HomeMy WebLinkAbout1991-10-15STATE OF TEXAS COUNTY OF TARRANT CITY OF GRAPEVINE The Planning and Zoning Commission of the City of Grapevine, Texas, met in Joint Public Hearing with the City Council, on this the 15th day of October, 1991, in the City Council Chambers, Room #205, 307 West Dallas Road, Grapevine, Texas, with the following members present to wit: Ron Cook Larry Oliver Cathy Martin Ery Meyer Darlene Freed Steve Stamos Curtis Young Chairman Vice Chairman Member Member Member Member Member constituting a quorum, with no members absent, and the following City Staff: H.T.(Tommy) Hardy Greg Wheeler Marcy Ratcliff Ray Collins Carol Baron Scott Dyer Larry Frassinelli Director of Community Development Building Official Planner Planner Secretary Civil Engineer Sr. Civil Engineer Mayor, William D. Tate called the joint meeting to order at 8:00 P.M., and Chairman, Ron Cook called the Commission's session to order at 10:00 P.M. INVOCATION Commission Member Ervin Meyer offered the Invocation. PRESENTATIONS: PRESENTATION BY CITY STAFF AND HUITT-ZOLLARS, INC., REGARDING POOL ROAD ALIGNMENT CONCEPT PLAN Director of Public Works, Jerry Hodge stated that in 1987 the City of Grapevine adopted the Master Thoroughfare Plan in which Pool Road was designated as a Type A, Major Arterial. Pool Road was downgraded from six lanes to four lanes in May. Mr Hodge then introduced Mr. Oakley of Huitt-Zollars Inc. Mr. Oakley stated that the alignment of the road could be done under two conditions. The road needs to have a radius of 1,125 feet and needs right-of-way 1 "taking" at the curve near the intersection with Ira E. Woods. Mr. Oakley also stated that the two garages on the corner of Blueberry Lane and Pool Road, especially the southerly one, which is too close to the right-of-way. The bridge on Big Bear Creek would need to be realigned for the 100 year flood plain. Mr. Oakley also stated that the utilities would need to be consolidated since Colleyville is on one side of Pool Road and Grapevine is on the other side. PRESENTATION BY CITY STAFF AND SCHRICKEL, ROLLINS AND ASSOCIATES REGARDING THE HALL-JOHNSON ROAD ALIGNMENT CONCEPT PLAN Mr. Dan Hartman of Schrickelf Rollins and Associates gave a presentation on the design changes proposed for Hall-Johnson Road west of William D. Tate Avenue and east of Pool Road. He stated the only area of constraint was between Parr Road and Kelsey Court. The right-of-way would become more narrow in this area only because of the existing houses and fence. JOINT PUBLIC HEARING: ZONE CHANGE APPLICATION 91-08, SUBMITTED BY HALL-JOHNSON PARTNERS, LTD First on the Agenda for the Commission to consider, and make a recommendation to the City Council, relative to Zoning Application Z91-08 submitted by Hall-Johnson Partners, LTD requesting rezoning of 27.72 acres from "CC" Community Commercial District Regulations, 11CN11 Neighborhood Commercial District Regulations and "R-MF-21, Multi-Family District Regulations to "R-7.511 Single-Family District Regulations. The property is located at 2400 Hall-Johnson Road, south of Western Oaks Estates Section II, east along the proposed Heritage Avenue down to Hall-Johnson Road. In the public hearing, Director of Community Development Tommy Hardy introduced Mr. Lynn Myer, representing Hall-Johnson Partners. Members of the Council were concerned about single-family backing up to Community Commercial. Mrs. Spencer stated the Grapevine city Council had won an award for the 1980 Master Plan which required separation between commercial and single family. With no one wishing to speak, and no letters submitted for or against Z91-08 the public hearing was closed. In the Commission's deliberation session, following a brief discussion on the Master Plan, a motion by Cathy Martin, and a second by Ervin Meyer to deny the request without prejudice, with the prevailing vote as follows: 9 Ayes: Cook, Oliver, Meyer, Martin, Stamos, Young and Freed Nays: None CONDITIONAL USE APPLICATION 91-19, SUBMITTED BY MAYSE AND ASSOCIATES FOR FOODMAKER, INC. dba JACK IN THE BOX Next for the Commission to consider and make a recommendation to the City Council was Conditional Use Application CU91-19, submitted by Mayse and Associates for Foodmaker, Inc. dba Jack in the Box. In the public hearing, Director of Community Development, Tommy Hardy advised that the applicant is requesting a waiver to specific requirements of Section 47E.2 pursuant to Section 47F of Ordinance No. 82-73, as amended, and requesting a conditional use permit for an amendment to an approved site plan to permit a drive-through restaurant to be located at 1380 William D. Tate Avenue and platted Lot 4-R, Block 1, Town Center Addition. The 6.13 acre tract is located in a district zoned "CC" Community commercial District Regulations with a conditional use permit (CU89-15) for a Planned Commercial Center. Mr. Hardy introduced Mr. Michael Mayse of Mayse and Associates. Mr. Mayse stated that the proposed restaurant will contain 2,760 square feet, which will provide seating for 86 people. The difference in the approved site plan and the proposed site plan is the drive- through drive around the back of Jack In The Box and the access way between lots 1-R and 4-R is now closed. With no other questions from the Commission or Council, no guests to speak and no letters or petitions, the public hearing was then closed. In the Commission's deliberation session, following a brief discussion, Commission member Curtis Young, and Larry Oliver's second was to recommend that the City Council approve the request for the conditional use with the prevailing vote as follows: Ayes: Cook, Oliver, Martin, Meyer, Young, Freed, and Stamos Nays: None The above motion was amended to include waiving the specific requirements of Grapevine Comprehensive Zoning Ordinance 82-73, Section 47E.2 pursuant to Section 47F, with the prevailing vote as follows: Ayes: Cook, Oliver, Martin, Meyer, Young, Freed, and Stamos Nays: None SPECIAL USE APPLICATION SU91-02, SUBMITTED BY METROCEL,. CELLULAR TELEPHONE COMPANY Next for the Commission to consider and make a recommendation to the City Council was Special Use Application SU91-02, submitted by MetroCel Cellular Telephone Company. In the public hearing, Director of Community Development Tommy Hardy advised that MetroCel Cellular Telephone Company is requesting a waiver to specific requirements of Section 47E.2 pursuant to Section 47F of Ordinance No. 82-73, as amended, and requesting a conditional use permit to allow a 1001 cellular antenna and a 211x 211 utility building at 1201 Minters Chapel Road and platted Lot 1, Block 2, DFW Freight Centre Addition. The subject 2.5 acre tract is zoned 'ILI" Light Industrial District. Mr. Hardy then introduced Mr. Victor Blood, who stated that the antenna would help fill in the dead spots for metrocellular telephones in the area. With no other questions from the Commission or council, no guests to speak and no letters or petitions, the public hearing was then closed. In the Commission's deliberation session, following a brief discussion, Commission Member Larry Oliver, and a second by Cathy Martin was to recommend the City Council approve specific Use Application SU91-02 as submitted, with the prevailing vote as follows: Ayes: Cook, Oliver, Martin, Meyer, Young, Freed, and Stamos Nays: None The above motion was amended to include waiving the specific requirements of Grapevine Comprehensive Zoning Ordinance 82 -73, Section 47E.2 pursuant to Section 47F, with the prevailing vote as follows: Ayes: Cook, Oliver, Martin, Meyer, Young, Freed, and Stamos Nays: None FINAL PLAT OF LOT 29R, BLOCK 3, PLACID PENINSULA ADDITION, SECTION "All, BEING A REPLAT OF LOT 29, BLOCK 3 AND AN UNPLATTED TRACT LOCATED ON THE WEST SIDE OF PENINSULA DRIVE. Next for the Commission to consider and make recommendation to the City Council, was the final plat of Lot 29R, Block 3, Placid Peninsula Additional, Section "A", being a replat of Lot 29, Block 3 and an unplatted tract located on the west side of Peninsula Drive. Senior Civil Engineer, Larry Frassinelli stated that the property 0 is located on the west side of Peninsula Drive, approximately 1,000 feet west of Redbird Lane. A single family dwelling presently exists on Lot 29. This plat will supersede the previous plat of this lot as recorded in Volume 388-C, Page 61, as recorded in the Plat Records of Tarrant County, Texas. This property fronts Peninsula Drive on the east side of the property. Mr. Frassinelli introduced Mr. Dale Agnew, owner and resident of the property. Mr. Agnew explained that he would like to combine the lots in order to expand his house and allow for the setbacks. City Secretary, Linda Huff read a letter from Mr. Gary N. Houdek, Lot 30, Block 4 stating that expansion of the house would interrupt their view of the lake. With no other questions from the Commission or council, no guests to speak, or petitions, the public hearing was closed. In the commissions's deliberation session, following a brief discussion, Commission Member Curtis Young's motion and Larry Oliver's second was to recommend the city council approve the Final Plat of Lot 29R, Block 3, Placid Peninsula Addition, with the prevailing vote as follows: Ayes: Cook, Oliver, Martin, Meyer, Young, Freed, and Stamos Nays: None PROPOSED AMENDMENT TO GRAPEVINE COMPREHENSIVE ZONING ORDINANCE 82- 73, SECTION 39, HISTORIC LANDMARK DISTRICT Next for the Commission to consider and make recommendation to the City Council was the proposed Amendment to Grapevine Comprehensive Zoning Ordinance 82-73, Section 39, Historic Landmark District. Director of Community Development, Tommy Hardy stated that the local Historic Preservation Committee along with the Foundation Director and the Director of Community Development developed an ordinance establishing an overlay zoning district for historic landmarks. This district would be added to the Zoning ordinance as Section 39. The district establishes procedures to designate those premises, lots or tracts as historic landmarks. The ordinance as written defines what is an historic landmark, how it shall be designated and the criteria to use for determination purposes. Mr. Hardy asked if the City Council Members could include in their discussion of Zoning Ordinance 82-73, Section 39, Historic Landmark District, the Proposed Historic Preservation ordinance, Appendix G of the Grapevine Code of Ordinances. Mr. Hardy then presented Mr. Ron Emrich, Foundation Director of the Grapevine Historic Foundation. Mr. Emrich gave a summary of what the proposed Historic Preservation ordinance proposes. 5 At this time Mayor Tate asked if there were any guests that would like to speak. The following people came forward: 1. Susan Massey stated she thought the restoration should be on a voluntary basis only. Mayor Tate said that the volunteer process had already been tried and had not worked, this is why further steps had to be taken. 2. Jess Daniel, Chairman of the local Historic Preservation Committee, stated that it would be good for the City. 3. Rebecca Carlson, stated that the Grapevine Historical Society fully supports the Historic Foundation. 4. Joe Gregory, stated that he and others on Main Street were concerned as they did not know of the ordinance or the wording of it and would like the opportunity to read it. 5. Bill Deacon stated that it has the possibility of being successful. He stated that there is a need to be careful of the way the ordinance is administered and careful of the people selected. With no one else to speak, no letters or petitions, the public hearing was closed. END OF JOINT HEARING OLD BUSINESS PROPOSED AMENDMENTS TO COMPREHENSIVE ZONING ORDINANCE NO. 82-73, AS AMENDED, SECTION 56 OFF-STREET PARKING First on the Agenda for the Commission to consider and make recommendation to the Council was the proposed changes to the Comprehensive Zoning ordinance No. 82-73, as Amended, Section 56 off-Street Parking. After a brief discussion concerning whether the wording should be changed for golf course parking, a motion by Curtis Young, a second by Cathy Martin was to leave the wording as is: Golf Course (public & private), number of parking spaces, 5, required for each hole, 1 space - 10 linear feet of a driving range, plus 50% of any required parking for each additional use. with the prevailing vote as follows: Ayes: Cook, Oliver, Martin, Meyer, Young, Freed, and Stamos Nays: None L-A PRELIMINARY PLAT OF TIMBERLINE EAST ADDITION Next for the commission to consider and make recommendation to the Council was the Preliminary Plat of Timberline East Addition. Civil Engineer, Scott Dyer stated that the property is located on the south side of Timberline Drive east of the recently approved Heatherwilde Addition, with the extension of Heritage Avenue and west of William D. Tate Avenue. The Developer in his application for a preliminary plat of the property declined to dedicate additional right-of-way needed to meet the minimum thoroughfare requirement of 75 feet for Timberline Drive. Timberline Drive was reconstructed in 1985 with a pavement width of 41 feet and right-of-way with 60 feet. The Master Thoroughfare Plan adopted in 1987 reflects a minimum 45 foot pavement section or a preferred 49 foot pavement section to serve anticipated traffic circulation needs at ultiimate development. Mr. Joe Wright stated that he did not want to give the additional right-of-way for Timberline Drive because he felt that Council would never approve the widening of Timberline Drive to the Thoroughfare Plan requirements. Mr. Wright felt the additional right-of-way would be wasted and not be used by the City. He preferred the needed 15 feet be used by the new single family subdivision as they seemed fit. After a brief discussion, a motion by Cathy Martin, and second by Steve Stamos was to recommend that the City Council approve the request for the preliminary Plat of Timberline East Addition, with the prevailing vote as follows: Ayes: Cook, Oliver, Martin, Meyer, Freed, and Stamos Nays: Young The request was approved, but will allow the right-of-way to reflect 601 and not the required 75. PRELIMINARY PLAT OF HERITAGE OAKS ADDITION Next for the Commission to consider and make recommendation to the City Council is the Preliminary Plat of Heritage Oaks Addition, located on the southeast corner of the intersection of Parr Road and O'Dell Court north. After a brief discussion, a motion by Cathy Martin, and second by Darlene Freed was to recommend that the City Council approve the request for the Preliminary Plat of Heritage Oaks Addition, with the prevailing vote as follows: ig Ayes: Cook, Oliver, Martin, Meyer, Freed, and Stamos Nays: Young AMENDMENTS TO COMPREHENSIVE ZONING ORDINANCE NO. 82 -73 AS AMENDED BY ADDING A NEW DISTRICT SECTION 39 HISTORIC LANDMARK Next for the Commission to consider and make recommendation to the City Council are the Amendments to Comprehensive Zoning Ordinance No. 82 -73, as Amended, by adding a new district Section 39, Historic Landmark. After a brief discussion, a motion by Curtis Young, and second by Darlene Freed was to recommend that the City Council approve the request for the proposed Amendments and a new district Section 39, Historic Landmark, with the prevailing vote as follows: Ayes: Cook, Oliver, Martin, Meyer, Freed, and Stamos Nays: None APPROVAL OF MINUTES OF THE PLANNING AND ZONING MEETING OF SEPTEMBER 3 1991 MEETING A motion by Ery Meyer and a second by Darlene Freed was to approve the minutes of the September 3, 1991 meeting as amended with the prevailing vote as follows: Ayes: Oliver, Martin, and Meyer, Young, Freed and Stamos Nayes: None Abstain: Cook ADJOURNMENT: With no further business for the Commission to consider, a motion by .Larry Oliver and second by Cathy Martin was to adjourn the meeting at 11:15 P.M., with the prevailing vote as follows: Ayes: Cook, Oliver, Martin, Meyer, Young, Freed and Stamos Nays: None PASSED AND APPROVED BY THE PLANNING AND ZONING COMMISSION OF THE CITY OF GRAPEVINE, TEXAS, ON THIS THE 15th DAY OF OCTOBER 1991.
