Any application for a change in zoning or for an amendment to the zoning ordinance sham have,
from the date of submittal, a period of four months to request and be scheduled on an agenda
before the Planning and Zoning Commission and City Council. If after said period of four months an
application has not been scheduled before the Commission and Council said application shall be
considered withdrawn, with forfeiture of all fng fees. The application, along with the required
filing fee may be resubmitted any time thereafter for reconsideration. Delays in scheduling
applications before the Planning and Zoning Commission and City Council created by city staff
shall not be considered a part of the four month period.

On Tuesday evening, December 17, 2013 at 7:30 P.M. in the City Council Chambers, 2nd
Floor, 200 South Main Street, Grapevine, Texas, the City Council and Planning and Zoning
Commission of the City of Grapevine will hold a public hearing to consider the following
items:
AMENDMENTS TO COMPREHENSIVE ZONING ORDINANCE 82-73 - The City Council
and the Commission will consider amendments and changes to the Comprehensive Zoning
Ordinance, No. 82-73, same being Appendix D of the Code of Ordinances as follows:
Creation of a new Zoning Ordinance District, Section 42, Supplementary District
Regulations relative to sale of alcoholic beverages and any other additions, deletions, or
changes to various sections, articles and provisions contained in said Ordinance No. 82-
73.
CU13-19A - La Buena Vida - submitted by Virginia Puente for property located at 416 East
College Street and platted as Lot 1 R3, Block 22R1, City of Grapevine. The applicant is
requesting a conditional use permit to allow the possession, retail sales, storage and on
and off -premise consumption of alcoholic beverages (beer and wine only) and outside
dining in conjunction with a restaurant. The property is currently zoned "GV" Grapevine
Vintage District and is owned by Puente Land Holdings.
PD1 3-02 — The Source — submitted by Biatwic LLC for property located at 520 South Main
Street and platted as Lot 2R, Block 4, Original Town of Grapevine. The applicant is
requesting a planned development overlay to allow a residential component in the Central
Business District. The property is currently zoned "CBD" Central Business District and is
owned by Biatwic LLC.
CU13-30 — Traveler Trader Hotel Stores - submitted by Traveler Trader Hotel Stores for
property located at 1501 Gaylord Trail #1241 & #1271 and platted as Opryland Addition.
The applicant is requesting a conditional use permit to amend the previously approved site
plan to allow off -premise consumption of alcoholic beverages (beer and wine only) in
conjunction with gift stores located with the Gaylord Texan. The property is zoned "PCD"
Planned Commercial Development and is owned by Opryland Hotel.
CU13-31 — Texas Gun Experience - submitted by Texas Gun Experience for property
located at 1901 South Main Street and platted as Lot 1, Block 3, Metroplace 2nd
Installment. The applicant is requesting a conditional use permit to amend the previously
approved site plan for a planned commercial center to allow an indoor shooting facility.

The property is zoned "CC" Community Commercial and is owned by James R Stacy.
CU13-32 — The Peavler Group - submitted by Homeyer Engineering for property located
at 2215 Westgate Plaza and proposed to be platted as Lot 2R, Block 2R, Westgate Plaza.
The applicant is requesting a conditional use permit to amend the previously approved site
plan for a planned commercial center to allow a new office building. The property is zoned
"CC" Community Commercial and is owned by Highway 114 Prospect.
CU13-33 — Silver Lake Crossings — submitted by Grapevine Metro Hotels GP LLC for
property located at 2200 & 2250 Bass Pro Court and platted as Lot 1, Block 1, Silver Lake
Crossings and Lot 2A, Block 1, The Bluffs At Grapevine. The applicant is requesting a
conditional use permit to establish a planned commercial center and a 20 foot pole sign.
The property is zoned CC Community Commercial and is owned by Grapevine Metro
Hotels GP LLC.
After all parties have been given an opportunity to speak, the public hearing will be closed
and the Commission and the City Council will deliberate the pending matters. Please

Because you are a property owner within 200 feet of the subject tract of land as
shown by the last City -approved tax rolls, you received this notice. If you cannot or
do not wish to attend the hearing, the attached form is provided for your
convenience. If owners of more than 20% of the property within 200 feet of the
subject tract object to the case, a 3/4 vote of the City Council is required to approve

Purpose of Request:
The public hearing is to consider an application submitted by Homeyer Engineering for
property located at 2215 Westgate Plaza and proposed to be platted as Lot 2R, Block 2R,
Westgate Plaza. The applicant is requesting a conditional use permit to amend the
previously approved site plan for a planned commercial center to allow a new office
building. The property is zoned "CC" Community Commercial and is owned by Highway
114 Prospect. A copy of the site plan is on file with the Development Services Department.

REQUESTED CONDITIONAL USE AND COMMENTS:
The applicant is requesting a conditional use permit to amend the previously approved site
plan of CU 12-39 (Ord. 2012-56) for a planned commercial center, specifically to allow the
development of an office building.
The applicant is proposing to develop a 8,325 square foot, single story, office building on a
platted lot within an undeveloped portion of Westgate Plaza. Required parking for the
proposed use is 35 -spaces; 35 -spaces are provided. A nine -foot high metal carport is
proposed for five parking spaces.
The property is currently zoned "CC" Community Commercial District and is vacant.

HISTORY OF TRACT AND SURROUNDING AREA:
The subject property was zoned "R-2" Two Family Residential prior to the 1984 City
Rezoning. During the City Rezoning the subject site was rezoned to "R-3.5" Two Family
District. At a January 16, 1990 meeting, Council approved a rezoning (Z89-17) of the
subject site to "CC" Community Commercial District and the property has remained vacant.
The Grapevine Plaza Shopping Center to the east was rezoned from "C-2" Community
Business District to "CN" Neighborhood Commercial District during the 1984 City Rezoning.
It was later rezoned (Z85-10) to "SP" Site Plan District to allow the development of a
shopping center with a grocery store with off -premise alcohol beverage sales. At the April
15, 2003 meeting, Council approved a conditional use permit (CU03-10) for a planned
commercial center for a future retail/office complex. At the August 15, 2006 meeting a
conditional use permit (CU06-31) was approved on the subject site to allow the
development of a medical office building. A zone change request (Z06-12) and a planned
development overlay (PD06-08) was approved by council at their October 17, 2006
meeting rezoning the property immediately to the north of the subject site which was part of
the original planned commercial center, from "CC" Community Commercial District to "R-
TH" Townhouse District with a planned development overlay to allow for reduced setbacks,
and private streets. At the April 17, 2007 meeting conditional use permit CU07-04 (Ord.
2007-17) was approved on the subject site to allow for the development of a veterinary
hospital. At the August 27, 2008 meeting of the Site Plan Review Committee, CU08-18
was approved to allow for reduced square footage and elevation changes to for a medical
office building (CU06-31). A zone change request Z09-02 (Ord. 2009-23) was approved at
the June 16, 2009 meeting rezoning the property immediately to the south, which was part
of a larger 18.22 acres of a boundary adjustment with the City of Southlake, from "R-20"
Single Family District to "CC" Community Commercial District. A planned development
overlay (PD10-03)was approved at the May 18, 2010 meeting forthe property immediately
to the north of the subject site to allow 22 detached townhomes. Conditional Use Request
CU12-39 (Ord. 2012-56) approved at the October 16, 2012 joint public hearing allowed for
an expansion of the veterinary hospital site and allowed overnight stays within the existing
building.

SOUTH: State Highway 114, City of Southlake
EAST: "R-5.0" Zero -Lot -Line District and "CN" Neighborhood Commercial

The subject tract is located within "Zone A" Zone of Minimal Effect as defined on the
"Aircraft Sound Exposure: Dallas/Fort Worth Regional Airport Environs" Map. Few
activities will be affected by aircraft sounds in "Zone A" except for sound sensitive activities
such as auditoriums, churches, schools, hospitals, and theaters. The applicant's proposal
is an appropriate use in this noise zone.
The Master Plan designates the subject property as a Commercial land use. The
applicant's request is in compliance with the Master Plan.

This letter is to verify that your request for a conditional use permit located at 2215 Westgate Plaza
and platted as Lot 2R, Block 2R, Westgate Plaza, to allow the development of an office building
was approved by the City Council on December 17, 2013.
On December 17, 2013, the Planning and Zoning Commission recommended the City Council
approve the request.
Any changes to a site plan approved with a conditional use ora special use (no matter how
minor or major) can only be approved by city council through the public hearing process.
No Conditional Use Permit shall be valid for a period longer than one (1) year from the date on
which the City Council grants the Conditional Use, unless within such one (1) year period: (1) a
Building Permit is obtained and the erection or alteration of a structure is started, or (2) an
Occupancy Permit is obtained and a use commenced.
The City Council may grant one additional extension not exceeding one (1) year, upon written
application, without notice or hearing. No additional extension shall be granted without complying
with the notice and hearing requirements for an initial application for a Conditional Use Permit.

As the owner of Lot 1, Block 2R, Westgate Plaza in Grapevine, Texas, we have reviewed the
plans provided to use by the developer. Based on our review, we do not object to the developer
closing the existing drive aisle and installing a proposed curb inlet to collect the drainage. We
understand that these improvements will become our property and we will be responsible for the
operation and maintenance of these improvements after the construction is complete. We also
understand that the fire lane on our property will be modified to reduce the length of the dead
end fire lane as a result of the drive aisle closure. We understand that as a result of the
shortened fire lane, we will still maintain the required fire protection coverage as required by the
City of Grapevine.
