The City Council of the City of Grapevine, Texas met in Special Session on this the
5th day of April, 1994 at 6:30 p.m. in Conference Room #204, 307 West Dallas
Road, with the following members present to-wit: '

CALL TO ORDER
Mayor Tate called the meeting to order at 6:35 p.m.
ITEM 1 . EXECUTIVE SESSION
Mayor Tate announced the City Council would conduct a closed session regarding
pending or contemplated litigation relative to (1) Dallas/Fort Worth International
Airport Board's decision relative to proposed Runway 16/34 West; (2) City of
Grapevine v Schollmeyer; (3) City of Grapevine v Vilbig; (4) Johnson v City of
Grapevine; (5) City of Grapevine v Aubrey Smith; (6) In Re: Russell Coleman; (7) In
Re: Cynthia Coleman; and (8) Patrick Camblin v City of Grapevine under Section
551 .071, Texas Government Code.
Upon reconvening in open session in the Council Chambers, Mayor Tate asked if there
was any action necessary relative to the closed session. City Manager Trent Petty
stated there was no action necessary relative to pending or contemplated litigation ,
relative to (1 ) Dallas/Fort Worth International Airport Board's decision relative to
proposed Runway 16/34 West; (2) City of Grapevine v Schollmeyer; (3) City of
Grapevine v Vilbig; (4) Johnson v City of Grapevine; (5) City of Grapevine v Aubrey
Smith; (6) In Re: Russell Coleman; (7) In Re: Cynthia Coleman; and (8) Patrick
Camblin v City of Grapevine under Section 551 .071, Texas Government Code.

ADJOURNMENT
Council Member Wickman, seconded by Council Member Traverse, offered a motion

Shoot" Free Throw Contest in Indianapolis, Indiana.
2. Mayor Tate to proclaim April 10-16, 1994 as National Telecommunicators
Week honoring and recognizing the City's Telecommunicators.
3. Mayor Tate to present a proclamation to Ms. Kay Wehunt proclaiming April
18-22, 1994 as National Organ and Tissue Donor Awareness Week.
4. Mayor Tate to present Awards of Achievement issued by the Texas Safety
Association to Street Superintendent Danny Porter, Deputy Fire Chief David
Anderson and Police Corporal Wayne Eichel in recognition of their outstanding
service and worthy accomplishments in accident prevention.
JOINT PUBLIC HEARINGS
5. City Council and Planning & Zoning Commission to conduct a public hearing
regarding proposed amendments to the Comprehensive Master Plan 1974-1994
Updated 1987 Map 2 Land Use Plan relative to State Highway 360 Corridor
Study.
6. City Council and Planning & Zoning Commission to conduct a public hearing to
receive comments from property owners on future development of recently
annexed property located in northwest Grapevine to assist City Staff in master
land use planning of the area.

7. City Council to conduct a public hearing relative to the concept plan of Bear
Creek Park and take any necessary action.
8. City Council to conduct a public hearing to receive citizen input relative to
Paragon Cable's franchise and relative to Paragon Cable filing its initial '
permitted basic service cable rates, consider a resolution tolling the initial ,
permitted basic service rates for a period not to exceed 90 days and take any '
necessary action. ,
NEW BUSINESS
9. Consider appointments to the Impact Fee Advisory Committee and take any
necessary action.
10. City Council to consider a resolution instituting annexation proceedings for four
tracts of land located in the City's Dallas and Denton Counties extra territorial ,
jurisdiction area, authorize preparation of a service plan and take any necessary
action.
CONSENT AGENDA
Consent items are deemed to need little Council deliberation and will be acted upon
as one business item. Any member of the City Council or member of the audience
may request that an item be withdrawn from the consent agenda and placed before
the City Council for full discussion. Approval of the consent agenda authorizes the
City Manager, or his designee, to implement each item in accordance with Staff
recommendations.
; 11 . Consider authorizing the City Manager to execute Hold Harmless Agreements
with Burger Street, Inc. for use of property located at 120 and 122 South Main
Street beginning 7:00 a.m. Friday through 8:00 p.m. Sunday during Main
Street Days and GrapeFest festivals each year, as long as Burger Street, Inc.
is the property owner. Convention & Visitors Bureau Director recommends
approval.
12. Consider awarding a contract to Walker & Associates Surveying, Inc. to
establish in the field the common boundary between the cities of Coppell and
Grapevine based upon the court ruling on the annexation case, authorize staff
to execute said contract. Public Works Director recommends approval.
13. Consider awarding a materials testing contract for the East Side Sanitary Sewer
Outfall and South Ball Street Sanitary Sewer Line Construction Project to
Southwestern Laboratories, Inc., authorize staff to execute said contract
Public Works Director recommends approval.
14. Consider an amendment to the design contract on East Wall Street (Coppell
Road) Reconstruction Project with Huitt-Zollars, Inc. and authorize staff to
execute said amendment. Public Works Director recommends approval.
15. Consider a resolution establishing minimum wage rates for street, drainage, '
water and wastewater construction projects within the corporate city limits of
the City of Grapevine, Texas. Public Works Director and Personnel Director
recommend approval.
16. Consider ratifying rescission of Bid 94-506 Provide and Install Sod in Medians ,
to Hutchins Sod & Landscape, Inc. and re-award Bid 94-506 to the next lowest '
and best bidder, Bush Landscaping, Inc. to provide and install sod in certain '
medians. Staff recommends approval. '
17. Consider awarding Request For Proposal 94-512 Bank Depository Contract to
First National Bank of Grapevine and authorize the City Manager to enter into
a safekeeping agreement. Finance Director recommends approvaL '
18. Consider awarding Bid 94-513 Tree and Shrub Watering Contract to the lowest
and best bidder meeting specifications: Jasper Hayes Company and Earth
Works and to establish contract pricing for the watering of trees and shrubs '
along Dallas Road and Baylor Parkway. Staff recommends approval.
19. Consider approval of the minutes of the March 22, 1994 City Council meetings.
City Secretary recommends approval.

ITEM 1 PRESENTATION HONORARY AMBASSADOR AT LARGE. MR. A. J. ,
RIDGEWAY
Mayor Tate presented a proclamation to Mr. A. J. Ridgeway, age 9, naming him as
Honorary Ambassador at Large to represent Timberline Elementary School and the City
of Grapevine at the National Finals of the Elks "Hoop Shoot" Free Throw Contest in
Indianapolis, Indiana. Mr. Ridgeway won the North Central Texas District
Championship shooting 25 of 25 free throws, the Texas State Championship shooting
23 of 25 free throws, and the National Regional Semi-Finals shooting 23 of 25 free
throws, plus a sudden death 5 of 5.
ITEM 2. PRESENTATION. PROCLAIMING NATIONAL TELECOMMUNICATORS
WEEK
Mayor Tate presented a proclamation to Ms. Sheri Sanderson, Technical Services
Manager, proclaiming April 10-16, 1994 as National Telecommunicators Week.

DONOR AWARENESS WEEK

1994 as National Organ and Tissue Donor Awareness Week. '
ITEM 4. PRESENTATION, AWARDS OF ACHIEVEMENT, TEXAS SAFETY
ASSOCIATION '
Mayor Tate presented Awards of Achievement issued by the Texas Safety Association '
to Street Superintendent Danny Porter, Deputy Fire Chief David Anderson and Police
Corporal Wayne Eichel in recognition of their outstanding service and worthy
accomplishments in accident prevention. Risk Management worked in cooperation
with the Fire, Police and Public Works Departments in Fiscal Year 1993 to certify the '
recipients as Defensive Driving instructors. Each Department has used the
certification to continually train the City of Grapevine employees in safe defensive
driving techniques.

ITEM 4A. PRESENTATION, COUNCIL MEMBER WILL WICKMAN
Convention & Visitors Bureau Director P. W. McCallum, on behalf of the Grapevine
Heritage Foundation Board, recognized Council Member Will Wickman for his courage
on the night of March 24, 1994 by presentation of a plaque and vintage fire
extinguisher. Council Member Wickman contained the fire (started by an arsonist)
under the historic Section House until fire units arrived on the scene. ;
ITEM 5. PUBLIC HEARING. PROPOSED AMENDMENTS TO THE
COMPREHENSIVE MASTER PLAN 1974-1994 '
Mayor Tate declared the public hearing open.
Planner Marcy Ratcliff reported the Planning & Zoning Commission had met
January 18 and March 1, 1994 to review the current zoning, land use maps, floodway
and flood plain areas along the State Highway 360 Corridor. The changes
recommended by the Planning & Zoning Commission effected four properties: City
of Grapevine property, the Glade Tree and Arbormont Estates Additions on Glade '
Road and four properties west of Arbormont Estates. The City's property (Bear Creek
Park) is proposed to be redesignated from Low Density Residential and Medium '
Density Residency to Governmental Use. Glade Tree and Arbormont Estates Additions
are proposed to be redesignated from Low Intensity Commercial to Low Density
Residential. The remaining proposed change is from Neighborhood Commercial to
Low Density Residential.
There were no questions from the City Council or the Planning & Zoning Commission. '
Mayor Tate invited guests present to comment regarding the proposed amendments
to Map 2 Land Use Plan of the Comprehensive Master Plan. No one wished to speak.

As interested residents living in the Glade Tree Estate neighborhood, we are
responding to your letter in reference to the 360 corridor expansion. As residents of
5302 Cambridge Court, Grapevine, Texas, 76051, our current lifestyles have been
directly affected due to street access and noise-level on the account of the increased
traffic on Glade Lane.

We need to know how we as residents in this area will be directly affected as a result il
of the 360 Corridor expansion.
We are requesting that Glade Road not run across the 360 corridor. This would
reduce the amount of traffic on Glade Road due to the vehicles travelling this road to
enter DFW Airport. There has also been an increased amount of commercial semi-
tractor trailers travelling this road recently. As it is, we are continuing to have
problems in trying to get out of our neighborhood, and in sleeping. Restricting the
Glade Road intersection at the 360 corridor should reduce this volume of non-
residential related traffic.
We are requesting that any information on future plans for this particular residential '
area be sent to us as soon as possible in order for us to plan our future in this area.

ITEM 6. PUBLIC HEARING. MASTER LAND USE PLANNING. NORTHWEST �
GRAPEVINE
Mayor Tate declared the public hearing open.
Planner Marcy Ratcliff stated that during the March 1, 1994 Planning & Zoning
Commission workshop, the Commission requested Staff to schedule a joint public
hearing with the City Council to receive input from property owners regarding
proposed land uses for the northwest Grapevine area that was recently annexed into
the City. Ms. Ratcliff reviewed maps depicting the current land uses, current zoning
and current property owners for the recently annexed area that contain 198 persons,
28 single-family residences and 63 mobile homes. She noted the majority of the area
is located in the 572 foot Lake Grapevine flowage easement. Ms. Ratcliff stated the
purpose of the public hearing was to assist the City Council, the Commission and

property owners in realizing what is actually in place and what planning steps need
to be taken to draft a land use plan for the area.
Mayor Tate invited guests present to comment regarding the proposed land uses for
the annexed area. The following guests spoke:
Mr. Phil Parker, property owne�, commented regarding possible recreational uses for
the lake area, i.e. driving range, batting range, restaurant. He stated there were no
plans for any commercial uses.
Mr. James Light, 2399 North Lonesome Dove, questioned the safety issue of the �
firing range located in the area as his home had bullet holes is some of the walls. City
Manager Petty advised the Police Department would evaluate the safety of the firing
range. '
Mr. Scott Ritzman and Mr. Gary Schragin, of 2299 Lonesome Dove Road, stated their
goals were to continue operation of Lonesome Dove Ranch as a family entertainment
facility by providing high quality entertainment and enhance outdoor amenities to a
true "ranch" attraction. They commented the ranch atmosphere would bring in
commerce and tourism to the City.
Ms. Pat Bond, potential property owner on Lonesome Dove, expressed concern
regarding the shooting range and the safety issues that would be involved for her
' family. City Manager Petty advised the City would be able to impose safety ,
standards, but possibly would not be able to shut down the operations.
Mr. Jerry Yates, property owner, questioned when water and sewer would be
provided to the area. City Manager Petty responded there was no projected date for ,
water and sewer extension to the area and that the purpose of the public hearing was
to determine proposed land uses for the area for the City to then have the ability to
determine the capacity needs (water and sewer) for the area.
Mayor Tate invited those present that did not wish to speak to submit their comments
in writing to City Staff, and if necessary, another public hearing could be scheduled.
Commissioner Young, seconded by Commissioner Balvin, offered a motion to close
the public hearing. The motion prevailed by the following vote:

Mayor Tate announced the Planning & Zoning Commission would recess to
Conference Room #204 to consider published business. '
The City Council remained in session in the Council Chambers to consider published
business.
ITEM 6A. CITIZENS REQUESTS. MR. & MRS. DANNY ESTEP
Danny and Margaret Estep, 2121 Santa Fe Trail, addressed the City Council
concerning an incident on March 11, 1994 at Oak Grove Ball Park involving their three
year old son. Their son was not seriously injured when he fell in a hole that was dug
for installation of a scoreboard, but they requested the City Council and City Staff '
take extra safety measures and precautions to ensure City parks are safe for children '
participating in sports and those children attending sports events. City Manager Petty
stated that procedures for digging and maintaining construction holes have been
altered and each City department has been notified.

Parks & Recreation Director pouglas Evans presented the concept plan of Bear Creek
Park located in south Grapevine. The proposed schematic addresses citizen concerns
that were expressed in a public hearing held in July, 1992, relative to the soccer field
and parking lot that were proposed to be located off Bear Run Drive. Mr. Evans
briefly reviewed the development process for the Texas Parks & Wildlife Department
matching grant application for the park that will include 1 .5 miles of trails, two multi-
purpose athletic fields, playground, sand volleyball court, observation pavilion, two
parking lots, a soccer field, picnic areas, and interpretive stations. Mr. Evans
reviewed the time schedule for the construction of the park and stated it should be
completed in April 1995.
Mayor Tate invited guests present to comment regarding the concept plan of Bear
Creek Park. The following spoke in favor of the proposed plan and expressed
appreciation to City Staff for working with citizens to address concerns expressed in
previous meetings:

ITEM 8. PUBLIC HEARING, PARAGON CABLE FRANCHISE AND INITIAL
PERMITTED BASIC SERVICE CABLE RATES
Mayor Tate declared the public hearing open.
Interim Director of Internal Services Michael Webb stated the public hearing was to
receive citizen input concerning cable services provided by Paragon Cable and relative
to Paragon Cable filing its initial permitted basic service cable rates. At the conclusion
of the public hearing, Mr. Webb recommended the City Council consider a resolution
postponing the initial permitted cable rates for an additional period not to exceed 90
days from April 9. Staff will utilize the 90 days to perform a professional study of
Paragon's rate structure that takes into consideration other systems, comparative

costs and FCC guideline interpretations.
Mr. Webb then introduced Mr. Buz Nesbitt, Paragon Cable Vice President of
Operations, to present the 1993 Ann�al Performance Report. Mr. Nesbitt reported the
company had paid 5163,671 .99 in franchise fees to the City and he briefly reviewed
the level of service provided and the continued growth in local community
programming. During the presentation, Mr. Nesbitt stated the company does not see
any rate change at the present time.

As a two year subscriber to Paragon, I consider the quality of the service provided to
be"adequate" and the value of the service as "acceptable". However, Paragon has '
recently implemented a billing practice I find to be intolerable.

Specifically, Paragon now imposes finance charges onto bills thev consider to be past
due, even though the service has not been rendered. For example, the cable service
' for the month, April 1 to April 30, will be invoiced on April 1 and payable in full by

April 15; in the event payment is received on April 16 or beyond, finance charges are
; being levied. Therefore, Paragon penalizes a subscriber with late charges for a service
� that has not been rendered.

I will be unable to attend this meeting in regards to Paragons cable rate. Therefore
am sending this to let you know I certainly think Paragons rate are too high. They
recently started charging for their TV guide, remote control and batteries also dropped
a couple of programs from basic. As I am an oldster and can't get around too much
I depend on TV to occupy my time. I certainly think there should be a seniors
discount. ;
I think it great that Grapevine's city management cares enough to watch these rates
to the citizens benefit. I am happy to be able to live in a clean, caring, well run city.

' It is my understanding that a public hearing regarding the local franchise agreement
� with Paragon Cable will be conducted at the Council meeting on Tuesday evening. '
� I wanted to go on record as indicating that the school district has been particularly
pleased with the working relationship we have had with out local cable company for
several years.
As I have visited other school districts, most are amazed that we have a full time
channel for reporting school events, menus, student and staff recognitions, and other
pertinent school information. I know without a doubt that Grapevine residents depend
on the school channel for information. If you ever need proof, just let me forget one

day to put on that day's menu. F
In addition, Paragon Cabie has gone above and beyond to provide us with a return line
in order that the school may "broadcast" its own programming. Many plans are being
discussed to provide even more programming, and we are regularly discovering new
methods for taking advantage of this service.
Furthermore, during those times when there have been problems on the line, their
repair crews have responded within an hour or so to correct the problem.
Thank you for giving me this opportunity to indicate to you our feelings regarding the
relationship between Paragon Cable and the Grapevine-Colleyville ISD. We are
pleased to report that Paragon has been a significant contributor to the
communications efforts of our school district.

The Grapevine Historical Society wishes to publicly acknowledge the very significant
contribution Paragon Cable is making to the Society's oral history project.
Some years ago, the Society completed an oral history project on audio tape. The '
tapes and transcriptions are available at the Grapevine Library. ',
Through the generosity of Paragon Cable, the individual interviews in the current
series have been videotaped. Thus we have available on video notable individuals
speaking about Grapevine history. Transcriptions will be available also.
Paragon has been very cooperative in making the tapes and is in the process of editing
them. This has enabled the Society to capture special moments with persons (who)
are very knowledgeable about out city's past.
We are pleased to have this opportunity to publicly thank Paragon Cable for their
invaluable assistance with this project.

Commission also recommended Map 2 Land Use Plan be recolored indicating all �
available parks in green.
