BACKGROUND INFORMATION: An application was submitted to the Department of Development Services by Bob Agar representing Kingsway Homes. The applicant is proposing to develop a single family home on the vacant cul-de-sac lot. This case was tabled at the November 6, 1995 meeting at the request of the applicant so that he could explore the possibility of placing a complying structure on the lot. The case was subsequently tabled at the December 4, 1995 meeting. The applicant has requested to table the case to February 5, 1996. Section 68.1-1.2., Board of Zoning Adjustment - allows the Board to hear and decide special exceptions to the terms of the Comprehensive Zoning Ordinance 82-73. The special exceptions are to the landscaping requirements of Section 53, specifically allowing the existing church facilites to remain as developed without having to meet the landscaping requirements of Section 53. The proposed exceptions would allow the proposed public school expansion to ouse the existing church facilities as built without landscaping between property lines, planter islands and buffering the parking lots from adjacent properties. I Q If approved the public school would be able to use the existing church facilities .a without installing the required landscaping between property lines, planter islands and buffering the parking lots from adjacent properties. SPECIAL CONDITION: Staff finds a special condition because the church facilities are currently existing. When the church was built it was zoned "R-7.5" Single Family and did not ,have required landscaping design criteria. Bringing the landscaping into compliance would reduce the number of available parking spaces and create traffic circulation problems that currently do not exist. BACKGROUND INFORMATION: The Grapevine-Colleyville Independent School District submitted request Z95-18 to rezone the rear 3.222 acres of the Memorial Baptist Church from "R-7.5" Single Family to "GU" Governmental Use. The School District is proposing to use the existing building as training and school offices. The Grapevine/Colleyville Independent School District is proposing to incorporate the rear portion of the Memorial Baptist Church facilities into the existing elementary school development. The expansion of the existing elementary school creates a need for a new playground area, which will be provided by eliminating portions of the paved areas at the rear of the existing Memorial Baptist Church property. Additionally, World of Learning submitted request Z95-19 to rezone the front 2.779 acres of the Memorial Baptist Church from "R-7.5" Single Family to "R -MF -1" Multifamily District and a Conditional Use Permit CU95-32 to allow a day care facility. A day care facility is not a permitted use in the "R-7.5" Single Family District. Additionally, the applicant has submitted deed restrictions to allow only day care facilities or church uses on the property. The deed restrictions, if approved, could only be amended through the public hearing process. The applicant will use the property for a day care facility and lease the sanctuary building to Memorial Baptist Church for a year. City Council approved the first reading of an ordinance considering the rezoning of the property to "GU" Governmental Use contingent on the approval of the special exceptions by the Board of Zoning Adjustment. The Grapevine/Colleyville I.S.D. intends to purchase the eastern portion on the current church site, along with one existing building. The building will be used for offices and training of school personnel. The rear of the site will become playground. The proposed site is contiguous to the current Timberline Elementary School. The existing school will be modified by adding additional classrooms, and parking behind the existing school buildings. Therefore, additional space is required for playground area, which will be placed upon the property being purchased from the Memorial Baptist church. The School District and Memorial Baptist Church have prepared a replat of the site, and have applied for a rezoning of the property. The front portion of the Memorial Baptist Church site is being purchased to be used as a day care center. Therefore, a zoning request has been made for that portion of the site. BACKGROUND INFORMATION: The applicant submitted request Z95-19 to rezone the front 2.779 acres of the Memorial Baptist Church from "R-7.5" Single Family to "R -MF -1" Multifamily District and a Conditional Use Permit CU95-32 to allow a day care facility. A day care facility is not a permitted use in the "R-7.5" Single Family District. Additionally, the applicant has submitted deed restrictions to allow only day care facilities or church uses on the property. The deed restrictions, if approved, could only be amended through the public hearing process. The applicant will use the property for a day care facility and lease the sanctuary building to Memorial Baptist Church for a year. Additionally the Grapevine-Colleyville Independent School District has submitted request Z95-18 to rezone the rear 3.222 acres of the Memorial Baptist Church from "R-7.5" Single Family to "GU" Governmental Use. The School District is proposing to use the existing building as training and school offices. The Grapevine/Colleyville Independent School District is proposing to incorporate the rear portion of the Memorial Baptist Church facilities into the existing elementary school development. The expansion of the existing elementary school creates a need for a new playground area, which will be provided by eliminating portions of the paved areas at the rear of the existing Memorial Baptist Church property. City Council approved the first reading of an ordinance considering the rezoning of the property to "R -MF -1 " Multifamily and the conditional use permit for a day care center with deed restrictions contingent on the approval of the special exceptions by the Board of Zoning Adjustment.
