PUBLIC HEARING Mayor William D. Tate called the joint meeting to order at 7:45 P.M., and Chairman Ron cook called the Planning & Zoning Commission deliberation session to order at 9.■5 P.MR Z94-12 & CU94-29 - LA BUENA VI DA VINEYARDS First on the Agenda for the Commission to consider and make a recommendation to the City Council was Zone Change Request Z94-12 and Conditional Use Request 0 P & z Minutes 10/18/84 CU94-29 submitted by Doctor Bobby Smith for La Buena Vida Vineyards to be located at 416 Fast college Street and proposed to be platted as Lot 1 R3, Block 22131, Original Town of Grapevine. The applicant is requesting to rezone 1.8 acres from "R- 7.5" Single Family District, within the college Street Historic Landmark District (FIL93- 01)f to "OV" Grapevine Vintage District and a conditional use permit to allow the possession,, storage, retail sale and on -premise and off -premise consumption of alcoholic beverages (wine only) in conjunction with a wine tasting facility. The applicant is also requesting a waiver to Section 47.1.2. in accordance with Section 47.F. Marcy Ratcliff, City Planner, told the Planning and zoning Commission and the City Council the applicant is proposing to use the existing buildings which contain a total of 3,082 square feet for a tasting room and bonded wine store. The applicant is proposing to construct a 5 foot masonry and tubular steel fence along the 30 foot front building line and a B foot wooden fence along the sides and rear. The applicant is providing 44 parking spaces which exceeds the 38 parking spaces required. The applicant went before the Historic Preservation Commission on October 12, 1994 and was granted a certificate of appropriateness by a vote of 4-0. Doctor Bobby Smith was introduced to present a slide presentation of the vinery in its present location and their request to develop a tasting room in Grapevine. Doctor Bobby Snaith introduced Mr. Henry Jones who resides at 409 Fast Hudgins Street, an adjacent property owner, to speak to the request. With no questions from the Planning and zoning Commission or the City Council, Mayor Tate asked if there were any other guests present who wished to speak to the request. Hinton, 5107 Shadow Glen, Grapevine, Texas Irwin Bowling, 522 South Dooley Street, Grapevine, Texas Diane Mcllvoy, 949 Meadowbrook Drive, Grapevine, Texas Linda Huff, City Secretary, reported there were six letters in favor of the request and one letter against with one letter requested to be read into the record from Ed and Martha Lubef proprietors of the Dorris House Cafe located at 224 East College Street. With nothing further to discuss the public hearing was closed. In the Commission's deliberation session, members discussed the location of the proposed wine tasting facility in an historical residential neighborhood. Member Marvin Balvin stated he would abstain from voting because he owned property in the immediate area. Chairman Ron Cools stated that no business use had been previously allowed east of Smith Street to preserve the historical residential character of the neighborhood. Although many members approved of a winery use they were not in favor of the mine tasting facility at the location. Steve Stamos moved to deny the requests for a zone change Z94-12 and conditional use request CU94-29 with a waiver to Section 47. E. 2. in accordance with 47.F. Cathy (Martin seconded the motion which prevailed by the following vote: Ayes: Cook, Martin, Starr os, Martinez and Newby Nays: Young Absent: Oliver Abstain: Balvin FINAL PLAT - LOTS 1 R3 BLOCK 2281 ORIGINAL TOWN OF GRAPEVINE Next for the Commission to consider and make a recommendation was the final plat of Lot 1 R3, Block 22131, original Town of Grapevine, being a replat of Lots 1 R, Block 2213; Lots 1 R1 & 1 R2. Block 23R; and portions of Lots 3 & 4, Block 23; Original Town of Grapevine submitted by Doctor Bobby Smith for La Buena Vida Vineyards. The applicant is requesting to plat three lots and a portion of two lots into one lot for a wine tasting facility and sales center. The property is located on the south side of East College Street and west of Dooley 3 P & z Minutes 10/18/94 Street. The site was formerly occupied by a church that was destroyed by fire. Cathy Martin moved, with a second by Curtis Young, to approve the Statement of Findings and the Final Plat Application of Lot 1133, Block 22131, original Town of Grapevine. The motion prevailed by the following vote: Ayes: Cook, Martin, Young, Stamos, Martinez, and Newby Nays: None Absent: Oliver Abstain: Balvin Z94-13 - DUNAWAY ASSOCIATES INC. Next for the Commission to consider and make a recommendation to the City Council was zone change request Z94-13 submitted by Dunaway Associates, Inc. to rezone 1.598 acres from "R -MF -2" Multifamily District to "CN" Neighborhood Commercial District for future development. Marcy Ratcliff, City Planner, told the Planning and Zoning Commission and the City Council the applicant is requesting to withdraw their application for their further consideration of the request. Cathy Martin, with a second by Steve Stamos, moved to allow the applicant to withdraw the application. The motion prevailed by the following vote: Ayes: Cook, Martin, Young, Balvin, Stamos Martinez and Newby Nays: None Absent: Oliver CU94--25 - RED ROBIN RESTAURANT Next for the Commission to consider and make a recommendation was conditional use request CU94-25 submitted by Red Robin International to amend the approved site plan of the CrossRoads of DFW Planned Commercial Center. The applicant is specifically requesting to amend the approved site plan of CU94-26 (ordinance 94-83) to allow the possession, storage, retail sale and on -premise consumption of alcoholic beverages (beer, vine and mixed beverages) in conjunction with a restaurant on Lot 1 R, Block 2, specifically addressed as 1 701 CrossRoads Drive. P & Z Minutes 10/18/94 restaurant containing 7,485 square feet with an occupancy load of 360 persons. The restaurant is providing 121 parking spaces which exceeds the minimum parking standard by 1 space. The proposed 20 foot pole sign is proposed to be located on William D. Tate Avenue and contains 39.332 square feet. With no guests to speak, no letters or petitions, the public hearing was closed. In the Commission's deliberation session, Marvin Balvin moved, with a second by Steve Starnos to approve CU94-25 with a waiver to Section 47.E.20 in accordance with Section 47.F. The motion prevailed by the following vote: Ayes: cools, /Martin, Young, Balvin, Stamos, Martinez and Newby Nays: None Absent: Oliver CU94-27 - STAR ENTERPRISES Next for the Commission to consider and make a recommendation was conditional use request CU94-27 submitted by Bob Norton for Star Enterprises to be located on Lot 2, Block 1, Mulberry Square Addition and specifically addressed as 5351 William D. Tate Avenue. The applicant is requesting a conditional use permit to allow the possession, storage, retail sales and off -premise consumption of alcoholic beverages (beer and wine only) in conjunction with a convenience store with gasoline sales and a drive through car wash. The applicant is also requesting a waiver to the site plan requirements of Section 47.E.2. in accordance with Section 47.F. Marcy Ratcliff, city Planner, explained the applicant is proposing a convenience store and a car wash containing 3,486 square feet. The car wash is proposed to be located at the rear of the convenience store. Seven parking: spaces are required and eight spaces are being provided. With no guests to speak, two letters of opposition, the public hearing was closed. In the Commission's deliberation session, Steve Starr os moved, with a second by Marvin Balvin, to approve conditional use request CU94-27 with a waiver to Section 47.E.2. in accordance with Section 47.F. The motion prevailed by the following vote: Ayes: Cook, Martin, Young, Balvin, Starnos, Martinez and Newby Nays; None Absent: Oliver 5 P & Z Minutes 10/18/94 CU94-28 - RACETRAC PETROLEUM Next for the Commission to consider and make a recommendation was conditional use request CU94-28 submitted by Timothy walker for Racetrac Petroleum to be located on Lot 4, Block 1, DEW Business Park and specifically addressed as 2 151 Ira E. Woods Avenue. The applicant is requesting a conditional use permit to allow the possession, storage, retail sale and off -premise consumption of alcoholic beverages (beer and ovine only) in conjunction with a convenience store with gasoline sales. The applicant is also requesting a waiver to site plan requirements of Section 47.E.2 in accordance with Section 47.F. Marcy Ratcliff, City Planner, explained the applicant is proposing to develop a 8,040 square foot convenience storewith alcoholic beverage and gasoline sales. The convenience store is proposed to have 8 pump islands underneath a canopy. The applicant is required to provide 15 parking spaces and is proposing to develop 17 parking spaces. The applicant will be allowed to have one drive entrance and is required to provide a left turn lane on Ira E. Woods Avenue. The applicant is providing internal cross access to the developments on either side of the subject property. Mr, Chris Wilkinson, representing Mustang Elite Car Wash, proposed development to the north of Racetrac, spoke regarding the requirement of the Public works Staff to require a left turn lane from Ira E. woods Avenue for their proposed development. He requested that the left turn lane be required of the Racetrac development only. With no other guests to speak to the request, no letters or petitions, the public hearing was closed. In the Corr missions's deliberation session, members discussed the recommendation by Staff to require a left turn lane from Ira E. Woods .Avenue. Cathy Martin, with a second by Curtis Young, moved to approve conditional use request CU94-28 requiring a left turn lane on Ira E. Woods Avenue and a waiver to Section 47.E.2. in accordance with Section 47.E. The motion prevailed by the following vote: Ayes: Cook, Martin, Nays: Done Absent: Oliver END OF PUBLIC HEARING Young, Balvin, Stamos, Martinez and Newby a P & z Minutes 10//8194 FINAL PLAT - LOT 1 BLOCK 1 GRAPEVINE KAWASAKI ADDITION Next for the Commission to consider and snake a recommendation was the Final Plat Application for Lot 1, Block 1, Grapevine Kawasaki Addition submitted by Neal Ivestor to develop a motorcycle dealership. The property is located on the north side of Ira E. woods Avenue west of Ball Street. The north property line abuts the St Louis Southwestern Railroad/DART right-of-way. The site contains 1.118 acres and is currently zoned "Ll" Light Industrial District. Marvin Galvin, with a second by Steve Stamos, moved to approve the Statement of Findings and the Final Plat Application of Lot 1, Block 1, Grapevine Kawasaki Addition. The motion prevailed by the following vote: Ayes: Cook, Martin, Young, Balvin, Stamos, Martinez and Newby Nays: None Absent: Oliver FINAL PLAT - STONEwOOD PHASE II Next for the commission to consider and make a recommendation was the Final Plat Application of Stonewood, Phase II submitted by Wright Development Co. The property is located on the north side of Barberry Road west of W. T. Parr Road. The site contains 28.789 acres and is currently zoned "R-1 2.5" Single Family District with a min" lot size of 14,000 square feet and is being platted to develop the site into a residential subdivision with 57 lots. The site is currently vacant and undeveloped land. Larry Frassinelli, Senior Civil Engineer, stated the applicant was requesting to table the application until November 15, 1994. Steve Stamos moved, with a second by Marvin Balvin, to table the Final Plat Application of Stonewood, Phase II until November 15, 1994. The motion prevailed by the following vote: Ayes: Cools, Martin, Young, Balvin, Stamos, Martinez and Newby Nays: None Absent: Oliver 7 P & z Minutes 10/18/94 FINAL PLAT - LOT 1 BLOCK 1 1ROSE PLAZA Next for the Commission to consider and make a recommendation was the Final Plat Application of Lot 1, Block 1, Rose Plaza submitted by Realty Capital Corporation to develop a professional office plaza. The property is located on the north side of Northwest Highway west of Dove Road. The site contains 1.048 acres and is currently zoned "PO" Professional office District. The site is currently vacant and undeveloped land. Curtis Young moved to approve the Statement of Findings relative to the Final Plat of Lot 1, Block 1, Rose Plaza and approve the Final Plat Application of Lot 1, Block 1, Rose Plaza Addition. Marvin Balvin seconded the remotion which prevailed by the following vote: Ayes: Cook, Martin, Young, Balvin, Btamos, Martinez and Newby Nays: None Absent: Oliver FINAL PLAT - LCT 1 BLOCK 1 BOWLES ADDITION Next for the Commission to consider and make a recommendation was the Final Plat- Application latApplication of Lot 1, Block 1, Bowles Addition submitted by Chris and Jonell Bowles to obtain a building permit for a single family house. The property is located on the north side of "Tall Street west of Pebblebrook Drive. The site contains 1.9197 acres and is currently undeveloped. The property is zoned "R-7.5" Bingle Family Residential District. Cathy Martin moved, with a second by Steve 8tamos, to approve the Statement of Findings and the Final Plat Application of Lot 1, Block 1, Bowles Addition. THE CROSSROADS OF DFW Next for the Commission to consider and make a recommendation was the final plat application of Lots 1 R & 2, Block 2, The CrossRoads of DFW Addition being a replat 0 P & z Minutes 10118194 of Lot 1, Block 2, The CrossRoads of DFW Addition submitted by James F. Mason, Trustee for Red Robin International. The applicant is replatting the property to divide one existing lot into 2 lots. Red Robin Restaurant is scheduled for Lot 2. The property is located on the south side of CrossRoads Drive east of William D. Tate Avenue. The site contains 8.795 acres and is zoned "CC" Community Commercial with a Planned Commercial venter designation. Steve Stamos, with a second by Curtis Young, moved to approve the Statement of Findings and the Final Plat Application of Lot 1 R & 2, Block 2, The CrossRoads of DFw. BLOCK 1 MULBERRY SQUARE Next for the Commission to consider and make a recommendation was the Final Plat Application of Lots 2 & 3, Block 1, Mulberry Square Addition submitted by Star Enterprises, New York General Partnership to develop a Texaco gasoline station on Lot 2, Block 1, Mulberry Square. The property is located on the north east corner of Glade Road and William D. Tate Avenue. The site contains 1.984 acres and is zoned "CC" Community Commercial. The mutual access easements shown on the plat correspond to internal drives within the future Planned Commercial Center,, Steve Stamos, with a second by Cathy Martin, moved to approve the Statement of Findings and the Final Plat Application of Lots 2 & 3, Block 1, Mulberry Square Addition.
