SUBJECT: APPROVAL OF AMENDMENTS TO THE ANIMAL SHELTER ADVISORY
BOARD
RECOMMENDATION: Consider an ordinance amending the Animal Shelter Advisory Board
membership from six members to seven.
FUNDING SOURCE:
BACKGROUND: During the Board and Commission interview process, Council discussed
adding another citizen member to the Animal Shelter Advisory Board due
to the high interest of citizens to serve on this board.
The current membership includes a veterinarian, an animal welfare
representative, a municipal officer, a member of the Animal Shelter staff
and two citizens. The proposed resolution will increase the number of
citizens to three. The new citizen term will be for two years, and the first
term will expire in 2021.

ORDINANCE NO. 2019-040
AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF
GRAPEVINE, TEXAS AMENDING THE GRAPEVINE CODE
OF ORDINANCES, CHAPTER 6 ANIMALS AND FOWL,
SECTION 6-19 (3), RELATIVE TO THE ANIMAL SHELTER
ADVISORY BOARD; REPEALING CONFLICTING
ORDINANCES: PROVIDING A SEVERABILITY CLAUSE;
DECLARING AN EMERGENCY AND PROVIDING AN
EFFECTIVE DATE
WHEREAS, the City of Grapevine is authorized to adopt ordinances to protect the
health, safety and welfare of its citizens; and
WHEREAS, the City of Grapevine has determined that it is a necessity to regulate
the activities and entities as provided for herein to safeguard the public; and
WHEREAS, the City of Grapevine is authorized by law to adopt the provisions
contained herein, and has complied with all prerequisites necessaryforthe passage of this
ordinance; and
WHEREAS, the City has determined that an amendment of Chapter 6 Animals and
Fowl of the Code of Ordinances is in the best interest of the City and its citizens; and
WHEREAS, all constitutional, statutory and legal prerequisites for the passage of
this ordinance have been met, including but not limited to the Open Meetings Act; and
WHEREAS, the City Council has determined that it is in the best interest of the
health, safety and welfare of the public to adopt this Ordinance.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
GRAPEVINE, TEXAS:
Section 1. That all matters stated herein above are found to be true and correct
and are incorporated herein by reference as if copied in their entirety.
Section 2. That Chapter 6 Animals and Fowl, Section 6-19(3), Animal Shelter
Advisory Committee, composition and qualification of members is hereby amended as
follows..
"An advisory committee shall be appointed by city council. Such committee shall
meet at least three times per year and its duties shall ensure compliance with the
requirements of the V.T.C.A., Health and Safety Code § 823.005. Members shall
hold office for staggered terms of two years, or until their successor is appointed;
excepting the municipal employees who shall serve at the pleasure of the city.
Members may be reappointed. All committee members, except the municipal
employees, shall serve without compensation. The members representing the
public shall be residents of the city and have resided within the city for 12
consecutive months preceding the appointment. The committee shall select a chair
person in two year terms. The committee shall consist of seven members and one
city council liaison. The following positions shall be filled:
(1) One municipal official — Department representative supervising animal services.
(2) One municipal employee —Animal services manager whose duties include the
daily supervision and operation of an animal shelter.
(3) Three representatives of the general public — Citizens of Grapevine.
(4) One representative — Animal welfare organization.
(5) One representative — Licensed veterinarian."
Section 3. That all ordinances or any parts thereof in conflict with the terms of
this ordinance shall be and hereby are deemed repealed and of no force or effect.
Section 4. That if any section, subsection, sentence, clause or phrase of this
ordinance shall for any reason be held to be invalid, such decision shall not affect the
validity of the remaining portions of this ordinance,
Section 5. That the fact that the present ordinances and regulations of the City of
Grapevine, Texas are inadequate to properly safeguard the health, safety, morals, peace
and general welfare of the inhabitants of the City of Grapevine, Texas, creates an
emergency for the immediate preservation of the public business, property, health, safety
and general welfare of the public which requires that this ordinance shall become effective
from and after the date of its passage, and it is accordingly so ordained.
