CITY OF GRAPEVINE
The Planning and Zoning Commission of the City of Grapevine, Texas,
met in regular session, Tuesday Evening, May 21, 1991, at 7:30 P.M.
for a Joint Public Hearing With the City Council in the City Council
Chambers, Room #205, 307 West Dallas Road, Grapevine-1 Texas,
followed by the Commission's deliberation session in Room #204, with
the following members present to wit:

Mayor William D. Tate called the public hearing to order at 7:45 PM;
and Chairman Ron Cook called the Commission's deliberation session
to order at 8:45 PM.
PRESENTATIONS
Mayor Tate presented the North Central Texas Council of Governments
Silver Cup Award for "Best Tasting Water, 1991" to Jean Bartley,
Water and Sewer Superintendent, and Frank White, Chief Water Plant
Operator, representing the Grapevine Public Works Department.

CONDITIONAL USE APPLICATION CU91-08-CONCOURSE AUTOMOTIVE
In the Public Hearing Planning and Zoning Commission Members were
first to consider Conditional Use Application CU91-08 submitted by
Concourse Automotive, Lot 3R2, Block A, Triple 'M' Addition, 1321
West Northwest Highway.
Marcy Ratcliff, Planner, presented slides indicating the relocation
of the proposed Concourse Automotive Service Center from 2101 West
Northwest Highway to 1321 West Northwest Highways (Proposed as Lot
3R2 of the Triple 'MI Addition). The request is for a conditional
use permit to allow an automotive repair garage in the existing
7,500 square foot metal building with 30 parking spaces, a 6 foot
wooden fence located toward the rear of the lot and an asphalt curb
along the riqht-of-way in front area designated for "future
parking;" and a waiver from the application requirements of Section
47.E.2 in accordance with Section 47.F. The Board of Zoning
Adjustment by approving BZA91-07 May 6, 1991, granted a special
exception to allow the non-conforming status • the tract to remain
with the change in use.
There were no questions from the City Council and the Planning and
Zoning Commission. Mayor Tate invited guests present to comment
regarding the request. No one wished to speak; and there was no
correspondence to report.
In the Commission's session, following a brief discussion, Chairman
Ron Cook, then called for a motion. Commissioner Larry Atchley's
motion and Ery Meyer's second was to recommend the City Council
approve Conditional Use Request CU91-08, including a waiver to
certain site plan requirements of Grapevine Comprehensive Zoning
Ordinance 82-73, Section 47.E.2, in accordance with Section 47.F.,
with the prevailing vote as follows:
Ayes: Cook, Oliver, Martin, Meyer, Atchley, Hinson and Young
Nays: None
CONDITIONAL USE APPLICATION CU91-09-PAYLESS SHOE SOURCE
CHILI'S RESTAURANT
Next for the Commission to consider and make a recommendation to the
City Council was Conditional Use Application CU91-09 submitted by
Payless Shoe Source and Chili's Restaurant.
In the public hearing session, Marcy Ratcliff advised the request
was to amend the Planned Commercial Center site plan by adding a
3,060 square foot retail store on Lot 1R-1 (Payless) and extending
the eastern property line of Lot 5R-A (Chili's). The request was
also to waive certain site plan requirements of Grapevine
Comprehensive Zoning Ordinance 82-73, Section 47.E.2 in accordance
with Section 47.F. The 13.514 acre tract is zoned "HC", Highway
Commercial and is located at the northeast corner of William D. Tate

Avenue and the frontage road of State Highway 114. The subject
Hayley Addition is bounded on the east by "R-7.5", Single-Family
Residential zoned and developed with the Bel Aire Subdivision, to
the north by the "GU" zoned Grapevine Post Office, to the south by
State Highway 114 and to the west by "CC" zoned Wal Mart, Fina and
the Towne Center Addition.
Mr. Blake Burks, Project Architect and Mr. Tom Harrington, Payless
Shoe Source Project Manager, advised that Lot 1R-1 will provide 27
parking spaces and Chili's Restaurant will expand the eastern
property line by 10,703 square feet to add 30 parking spaces.
Ms. Kim Woodard, representing Chili's Restaurant, requested
favorable consideration for the conditional use application stating
that the additional parking would add a buffer to any proposed
development to the east of their property.
With no questions from the Council or Commission, no guests wishing
to speak and no correspondence to report, Mayor Tate declared the
public hearing closed.
In the Commission's session, Marcy Ratcliff advised with the
addition of the Payless Shoe Store, no further curb cuts will be
made on William D. Tate Avenue from the Hayley Addition. Then with
no further questions or deliberation, Robert Hinson's motion and Ery
Meyer's second was to recommend the City Council approve Conditional
Use Application CU91-09, with the prevailing vote as follows:
Ayes: Cook, Oliver, Martin, Meyer, Atchley, Hinson and Young
Nays: None
ZONING APPLICATION Z91-04-TIM LANCASTER
Next for the Commission to consider and make a recommendation to the
City Council was Zoning Application Z91-04 submitted by Mr. Tim
Lancaster.
In the Public Hearing Marcy Ratcliff advised that Zoning Application
Z91-04 had been submitted by Mr. Tim Lancaster requesting rezoning
of a one (1) acre tract from "LI"I Light Industrial to 11CN11,
Neighborhood Commercial District Regulations. The tract is located
at 733 Ball Street adjacent to the St. Louis and Southwestern
Railway. A day care facility is proposed to be developed. Ms.
Ratcliff noted that the applicant had been advised the request
constitutes "spot zoning" because Light Industrial zoning surrounds
the tract. Staff further, noted it is advisable to rezone
additional property "CN" fronting Ball Street. The concept plan
does not indicate future development.
Mr. Tim Lancaster, representing the developers, offered to answer
questions and requested favorable consideration for the request. He
also addressed the Commission concerns for children's safety with

the railroad tracts and Ball Street's close proximity. Mr. Bill
Deacon, owner of the subject tract, addressed the City Council and
Planning and Zoning Commission, stating the "CN", Neighborhood
Commercial request should encourage similar uses to develop along
Ball Street on either side of the subject proposal and the recently
approved dental office (rezoned from "R-TH" to "PO.")
In response to Mayor Tate's invitation, no guests wished to speak;
and the City Secretary had no correspondence to report. The public
hearing was then closed.
In the Commission's session, a lengthy deliberation ensued, with the
concern being primarily to prevent side-by-side incompatible uses.
Then, with no further deliberation, Commissioner Curtis Young's
motion and Cathy Martin's second was to recommend the City Council
deny Zoning Application Z91-04 without prejudice. Reasons for
recommending denial were: because of the spot zoning proposal, the
close proximity to the railroad tracks, and there must be a better
location for a day care facility. The prevailing vote was as
follows:
Ayes: Cook, Oliver, Martin, Meyer, Hinson and Young
Nays: Atchley
REPLAT OF LOT 3, BLOCK A OF THE TRIPLE W ADDITION
Next for the Commission to consider and make a recommendation to the
City Council was The Replat of the Triple 'M' Addition.
In the public hearing, Senior Civil Engineer Larry Frassinelli
advised that Mercantile Bank of Fort Worth and BEMCO Properties had
submitted an application for the replat of Lot 3, Block A of the
Triple 'M' Addition into three (3) lots, Lot 3R-1, 3R-2, and 3R-3,
for a Concourse Automotive Service Center on Lot 3R-2. The 3.32
acre tract zoned "HC", Highway Commercial is located on the south
side of Northwest Highway 800 feet west of Dove Road and is in
conjunction with CU91-08.
There was no discussion by the City Council and Planning and Zoning
Commission and no guests wished to comment relative to the replat
application. City Secretary Linda Huff had no correspondence to
report.
The Planning and Zoning Commission had discussed the item earlier in
the Commission's deliberation session in conjunction with CU91-08.
Further brief discussion concerned reasons for the replat. It was
noted that a portion of the property has been sold off by metes and
bounds-part of Lot 3R3 has been sold. Then Commissioner Cathy
Martin's motion and Larry Atchley's second was to recommend the City
Council approve the Replat of the Triple 'M' Addition with the
prevailing vote as follows:

REPLAT OF LOT 1, BLOCK 1, HAYLEY ADDITION
Next the Commission was to consider the Replat of Lot 1, Block I of
the Hayley Addition and make a recommendation to the City Council.
In the public hearing Larry Frassinelli advised that Mr. James P.
Christon had submitted an application for the replat of Lot 1, Block
1 of the Hayley Addition into two lots, Lot 1R-1 and IR-2. The 1.32
acre tract zoned "HC" Highway Commercial is located south of the
U.S. Post Office and on the east side of William D. Tate Avenue.
The request is 'in conjunction with Conditional Use Application
CU91-09.
There was no discussion, no guests wishing t6 speak and one
correspondence to report. The public hearing was then closed.
In the Commission's deliberation session there was no discussion and
Ery Meyer's motion and Curtis Young's second was to approve the
replat of Lot 1, Block 1 of the Hayley Addition to Lot 1RI and 1R2,
with the prevailing vote as follows:
Ayes: Cook, Oliver, Martin, Meyer, Atchley, Hinson and Young
Nays: None
REPLAT OF LOTS 5A & 5B, BLOCK 1, HAYLEY ADDITION
Next for the Commission to consider and make a recommendation to the
City Council was the Replat of Lots 5R-A and 5R-B, Block 1 of
the Hayley Addition.
In the public hearing Frassinelli advised Chili's, Inc. had
submitted an application for the replat of Lots 5A and 5B, Block I
of the Hayley Addition to re-position a- lot line for additional
parking on Lot 5A. The 4.321 acre property, zoned "HC" Highway
Commercial is located on the northwest corner of the intersection of
South Ball Street and State Highway 114.
With no further questions, no guests to speak or letters or
petitions, the public hearing was then closed.
In the Commission's deliberation session Chairman Ron Cook called
for a motion. Following a brief discussion, a motion from Vice
Chairman Larry Oliver and second from Cathy Martin was to approve
the request to replat to Lots 5R-A and 5R-B, Block 1-of the
Hayley Addition, with the prevailing vote as follows:
Ayes: Cook, Oliver,,Martin, Meyer, Atchley, Hinson and Young

The Planning and Zoning Commission was next to consider the
Department of Public Works' conceptual design proposal for the
realignment of Bear Run Drive and make a recommendation to the City
Council.
Mr. Laster advised the 45 degree curve will slow traffic, and the
design will limit curb cuts to the State Highway.

The next item for the Commission to consider and make a
recommendation to the City Council was the proposed Thoroughfare
Plan Amendment to downgrade Pool Road from Type A, Major Arterial to
Type B Major Arterial.
The Planning and Zoning Commission then ceased deliberation; and
Commissioner Curtis Young's motion and Robert Hinson's second was -b*
recommend the City Council approve the proposed amendment to abandon
the plan for a Type A Arterial previously proposed by the

Thoroughfare Plan and approve a four-lane divided roadway with an 80
foot right-of-way (Type B), with the prevailing vote as follows:
Ayes: Cook, Oliver, Martin, Meyer, Atchley, Hinson and Young
Nays: None
FINAL PLAT OF CFA ADDITION
Next the Commission was to consider the Final Plat of the CFA
Addition and make a recommendation to the City Council.
In the Commission's deliberation session, Mr. Frassinelli noted the
location of the subject Final Plat of the CFA Addition is the east
side of Ball Street, north and adjacent to the railroad tracts. The
replat of the 1.0 acre tract zoned LI, Light Industrial is the area
proposed as CN, Neighborhood Commercial by Z81-04 indicating plans
for a day care center for which the Commission recommended denial to
the City Council earlier in the evening.
With no further discussion, a motion from Vice Chairman Oliver and
second from Larry Atchley was to recommend the City Council deny the
Final Plat of the CFA Addition, with the prevailing vote as follows:
Ayes: Cook, Oliver, Martin, Meyer, Atchley, Hinson and Young
Nays: None
TREE REMOVAL PERMIT TR91-02 CENTEX
Next for the Commission to consider and make a recommendation to the
City Council was Tree Removal Permit TR91-02 submitted by Centex.
Because the applicant was not present, Staff suggested the case be
tabled. With no discussion, a motion from Vice Chairman Larry
Oliver and second from Ery Meyer was to table the case, with the
prevailing vote as follows:
Ayes: Cook, Oliver, Martin, Meyer, Atchley, Hinson and Young
Nays: None
ADJOURNMENT
With no further business for the Commission to consider, a motion
from Larry Oliver and second from Cathy Martin was to adjourn the
meeting at 10:45 PM, with the prevailing vote as follows:
Ayes: Cook, Oliver, Martin, Meyer, Hinson, Atchley and Young
Nays: None
