CALL TO ORDER
EXECUTIVE SESSION
1 . City Council to conduct a closed session relative to:
A. Pending or contemplated litigation relative to (1) Dallas/Fort Worth
International Airport Board's decision relative to proposed Runway 16/34
: West and (2) City of Grapevine v Aubrey Smith under Section 551 .071,
Texas Government Code.
City Council to reconvene in open session and take any necessary action
relative to pending or contemplated litigation under Section 551 .071,
Texas Govemment Code. '

CITY OF GRAPEVINE
The City Council of the City of Grapevine, Texas met in Special Session on this the
24th day of May, 1994 at 7:30 p.m. in Conference Room #204, 307 West Dallas
Road, with the following members present to-wit:
William D. Tate Mayor
Ted R. Ware Mayor Pro Tem
C. Shane Wilbanks Council Member
Jerry L. Pittman Council Member
Will Wickman Council Member
constituting a quorum, with Council Member Sharron Spencer and Council Member
Gil Traverse absent, with the following members of the City Staff:
Trent Petty City Manager
John F. Boyle, Jr. City Attorney
Jodi C. Brown Assistant City Secretary
CALL TO ORDER
Mayor Tate called the meeting to order at 7:30 p.m.
ITEM 1 . EXECUTIVE SESSION
Mayor Tate announced the City Council would conduct a closed session regarding
pending or contemplated litigation relative to (1 ) Dallas/Fort Worth International
Airport Board's decision relative to proposed Runway 16/34 West and (2) City of
Grapevine v Aubrey Smith under Section 551 .071 , Texas Government Code.
Upon reconvening in open session in the Council Chambers, Mayor Tate asked if there
was any action necessary relative to the closed session. In regard to (1) Daltas/Fort
Worth International Airport Board's decision relative to proposed Runway 16/34 West,
City Manager Trent Petty requested the City Council approve a resotution authorizing
the City Manager to engage the law firm of Popham, Haik to file a Petition for Writ of
Certiorari with the United States Supreme Court on behalf of the City of Grapevine in
regard to the challenge to the Final Environmental Impact Statement in connection
with the proposed expansion of Dallas/Fort Worth International Airport.
Council Member Pittman, seconded by Council Member Wilbanks, offered a motion
to approve the resolution authorizing the City Manager to engage the law firm of
Popham, Haik to file a Petition for Writ of Certiorari with the United States Supreme
Court on behalf of the City of Grapevine in regard to the challenge to the Final

RESOLUTION NO. 94-30
A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF GRAPEVINE, TEXAS FINDING AND
DETERMINING THAT IT IS IN THE BEST
INTEREST OF THE HEALTH, SAFETY AND
WELFARE OF THE CITIZENS OF THE CITY OF
GRAPEVINE TO APPEAL THE DISTRICT OF
COLUMBIA COURT OF APPEALS' DECISION
AND DIRECT ITS SPECIAL COUNSEL TO FILE A
PETITION FOR CERTIORARI WITH THE UNITED
STATES SUPREME COURT; AND PROVIDING
AN EFFECTIVE DATE ',
(2) City Manager Petty also requested authorization for the City Attorney to appeal
the case of City of Grapevine v Aubrey Smith.
Mayor Pro Tem Ware, seconded by Council Member Wickman, offered a motion to
authorize the City Attorney to appeal the case of City of Grapevine v Aubrey Smith.
Ayes : Tate, Ware, Wilbanks, Pittman & Wickman
Nays : None
Absent : Spencer & Traverse
ADJOURNMENT
Council Member Wilbanks, seconded by Mayor Pro Tem Ware, offered a motion to
adjourn the meeting at 8:07 p.m. The motion prevailed by the following vote:
Ayes: Tate, Ware, Spencer, Wilbanks, Traverse, Pittman & Wickman
Nays: None
