Boyle, Jr. City Attorney Linda Huff City Secretary CALL TO ORDER Mayor Tate called the meeting to order at 7:00 p.m. ; ITEM 1 . EXECUTIVE SESSION i Mayor Tate announced the City Council would conduct a closed session regarding pending or contemplated litigation relative to (1) Dallas/Fort Worth Intemational Airport Board's decision relative to proposed Runway 16/34 West and (2) Park Cities MUD v City of Grapevine and City of Dallas Water Rights Case under Section 551 .071, Texas Government Code. Upon reconvening in open session in the Council Chambers, Mayor Tate asked if there was any action necessary relative to the closed session. City Manager Trent Petty stated there was no action necessary relative to pending or contemplated litigation relative to (2) Park Cities MUD v City of Grapevine and City of Dallas Water Rights Case under Section 551 .071, Texas Govemment Code. NOTE: Council Member Pittman arrived at this time. Regarding (1) Dallas/Fort Worth International Airport Board's decision relative to proposed Runway 16/34 West, City Manager Petty requested approval of a resolution ' authorizing the City Manager to enter into a contract to engage appropriate legal counsel to continue the challenge to the Federal EIS via the Petition for Writ of 06/21/94 Certiorari before the United States Supreme Court. Council Member Spencer, seconded by Council Member Wickman, offered a motion to approve a resolution authorizing the City Manger to enter into a contract to engage appropriate legal counsel to continue the challenge to the Federal EIS via the Petition for Writ of Certiorari before the United States Supreme Court. The motion prevailed by the following vote: Ayes : Tate, Ware, Spencer, Traverse, Pittman & Wickman : Nays : None Absent : Wilbanks RESOLUTION N0. 94-34 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF GRAPEVINE, TEXAS FINDING AND DETERMINING THAT IT IS IN THE BEST INTEREST OF THE HEALTH, SAFETY AND WELFARE OF THE CITIZENS OF THE CITY OF GRAPEVINE TO APPEAL THE DISTRICT OF COLUMBIA COURT OF APPEALS' DECISION AND DIRECT THE CITY MANAGER TO ENGAGE COUNSEL TO FILE A PETITION FOR CERT/ORARI WITH THE UNITED STATES SUPREME COURT AND TAKE OTHER NECESSARY AND APPROPRIATE ACTION; AND PROVIDING AN EFFECTIVE DATE NOTE: City Council continued with the Regular City Council meeting. City Council and Planning & Zoning Commission to conduct a public hearing relative to Conditional Use Application CU94-12 submitted by Romacorp, Inc. for Tony Roma's requesting a waiver to specific requirements of Section 47E.2 pursuant to Section 47.F of Ordinance No. 82-73, as amended, and requesting a conditional use permit for an amendment to a site plan approved by Ordinance No. 94-04 to expand the commercial development to allow the possession, storage, retail sale, and on-premise consumption of alcoholic beverages (beer, wine, and mixed beverages) in conjunction with the operation of a restaurant with a forty foot (40'1 pole sign. The property is located at 805 State Highway 114 West and is zoned "CC" Community Commercial District Regulations. 4. Consider an increase in the contract fee with Innovative Transportation Strategies, Inc. from 54,800.00 to 55,900.00 for professional expert witness services, authorize staff to make payment of outstanding bills incurred against this contract during the Robert Taylor Tract condemnation case. Public Works Director recommends approval. 15. Consider an agreement with Texas Department of Transportation for construction, maintenance and operation of safety lighting systems within the City of Grapevine at the Interchange of State Highway 121 and State Highway 26 with Farm to Market 2499. PRESENTATION. MR. ROBERT POINDEXTER � Mayor Tate, on behalf of the Heritage Foundation and Historic Preservation Commission, presented a plaque to Mr. Robert Poindexter in appreciation for his leadership and outstanding commitment to the history of Grapevine through efforts in support of The Palace Theatre and its programs, the Grapevine Heritage Center and the Historic Preservation Commission. ITEM 2. OATH OF OFFICE, PLANNING & ZONING COMMISSION MEMBERS City Secretary Linda Huff administered the Oath of Office to reappointed Planning & Zoning Commissioners Mr. Curtis Young and Mr. Steve Stamos, and to newly appointed member Ms. Kathy Martinez. ITEM 1 . PUBLIC HEARING, CONDITIONAL USE APPLICATION CU94-12, ROMACORP, INC./TONY ROMA'S Mayor Tate declared the public hearing open. Planner Marcy Ratcliff advised Conditional Use Application CU94-12 had been filed ,. by Romacorp, Inc. for Tony Roma's requesting a waiver to specific requirements of Section 47E.2 pursuant to Section 47F of Ordinance No. 82-73, as amended, and requesting a conditional use permit for an amendment to a site plan approved by Ordinance No. 94-04 to expand the commercial development by adding a fourth lot containing 60,000 square feet and to allow the possession, storage, retail sale, and on-premise consumption of alcoholic beverages (beer, wine, and mixed beverages) in conjunction with the operation of a restaurant with a forty foot (40') pole sign. The property is located at 805 State Highway 114 West and is zoned "CC" Community Commercial District Regulations. The proposed 6,165 square foot restaurant will provide seating for 305 persons and 106 parking spaces (102 requiredl. Mr. David Boyd was present to address any questions from the City Council and Planning & Zoning Commission. There were no questions. ' Planner Marcy Ratcliff advised Conditional Use Application CU94-14 had been submitted by White's Enterprises (King Arthur's Castle) requesting a waiver to specific requirements of Section 47E.2 pursuant to Section 47F of Ordinance No. 82-73, as amended, and requesting a conditional use permit for an amendment to a site plan : approved by Ordinance No. 84-24 to include a self serve gasoline service station and full convenience store. The property is located at 920 East Northwest Highway and is zoned "SP" Site Plan and "HC" Highway Commercial District Regulations. Arthur and Darlene White were present to address questions from the City Council and Planning & Zoning Commission. There were no questions. APPENDIX D, COMPREHENSIVE ZONING ORDINANCE NO. 82-73. SECTION 23A GRAPEVINE VINTAGE DISTRICT REGULATIONS: SECTION 58 PARKING AND LOADING AREA DEVELOPMENT STANDARDS; AND SECTION 60 SIGN STANDARDS Mayor Tate declared the public hearing open. Planner Marcy Ratcliff advised the proposed amendments to the Grapevine Code of Ordinances, Appendix D, Comprehensive Zoning No. 82-73, as amended, were as follows: Section 23A Grapevine Vintage District relative to allowing the building height of a winery, or a wine tasting structure, to exceed the 35 feet maximum height limit up to 50 feet or less only as a conditional use, if they are not contiguous to a single family residential district; Section 58 Parking and Loading Area Development Standards relative to requiring internal cross access between all nonresidential lots and development; and Section 60 Sign Standards allowing projecting signs to be a minimum of eight (8) feet above the sidewalk and limited to the height of the roof or eave line of the principal building. There were no questions from the Planning & Zoning Commission or the City Council. Mayor Tate invited guests present to comment regarding the proposed amendments. DENNIS KOPER Dr. Dennis Koper, 3108 Joyce Way, addressed the City Council on behalf of homeowners in Stonewood Phase I regarding their concerns that the proposed - Stonewood Phase II development does not agree with the original intent of the developers as discussed and approved by the City Council and Planning & Zoning Commission on July 17, 1990. He commented that certain criteria was to become a part of the final plat and filed with deed restrictions and it is their concern that the final plat was not filed as promised by the developer. He stated their objections that Stonewood Phase II would develop in a manner that is inconsistent with the Phase I development and inconsistent with a promise previously made by the developers to the City Council, Planning & Zoning Commission and homeowners regarding deed restrictions. He summarized as follows: homeowners concerns that promises by a developer may not be kept, homeowners concerns regarding largest investment in their homes, and homeowners concerns about integrity of a development being breached which would directly affect the value of Stonewood Phase I homes. INTERLOCAL AGREEMENT AUTO THEFT TASK FORCE PARTICIPATE WITH TARRANT COUNTY Police Chief Martin requested approval of an interlocal agreement with Tarrant County to participate in the Tarrant County Auto Theft Task Force. The agreement provides 100% reimbursement for all salary, benefit and equipment cost from State funds allocated by the Texas Auto Theft Prevention Authority for FY95 and FY96. After FY96, the City is responsible for 20% the first year, 40% the second year, etc. Grapevine's participation in the task.force would provide invaluable experience for one investigator and additional help in combatting the costly crime of auto theft.
