Regulations.
6. City Council and Planning & Zoning Commission to conduct a public hearing
relative to Conditional Use Application CU93-05 submitted by Luby's Cafeteria
requesting a waiver to specific requirements of Section 47E.2 pursuant to
Section 47F of Ordinance No. 82-73, as amended, and requesting a conditional
use permit for an amendment to the Planned Commercial Center approved by
Ordinance No. 92-86 to change the location of the Luby's Cafeteria and revise
the forty foot (40') and twenty foot (20') pole signs on State Highway 114
West and Ira E. Woods Avenue in a district zoned "CC" Community Commercial
District Regulations with a Conditional Use for a Planned Commercial Center.
7. City Council and Planning & Zoning Commission to conduct a public hearing
relative an application submitted by Mr. Jim Burger for the replat of Lot 2,
Block 1 of the McClelland Addition into Lots 2R-1, 2R-2 and 2R-3. The
property zoned "R-12.5" Single-Family District Regulations is located on the
west side of Pebblebrook Drive south of Wall Street.

City Secretary Linda Huff administered the Oath of Office to reappointed Planning &
Zoning Commission Members, Mr. Larry Oliver and Ms. Cathy Martin. ;;
ITEM 2. PUBLIC HEARING, DRAFT WILLIAM D.TATE AVENUE/STATE HIGHWAY
121 CORRIDOR LAND USE MAP

Mayor Tate declared the public hearing open.
Mayor Tate briefly reviewed the development and adoption of the City's
Comprehensive Master Plan 1974-1994, which was updated in 1980 and 1987. He
stated that in 1984, the City was rezoned (in most cases) in accordance with the `
i
Land Use Map with the intention to represent the best interests of the community. ;.
He stated the rezoning was mostly down zoning which was necessary to bring
development trends and land uses into control to buffer between incompatible land `
uses and to protect existing neighborhoods.
He noted that during the last 12 months zoning requests have been inconsistent with �
the Land Use Map. Since December, the Planning &Zoning Commission and the City ;
Council have held a public hearing and workshops in an attempt to receive public input `
�
regarding the William D. Tate Avenue/State Highway 121 Corridor Land Use Map. He
stated the City of Grapevine had been built by tough decisions and strong
commitments by the City Council and the Planning & Zoning Commission in order to i
create a community that has ordinances to preserve heritage, enforce setback �
�
requirements, preserve trees, ensure green belt areas and parks. These commitments
by the City Council and Planning & Zoning Commission have created a community
that has the reputation of being the best planned community in the metroplex. Mayor
Tate stated that to maintain the quality of life everyone enjoys, the ordinances and
master plans of the City have to be reviewed and updated on a continuing basis and

good judgment has to be utilized. �
Community Development Director H. T. Hardy reported the City Council and the G
Planning & Zoning Commission adopted the 1974-1994 Comprehensive Master Plan G
and revised it in 1980 and 1987. Mr. Hardy stated that the Master Plan does not
place zoning on property, but serves as a guide for the City when land use decisions �:
are made. �

Mr. Hardy then presented the proposed changes to the Land Use Map 2 that has been `�
in effect since February, 1987. He commented that the recommended changes were ;
due to the environmental noise impact from State Highway 121, the need to maintain
various land use mixes, and the need to review zoning changes that have occurred �
since 1984 and the adoption of the current Land Use Map. Mr. Hardy briefly
reviewed zoning terminology,i.e. highway commercial, neighborhood commercial, low t
intensity commercial, planned industrial development, etc. He briefly reviewed the ;

fdevelopments that would be allowed as a matter of right under certain zoning ;,
categories and stated that any conditional use requests wouid be handled the same '
` as zoning requests -- notices, public hearing, and approval by ordinance. ;

� During review of the proposed Land Use Map 2, Mr. Hardy stated that the area west �
��i of State Highway 121 between Hughes Road and Hall-Johnson Road had been �
�
' changed from residential high density to commercial and the area above Western Oaks �
� had been changed to governmental use. It was noted that approximately 39% of the
i housing units in the City are multi-family and that changing the multi-family zoning �
� would eliminate approximately 1600 multi-family units. �
i
� Mayor Tate reported that the change to commercial zoning was for economic reasons �
i to generate property taxes in order that the City does not have to rely so heavily on �
� Dallas/Fort Worth Intemational Airport and the downtown area of the City for tax !
� revenues. He stated the State Highway 121 Corridor has great potential to develop ;
as a tax base to support retail development, therefore adequate commercial zoning is ;
� needed in the City to capitalize and be flexible on future commercial development. �
, Mayor Tate invited guests present to comment regarding the proposed William D. Tate �
f Avenue/State Highway 121 Corridor Land Use Map. The following citizens spoke in ;

j children's safety, concems that high intensity commercial zoning would decrease �
j property values of existing homes, concerns regarding what type of buffers would be

considered between the residential and commercial districts, and concems that
commercial development along the corridor would not preserve the quality of life of b
the residents in the area. €
The citizens commented in support of the proposed residential developments as �
presented in Zoning Applications Z92-10 and Z93-01 (next on the agenda) that would ;
provide deed restrictions for the proposed single-family and commercial development �:
that would have a green belt/jogging trail/park and masonry fence to buffer between �
k
the existing homes and the proposed low impact commercial development. The City �
Council and Commission were requested to consider possible green belt/tree buffers �
between the proposed commercial and residential zoning, possibly professional office fi
buildings with green space, or a low impact commercial development that would �;
provide the needed tax base. There was a general consensus of residents present �
that it was a high burden on the City Council and Commission to maximize the tax �
base without endangering the community, and it was requested a single-family �
development with low intensity commercial be considered for the State Highway 121 a

Council Member Spencer noted that during the previous public hearing regarding the �
corridor, citizens commented they wanted the multi-family zoning eliminated; �
therefore, the Council and Commission believed that by indicating commercial zoning �
in the corridor area would be acceptable to the citizens. The commercially zoned area
would not have any access to Heritage Avenue where the schools are located. It was :
also noted that the area south of the proposed commercial zoning is within the City �
limits of Colleyville and is designated for commercial development. Commissioner �
Martin noted that Grapevine has worked with its citizenry to provide the best �
developments possible and protection to all residents and to all school children �

(whether they are residents of the City or not). t

During discussion, it was noted that development of wineries along the State Highway �
121 Corridor would create a low impact commercial development with the grape fields 3
providing a buffer between the existing homes and the freeway. It was also reported �
there would possibly be a special zoning district created for wineries that would limit x
the types of future development. �

City Secretary Linda Huff commented there were 15 letters in opposition and two ;
letters in support of the proposed Land Use Map 2. The following letters were then �

� play equipment. These two developers are ready to go ahead with their '

To disallow their proposal and to dictate, instead, that commercial �
development cover this delightfully wooded, rolling land which
immediately abuts expensive single-family homes, would be a travesty! �
This is particularly so in light of the very large number of freeway acres �
available in Grapevine for commercial development which does not �
immediately adjoin areas of single-family residential. A fully appropriate �
future tax base of commercial use land can be comfortably established �
in our city in a responsible manner which does not negatively impact our �
residential communities. �

I also wish to register my strong opposition to the manner in which this
proposal was submitted to the public and then, only a very few days �
later, is placed before the Council for approval. This does not provide �
the public a reasonable opportunity to examine and comment on actions �

being taken by our city government. Voting citizens of our city view t
such activity as underhanded and unacceptab/e. Please keep in �
; mind...our mayor and city council members are in place to do the �
bidding of their constituents - not to impose themselves on their �
constituency. �

moral obligation to make this plan known (and in time for all who have �

application) shows a proposed 7,500 square foot building adjacent to the corner of �

} the park. It was noted that the Open Space Committee recommended approval of the �

Mr. Dick LeBlanc, of Hanover Property Company, Managing Partner of Hall-Johnson
Partners, Ltd., requested favorable consideration of Zoning Application Z92-10 as it
� relates to the surrounding property and is appropriate to the development patterns
that have taken place in the area. He stated the commercial area would provide
; service related retail businesses, i.e. dry cleaners, hair salons, dentists.

City Council and Planning & Zoning Commission questioned the proposed lot sizes
(65x120) and values (540,000.001, as well as the average size (2,000-3,000 square
'; feet) and cost (S 170,000.00 to S 180,000.00) of the custom homes proposed.
! Mr. LeBlanc commented the proposed deed restrictions (as discussed with the
residents) were not yet developed but would be similar to those deed restrictions to
the north of the development. It was stated that the park area would be developed
; jointly with the developer of the northern tract, but the jogging trail has not been
planned to extend to the southern development.

' Mr. Lynn Meyers, Planning Director of Unzicker, Schnurbusch & Assoc., addressed
; the City Council and Planning & Zoning Commission regarding Zoning Application
j Z93-01 requesting favorable consideration of the application. The proposed concept
' plan meets all the concerns previously expressed by those listed below regarding the
;
; development of the two tracts of land west of State Highway 121, i.e. provides a
buffer, provides a linear park, and addresses the topography of the area. All of the
proposed lots site to the park area and do not face the commercial area. Average lot
; size (65x140) was discussed, as well as average lot value (mid 540,000.00) and
! custom home builders would develop the tract. One hundred percent (100°�)
masonry would be required on all homes on the perimeter of the proposed
; development with 80% required on the interior development.
