happen" and our managers are trained to foster a relaxed, family-friendly, entertaining atmosphere. Our restaurants utilize a top of the line audio/video system with a multitude of televisions including over a dozen plasma screens to create a state of the art sports viewing experience. To entertain our guests, we host live trivia at our restaurants, play local sports teams' fight songs over our speakers for their hometown fans and teach our management and staff to go the extra mile for our guests. However, we are not your typical sports bar; rather, we are a restaurant where families and sports fans alike share a desire to eat a good meal in an exciting environment.. Our strategy is to position each of our restaurants as the local "hang-out" for a broad segment of consumers seeking a"non-chain" atmosphere with friendly service and a sports themed background. o Through "making fun happen" we are able to leverage the consumer's desire to have places they can call their own.. The movie Office Space's mockery of the chain restaurant with their "15 pieces of Flair" mentality and contrived marketing best exemplifies the Pluckers attitude. We do not contrive branding, instead we allow our guests to take part in our brand through programs like our Pluckers Club and our Wall of Flame (Polaroids of guests who eat 25 or more of our Fire in the Hole wings). The result is that each store has pieces of our customers within its four walls, much like your home has pictures of your friends and family. In doing so, our guests become brand ambassadors for our food and atmosphere. It is these Pluckers evangelists that spread the message about our product. Freshly Prepared Food and Customization All of our food is prepared fresh in our kitchens ... and so is everyone else's, right? Fair enough, but our guests picketed our competitors when they entered one of our markets. (Unbeknownst to us, a die hard fan recruited other fans to picket a competitor's franchise when they opened their first Austin location.) Why? Our food is just plain addictive because it is fresh and we use only the top ingredients in our proprietary sauces. We make everything from scratch: we hand bread our chicken tenders, use hand-cut mozzarella for our mozzarella sticks, fresh cooked potato chips, and our salad dressings are prepared in our store's kitchens. We believe freshly prepared foods taste better and even our chicken wings are delivered fresh multiple days per week. Jr. was convinced that Austin badly needed a mouth-watering chicken wing joint mapped in a fun, sports oriented atmosphere. And what's more, that restaurant needed to deliver — LATE. So, with an entrepreneurial spirit and a winning concept in mind, Greenberg co- founded Pluckers in Austin, Texas just after his graduation from the University of Texas in July of 1995 From Pluckers' inception, Greenberg has been very "hands-on" in his involvement with the restaurant, doing everything from managing, to waiting tables, to cooking and even delivery driving. With the growth from one store to four, Greenberg, who can still be caught tossing a wing or two, oversees all stores from an operational standpoint and also oversees the construction management of new locations. Greenberg attributes the success of Pluckers to the laid back, inviting atmosphere and the "dynamite"food. A native of New Orleans, Greenberg brings a taste of Louisiana to Pluckers with his Cajun wing sauce and "The Beav," an "off menu" chicken tender sandwich named for Greenberg's childhood nickname. Another tradition that follows Greenberg from childhood is baseball. An Avid fan and one-time player, Greenberg volunteers time coaching his son in the Austin area. • David Paul, Co-Founder and Owner, Pluckers Wing Bar Co-Founder and Owner of Pluckers, Dave Paul began his restaurant career in high school, working as a cook, busboy and delivery driver in his hometown of Atlanta, Georgia. He also spent weekends with friends watching SEC football while enjoying the Buffalo wings of local favorites $3 Cafe, Taco Mae and Clay's. When he arrived at the University of Texas as a college freshman in 1991, Paul was dismayed to find Austin didn't have a wings joint to satisfy his addiction. So, he and co-founder Mark Greenberg had the idea of opening the first wings restaurant in Austin, but the plan Cal �- a � was put on hold when their parents told them there was NO WAY they were dropping out of school to "sling wings!" During the next four years of college, Dave switched majors as often as the bluebonnets bloomed on the Texas highways. However, he continued to hold on to the dream of opening a chicken wing restaurant in Austin, and in the summer of 1995, Pluckers was opened. During the first years of Pluckers, Dave worked directly in the trenches — cooking, driving, waiting tables, even passing out flyers and menus around Austin— whatever it took! As the concept has grown and evolved, Dave's position has become slightly more glamorous, but just as demanding. He currently oversees Accounting, Purchasing and Marketing aspects of the restaurants, and is also actively involved in operations. An avid cook, Dave also spends many hours locked in the Pluckers kitchen devising recipes for new menu items and wing sauces. • Sean Greenberg, Owner, Pluckers Wing Bar While Sean Greenberg, brother of co-founder Mark Greenberg, managed Pluckers during college at the University of Texas (BBA—Finance, 1998), he officially joined the Pluckers team as a partner while attending The Dedman School of Law at Southern Methodist University (JD cum laude, 2002) in 2001- Creative finance options learned in business law classes, combined with Greenberg's detailed knowledge of the potential of the Pluckers concept, sparked a plan to help grow the Pluckers concept into a full-fledged restaurant company. In joining the Pluckers team, Greenberg was excited at the opportunity to grow a company and was equally drawn to the opportunity to work with his brother professionally. Pluckers is an environment where everyone pitches in to get the job done. Greenberg's law degree enables him to serve as in-house counsel and to oversee real estate negotiations as well as source capital for expansion and handle banking relationships. Greenberg coordinates raising capital from private investors as well as handling entity formation and planning. However, all partners work together, and few major decisions are made without reaching a complete consensus. Greenberg, a native of New Orleans, has lived in Austin since 2004. Prior to law school Greenberg spent a year in Aspen in the hospitality industry and also lived in Austin,Texas during his four years at the University of Texas at Austin. The Grapevine Location: After spending considerable time over the past eighteen months visiting the Grapevine area, we believe Grapevine is an ideal location for a Pluckers. Clearly, the citizens of Grapevine have a love for sports and appreciate quality food_ Unlike many concepts with similar menu items, Pluckers is family friendly with weekly Kids Eat Free nights and will become actively involved in the community through our profit share programs with teacher's organizations, Little Leagues, and other community groups. Although we do intend to have a full bar, and a vibrant bar atmosphere, our restaurant floor plan will serve to properly separate the bar area from the dining area so families do not feel as though they are eating at a bar. Our audi-visual package should be the best in the Grapevine area with over 50 high definition plasma televisions and two high definition 100 inch projection screens. The former Don Pablos site is in much need of restoration and reconfiguration due to its dated floor plan and design. In taking a building that has struggled to find a proper tenant in recent history, our goal is to completely remake the building into a Pluckers and restore the property to its highest and best use. Certainly having a completely renovated building and a thriving business will benefit all the surrounding properties and their underlying values for years to come. Thus, we will completely gut the building, remove the dated mezannine layout and modernize the space with a truly unique outdoor patio. With our patio, we hope to create an outdoor area with an atmosphere that encourages families and singles alike to dine outdoors during nice weather. We plan to enclose approximately two thousand square feet of outdoor space with a fence and plant two large canopy trees in the outdoor space to create an enjoyable patio with greenery and shade trees. Furthermore, in our effort to create an exciting patio where business meetings can occur during happy-hour or where folks can gather on a nice night to watch a sporting event, we will install over ten plasma televisions and a state of the art outdoor audio/visual package. In selecting the East side of the building to place the patio, we are strategically trying to avoid any sound issues that could be created by placing the patio on the side of the building closest to the highway and furthest away from surrounding businesses. Having done similar outdoor areas at other locations, we are sensitive to sound issues and keep a decibleometer on site to ensure we are always in compliance with any sound ordinances. We want Pluckers to be a place to hang-out, relax, and enjoy a beautiful day with a great meal and terrific drinks. Grapevine is a thriving community and we whole heartedly believe that Pluckers will become a fixture within the community for many years to come. With over 15 years of privately owning and operating our restaurants, we request the design changes to the building because we believe it is essential to creating a restaurant that will be a success for many years. We do not open restaurants with a goal to sell them shortly thereafter or to open as many as possible. Rather, we aim to supplant ourselves in a community and become a part of that community.
