HomeMy WebLinkAbout1991-07-16STATE OF TEXAS COUNTY OF TARRANT CITY OF GRAPEVINE The Planning and Zoning Commission of the City of Grapevine, Texas, met in Joint Public Hearing with the City Council, on this the 16th day of July, 1991, in the City Council Chambers, Room #205, 307 West Dallas Road, Grapevine, Texas, with the following members present to wit: Ron Cook Larry Oliver Cathy Martin Ery Meyer Darlene Freed Steve Stamos Curtis Young Chairman Vice Chairman Member Member Member Member Member constituting a quorum, with no members absent, and the following City Staff: H.T.(Tommy) Hardy Greg Wheeler Marcy Ratcliff Ray Collins Carol Baron Scott Dyer Larry Frassinelli CALL TO ORDER Director of Community Development Building Official Planner Planner Secretary Civil Engineer Sr. Civil Engineer Mayor, William D. Tate called the joint meeting to order at 7:35 P.M., and Chairman, Ron Cook called the Commission's session to order at 9:35 P.M. INVOCATION Commission Member Cathy Martin offered the Invocation. JOINT PUBLIC HEARING REPLAT OF LOT 5R-BIFINAL PLAT OF LOTS 5R-B1 AND 5R-B2, BLOCK 1 OF THE HALEY ADDITION First on the Agenda for the Commission to consider and make recommendation to the City Council was the replat of Lot 5R-B, Block 1 of the Haley Addition into two lots. In the public hearing, Sr. Civil Engineer, Larry Frassinelli advised that the property is located on the northwest corner of the intersection of South Ball Street and State Highway 114, and is zoned 11HC11 Highway Commercial and Lot 5R-B1 is proposed to be developed as Romano's Macaroni Grill. Mr. Frassinelli then introduced Kim Woodard of Brinker International. Ms. Woodard stated that Romano's Macaroni Grill would be an upscale Italian Restaurant, and be very beneficial to Grapevine. She also stated that the restaurant would be open five (5) months from the start of construction. With no questions from the Commission or Council, no guests to speak and no letters or petitions, the public hearing was then closed. In the Commission's deliberation session, following a brief discussion, Commission Member, Curtis Young's motion and Cathy Martin's second was to recommend the City Council approve the replat of Lot 5R-B, Block 1 of the Haley Addition into two lots, 5R-B1 and 5R-B2, Block 1 of the Hayey Addition, with the prevailing vote as follows. Ayes: Cook, Oliver, Martin, Meyer, Young, Freed and Stamos Nayes: None CONDITIONAL USE APPLICATION CU91-14, ROMANO'S MACARONI GRILL: Next for the Commission to consider and make a recommendation to the City Council was Conditional Use Application CU91-14, submitted by Romano's Macaroni Grill. In the Public Hearing, Planner Marcy Ratcliff advised that Romano's Macaroni Grill is requesting a waiver to specific requirements of Section 47E.2 pursuant to Section 47F of Ordinance No. 82-73, as amended, and requesting a conditional use permit for an amendment to a site plan approved by Ordinance No. 89-92 for the possession, storage, retail sale and on-premise consumption of alcoholic beverages (beer, wine and mixed beverages) in conjunction with the operation of a restaurant, and a forty foot (401) pole sign. The 80,000 square foot tract is located at 700 State Highway 114, in the Haley Addition. In response to a question from the Council, Mrs. Ratcliff stated that access to the restaurant would be from the entrance between Chili's Restaurant and Colter's Bar-B-Que and off Ball Street, and there would be no drive cuts along the frontage road of State Highway 114 on Lot 5R-B1. With no other questions from the Commission or council, no guests to speak and no letters or petitions, the public hearing was then closed. In the Commission's deliberation session, following a brief discussion, Commission Member Cathy Martin's motion and Darlene Freed's second was to recommend the city Council approve Conditional Use CU91-14, and waive the specific requirements of Grapevine Comprehensive Zoning Ordinance 82 -73, Section 47.E.2 pursuant to Section 47.F, with the prevailing vote as follows: Ayes: Cook, Oliver, Martin, Meyer, Young, Freed and Stamos Nayes: None ZONE CHANGE APPLICATION 91 -06, HIGH POINTE ASSOCIATES: Next the Commission was to consider, and make a recommendation to the City Council, relative to Zoning Application Z91 -06 submitted by High Pointe Associates requesting rezoning of 16.365 acres from "R -2011 Single - Family District Regulations to "R-12.511 Single- Family District Regulations. The property is located at 2820 Hall- Johnson Road. In the public hearing, Planner, Marcy Ratcliff introduced Mr. John Delin. Mr. Delin stated he had hired a marketing representative to advise him on the project and that he has tried in earnest to work with the surrounding home owners and with the Planning and Zoning Commission. Mr. Delin presented proposed Deed Restrictions that he stated has been fashioned after several successful cities, and a plat with no dimensions. The members questioned Mr. Delin concerning the proposed Deed Restrictions and the plat with no dimensions or lot sizes. Mayor Tate suggested he put dimensions on the plat to show lot sizes. At this point, Mayor Tate invited guests to speak on the zoning request. The following home owners of the surrounding area of High Pointe spoke: 1. Mary Dunlap, 2709 Whitby Lane, Grapevine, Texas 5. Wally Mitchell, 2808 Scarborough Court, Grapevine, Texas 6. Tom Carmody, 2705 Yorkshire Ct., Grapevine, Texas 7. Mark Moore, 3719 Kelsey Ct., Grapevine, Texas 8. Steve Ambrose, 2937 Crestline, Grapevine, Texas 9. Derk W. Pasemen, 3921 Kelsey Ct. Grapevine, Texas 10. Myles Walsh, 2929 Crestline, Grapevine, Texas 11. William D. Rich, 3835 Kelsey Court, Grapevine, Texas 12. Bonnie E. Rich, 3835 Kelsey Court, Grapevine, Texas 13. Dr. Walker, 3830 Parr Road, Grapevine, Texas The above home owners spoke to the Commission expressing their concerns if anything other than R-20 zoning is allowed for the High Pointe Addition. The concerns are as follows: Traffic problems could develop if too many more homes are allowed, the streets are already crowded, school traffic, property values, the quality of life on bordering properties, drainage problems, views disturbed or blocked and utilities. Most of the home owners stated they were discouraged with Mr. Delin because he has had little or no detailed documentation to show them what he intends to do with High Pointe, (such as lot sizes). The neighborhood felt that the proposed deed restrictions could not be enforceable by the city. They stated that he showed little commitment and could not, or would not, work with the home owners. At this time Linda Huff, City Secretary read a memo from the Community Development Department stating that 87 letters had been received indicating objection to the requested rezoning to R-12.5 Single-Family District Regulations. Fifty-five (55) of the letters of objection were from owners of 74.20% of the 200 foot perimeter surrounding the 16+ acre High Pointe tract. In the Commission's deliberation session, Mr. Delin asked if his request could be tabled for 60 days in order for him to prepare a more definite plan with proper dimensions. It was the consensus of the Commission members that he has had plenty of time to do this, but the Commission members suggested to Mr. Delin that he should expand the lot sizes and have plans drawn up showing what he intends to do concerning the drainage issue. After further discussion, a motion by Larry Oliver, and a second by Curtis Young to deny the request without prejudice and ask the City Council to waive the filing fees, with the prevailing vote as follows: Ayes: Cook, Oliver, Martin, Young, and Freed Nays: Stamos, Meyer END OF JOINT HEARING: FINAL PLAT OF HEATHERWILDE ADDITION: Next for the Commission to consider and make a recommendation to the City Council was the final plat of the Heatherwilde Addition. After presentation by Larry Frassinelli and a brief discussion, a motion by Ery Meyer and second by Curtis Young was to recommend that the City Council approve the request for the final plat, with the prevailing vote as follows: Ayes: Cook, Oliver, Martin, Meyer, Young, Freed, and Stamos Nays: None OLD BUSINESS: AMENDMENTS TO THE COMPREHENSIVE ZONING ORDINANCE NO.82-73: Next for the Commission to consider and make a recommendation to the City Council were the Amendments to the Comprehensive Zoning Ordinance No. 82-73, as amended, Section 24 IICNII Neighborhood Commercial District Regulations relative to size of related uses in IICNII Neighborhood Commercial Districts. Following discussion, a motion by Cathy Martin, and second by Curtis Young to deny the proposed amendments, with the prevailing vote as follows: Ayes: Cook, Oliver, Martin, Meyer, Young, Freed and Stamos Nays: None AMENDMENTS TO THE COMPREHENSIVE ZONING ORDINANCE NO. 82.73 AS AMENDED: Next for the Commission to consider and make a recommendation to the City Council were the Amendments to the Comprehensive Zoning Ordinance No. 82.73 as amended, Section 42 Supplementary District Regulations relative to visibility triangles at intersections and make a recommendation to the City Council. After a brief discussion, a motion by Curtis Young, and second by Larry Oliver to recommend the City Council approve the request, with the prevailing vote as follows: Ayes: Cook, Oliver, Martin, Meyer, Young, Freed and Stamos Nayes: None ELECTION OF CHAIRMAN AND VICE CHAIRMAN: After discussion, with a motion by Cathy Martin, and a second by Ery Meyer, the Commission re-elected Ron Cook as Chairman of the Planning and Zoning Commission, and re-elected Larry Oliver as Vice Chairman, with the prevailing vote as follows: Ayes: Martin, Meyer, Young, Freed and Stamos Nayes: None Abstain: Cook, Oliver APPROVAL OF MINUTES OF THE PLANNING AND ZONING MEETING OF JUNE 18, 1991 A motion by Ery Meyer and a second by Darlene Freed was to approve the minutes of the July 18, 1991 meeting as written with the prevailing vote as follows: Ayes: Cook, Oliver, Martin, and Meyer, Young, Freed and Stamos Nayes: None MISCELLANEOUS DISCUSSION AND REPORTS: Planner, Marcy Ratcliff spoke to the Commission concerning the Texas State APA Conference to be held October 2nd through the 5th, in Corpus Christi, stating that one member is budgeted to attend. Curtis Young volunteered to attend. Mrs. Ratcliff also brought up the Texas Midwest Section of the APA Meeting on July 25th at 6:00, in Denton. The speakers topic will be on Alliance Airport. Commission Member Ron Cook, suggested that a workshop be held in August on the status of the historical preservation. Marcy Ratcliff is to investigate the date and time and get back to the members. ADJOURNMENT: With no further business for the Commission to consider, a motion by Larry Oliver and second by Cathy Martin was to adjourn the meeting at 10:45 P.M., with the prevailing vote as follows: Ayes: Cook, Oliver, Martin, Meyer, Young, Freed and Stamos Nays: None PASSED AND APPROVED BY THE PLANNING AND ZONING COMMISSION OF THE CITY OF GRAPEVINE, TEXAS, ON THIS THE Ale DAY OF JULY, 1991.
