'i GRAPEVINE HERITAGE FOUNDATION � � Mayor Tate declared the public hearing open. � � °� Planner Marcy Ratcliff advised Conditional Use Application CU93-06 had been � submitted by Mr. Ron Emrich for the Grapevine Heritage Foundation requesting a waiver to specific requirements of Section 47E.2 pursuant to Section 47F of ; Ordinance No. 82-73, as amended, and requesting a conditional use permit for the ` � possession, retail sale and on-premise consumption of alcoholic beverages (beer,wine ` { ; and mixed beverages) in conjunction with festivals/special events at the Grapevine E � Heritage Center located at 701 South Main Street. The possession, storage, retail sale and on-premise � { consumption would only be in conjunction with the Heritage Center's special events ` such as GrapeFest and Main Street Days and not be on an ongoing basis. Alcoholic t '; beverages would not be served or stored in the building. � F � � ; Mr. Ron Emrich, Foundation Director, requested favorable consideration of the & � conditional use application stating that the physical address would allow the Heritage � Foundation to obtain special event permits from the Texas Alcoholic Beverage � :� Commission (TABC) for the sale of alcoholic beverages (beer and wine) in an enclosed � area of South Main Street during GrapeFest and Main Street Days. Mr. Emrich � � ; reported that in the past, the Heritage Foundation has worked very closely with other ` non-profit organizations within the City to be able to obtain enough special event permits from the TABC. He stated there would not be any storage or sale of alcoholic ; beverages at the Heritage Foundation and the omission of "not" on the submitted site ' plan was an oversight. : � ' Mayor Tate invited guests present to comment regarding the proposed conditional use ' '� application. There was no correspondence to report. � � Mr. Bruce Rider, 325 West Worth Street, stated he did not have a problem with the , t intent of the proposed conditional use application, but noted concern that the history � of the City would be tied to alcoholic beverage permits. He expressed concem there � � seems to be an increasing alcoholic beverage theme for the City of Grapevine in € regard to the proposed wine election and the proposed alcoholic beverage permit for � the Heritage Center. Mr. John Armistead, 627 Berkley Drive, questioned whether the proposed ordinance would allow vendors to sell alcoholic beverages on the Heritage Foundation property `'' during special event weekends. Mr. Emrich responded that there would not be any c alcoholic beverages sold on the premises of the Heritage Foundation as the site plan � � would contain the statement "Beverages not to be served and stored throughout ' � building." E � � 2 a I 1 � � i I 07/20/93 � � i ': � � City Council and Planning &Zoning Commission discussion ensued regarding the cost � to obtain the annuat mixed beverage permit from the TABC versus the expense and i I time involved in working with other non-profit organizations in the community to try � to obtain the required 18 special event permits for a three day festival. During deliberation, it was noted that the proposed site plan did not state that alcoholic ; beverages would not be stored or sold at the Heritage Foundation. Commissioner f Balvin recommended the following statement be added to the site plan: "Beverages � not to be served and stored throughout building." Also discussed was whether the City's ordinance would allow the possession, ' storage, retail sale and on-premise consumption of alcoholic beverages, even though ` � the approved site plan contained the statement "Beverages not to be served and ; stored throughout the building." City Attorney John F. Boyle, Jr. advised that the ' � City Secretary would certify that the proposed use contemplated is consistent with � the City's ordinance, and at that point, the TABC would then make the determination ' �� regarding the alcoholic beverage permit. � � Commissioner Balvin, seconded by Commissioner Freed, offered a motion to close the f public hearing. PUBLIC HEARING, CONDITIONAL USE APPLICATION CU93-07. i FELLOWSHIP OF LAS COLINAS CHURCH : Mayor Tate declared the public hearing open. Planner Marcy Ratcliff advised Conditional Use Application CU93-07 had been filed by Mr. Jeff Williams of Graham Associates, Inc. for the Fellowship of Las Colinas � Church requesting a waiver to specific requirements of Section 47E.2 pursuant to Section 47F of Ordinance No. 82-73, as amended, and requesting a conditional use ' permit to build a church in a Planned Industrial Development District under the j standard development option. The 21 .002 acre property is located on the southeast ; side of State Highway 121, north of Bethel Road. Ms. Ratcliff advised the proposal is to develop a church campus on approximately 160 acres of land that lies partly in ' Grapevine's city limits and in Coppell's city limits. The conditional use, as requested, . � � i 3 ' � � � $ _. � 1 � i 1 ; 07/20/93 z � ' is Phase I of the proposed development and Staff recommends the foliowing ` � :. ; statement be noted on the site plan, if approved: "No building permits will be issued 4 ' on this lot until the off-site easements for the City's lift station and force main have � been dedicated to the City by the property owner". � :j t � Ms. Ratcliff advised Phase 1 of the proposal will consist of a multi-use dining/assembly { � a structure, seminar building and chapel for a combined building area of 76,000 square � � feet and will seat 1,800 persons. The total future building area is 250,000 square ; feet that will contain a family life center, seminar building, and a worship center that K ; will seat 5,000 persons. Also planned are outside activity areas to include softball � ; fields, multi-purpose field, tennis courts, sand volleyball courts, and a golf driving � " range. She advised all of the buildings shown in the Grapevine city limits are within "Zone B" as defined on the "Aircraft Sound Exposure: Dallas/Fort Worth Regional € ; Airport Environs" map. The family life center, located in the Coppell City limits, is the � only structure located within "Zone C" and has no bearing on the Grapevine case. ; � � Mr. David Hardesty, a member of the Fellowship of Las Colinas Church, introduced � 3 each of the members of the Church's Search Committee to present their request to � � the City Council and the Planning & Zoning Commission. Mr. Hardesty advised the � Search Committee had determined the site contained adequate acreage for growth, � ; � � access by major freeways, and, most importantly, a central location in the Metroplex � � in a progressive city. He stated that the Resolution Trust Corporation had chosen the . � Church as the best bidder for the property and that a contract on the acreage would ; � be prepared for execution within ten days to two weeks. _ � 6 Pastor Ed Young requested favorable consideration of the conditional use application � for the regional chu�ch that would draw people from all across the Dallas/Fort Worth Metroplex and commented that the Church would become a vital part of the ; community. i ; � i Mr. Jeff Williams, of Graham Associates, Inc., addressed the City Council and I Planning & Zoning Commission briefly noting the requirements of the City had been § met regarding the site plan and proposed drainage, and stated that agreements would s need to be considered by the cities of Grapevine and Coppell for water/sewer usage, � ' drainage, and police and fire protection. He noted the family life center building was ! the only building ta be located within the city limits of Coppell, with the educational/seminar building proposed to be constructed on the boundary between the ; cities of Grapevine and Coppell. � t 3 Mr. David Shanks reviewed the master plan concept of the proposed Church campus � stating that with the commitment of the Fellowship of Las Colinas to provide a state- � of-the art regional facility, the noise attenuation within the Worship Center will be of ' j highest priority. All areas of the complex would be provided the appropriate noise � � attenuation design commensurate with the function of each space. The facilities will ; be designed with spacious circulation systems and atrium lobby areas to provide for ' the normal gathering and visiting that occur before and after services. The southside ' � 4 ; i . � , � � 07/20/93 j ' . of the property would be developed as an outdoor recreation area to include soccer, ; football, baseball, tennis, sand volleyball, jogging and a golf driving range. He also noted there would be a 100' setback on State Highway 121 that would feature � appropriate landscaping and berms. � Mr. John Joiner, of Joiner Rose Acoustics, presented the "Acoustical Study for i Proposed Development at State Highway 121, North of Bethel Road, Grapevine, ; Texas, July, 1993". The purpose of the study was to access the environmental impact of noise from the operation of Dallas/Fort Worth International Airport (D/FW) on the proposed Phase I development of a worship and fellowship center to be located ' on approximately 21 acres in the City of Grapevine, Texas at State Highway 121, north of Bethel Road. He noted the two principle sources of environmental noise � considered and addressed in the study are: D/FW aircraft operations and State ' Highway 121 traffic. Mr. Joiner stated that based on the Grapevine Official Airport Noise Map dated , October 14, 1971, all of the proposed development to be located in Grapevine is identified as being in Noise Zone B. He stated the site will be impacted by overflights to and from D/FW and noise levels from one event can vary up to 89 decibels for a � � few seconds duration. He stated sound proof modifications would be required to lower the impact of the noise to acceptable levels when the facilities are used for the ! intended purpose. Noise level from traffic on State Highway 121 would be a factor, � I but much less severe than that from D/FW operations. It was also noted that flight paths, types of aircraft and predicted fly-over noise levels have all remained as forecasted in a 1969 study that was prepared for the Council of Governments. Mr. Joiner stated that state of the art acoustics exists to deal effectively with the ' intrusion of noise from the mentioned sources and that the prepared report establishes criteria and specifies techniques to meet that criteria. He stated the report deals with maximum single event noise (Sel) and not the average noise level (Ldn). � i i During his presentation, Mr. Joiner defined Sel (single event level) and Ldn (day-night � � average sound level). Mayor Tate stated that the City of Grapevine is on record as objecting to the Ldn measurement and is very aware that Ldn does not reflect the � noise impact on a facility. Mayor Tate also stated that the City of Grapevine needs � I to make sure that noise evaluations for the City's customers are based on Sel. Mayor �I Tate then asked Mr. Joiner to verify whether the following would be a summary of ' his presentation: "From an engineering stand point, it really doesn't matter whether , you are in a "B" or "C" noise corridor, or whether Sel or Ldn is utilized--that can be addressed from an engineering standpoint. It comes down to a matter of cost and design the way the facility is built to allow you to reduce the noise impact in a given facility". The 330.5 acres has access through Southlake and is situated such that current development in the area is negatively impacting the City of Southlake. There are 50 acres of property for development above elevation 572 which border Lonesome Dove Road and the Southlake city limits. The acreage is located on the eastern perimeter of the ETJ. The area is currently served by septic � tanks and no wastewater lines are nearby. Service to the area from Grapevine would be difficult and not cost effective. The same situation exists for water service to the area with the exception that some of the residences along Lonesome Dove Avenue ; are now served by Southlake. Providing Public Safety to the area is difficult due to the limited access to the area only through Southlake. Therefore, Southlake has requested that Grapevine release the ETJ so that they may annex the property to I� exercise more rigid controls on development. Discussion ensued as to whether Southlake would consider trading land along the railroad tracks for the property in northwest Grapevine. It was stated that was not part of the proposal.
