Mayor Tate called the meeting to order at 7:40 PM; and Planning and Zoning Commission Chairman Ron Cook called the Commission's portion of the meeting to order at approximately 9:10 PM. ZONING APPLICATION Z89-16-FRED JOYCE-MARY STONE MYERS ENTERPRISES The first item for the Commission to consider and make a recommendation to the City Council was Z89-16 submitted by Fred Joyce-Mary Myers Enterprises, Inc. requesting rezoning of approximately 26.81 acres frcm "R-20", Single-Family Zoning District Regulations to "R-12.5", Single-Family Zoning District Regulations. The public hearing had been continued to the July 17, 1990, Joint City Council and Planning and Zoning Commission Meeting and had originally been scheduled for June 19, 1990. The subject property is located north of Barberry Road and Stonewood Phase I, south of Parr Park, east of Druid Hills and west of W. T. Parr Road. The applicant had submitted a letter requesting the public hearing be tabled to the July 17 Meeting to provide time to address certain concerns of the surrounding property owners. Marcy Ratcliff, Planner, presented slides to review the the location, the present and requested zoning, and advised the zoning to the north is Governmental Use and R-20, Single Family developed as Parr Park and single-family residences; the area to the south zoned R-12.5 and R-7.5, single-family is developed with Stonewood Phase I and High Country Estates; to the east the R-20 zoning and unannexed Stone property is developed with unplatted residences; and to the west the R-20 zoned land is developed with Druid Hills, Skyline Oaks and unplatted residences. Further, Mrs. Ratcliff advised that a three-fourths vote of the City Council would be required to approve the rezoning because Staff was in receipt of a petition containing signatures of property owners comprising 350 of the surrounding 200 foot perimeter of the tract. Then Mrs. Ratcliff introduced Mr. Fred Joyce who advised Mr. Pete Henderson and Mary Myers were also present. Further, it was noted that the surrounding zoning was Governmental Use, being airport property with Terminal 1W located to the north, Terminals 3W and 4W to the south, Terminal 2E to the east and airport runways to the west. A brief history of the tract was reviewed. Mrs. Ratcliff then introduced Mr. Victor Toledo, the applicant's counsel who introduced Mr. Chuck Lynch, General Manager of TWA. With no questions or requests from guests to speak and no correspondence to report, the public hearing was then closed. In the Commission's deliberation session, with no deliberations or discussion, Commissioner Cathy Martin's motion and Ery Meyer's second was to recommend the City Council approve Conditional Use Application 90-09, with the prevailing vote as follows: Ayes- Oliver, Martin, Meyer, Atchley, Hinson and Palpant Nays: None Absent: Cook Next for the Commission to consider and make a recommendation to the City Council was Conditional Use Application 90-10 submitted by Michael F. Tkqichell, Inc. for Tan Thumb Stores. Mrs. Ratcliff's slide presentation indicated the subject site plan revision for 14.1 acres, being 120 Park Blvd., or Block 1, Lots 1, 2, 3, 4, and 5 of the Park and Wall Addition. It was noted that the CC zoned site plan was for a Planned Commercial Center designation for off-premise consumption of alcoholic beverages (beer only) on Lot 4 and a 40 foot pole sign at the corner of Wall and SH 114. The requested conditional use was to amend the existing approved site plan for a Planned Commercial Center designation, the sale, storage and off-premise consumption of alcoholic beverages (beer only); and a 40 foot pole sign. The purpose of the site plan amendment is to increase the building area at the front entry of the Tom Thumb Store by 3,480 square feet; to amend the area for beer storage; to add temporary promotional display areas for beer; to relocate both store entries and handicap parking spaces and to provide several cart storage areas in parking islands and revise the building facades and requesting a waiver from the Site Plan Review application requirements of Section 47.E.2 in accordance with Section 47.F. A brief review of the history of the subject tract and surrounding zoning was offered, then Mr. Mike Bailey and Mr. Mike Twichell were introduced. Discussion from Commission and Council related to the pole signs and the building facade changes. City Secretary Linda Huff read into the record a letter from Glynda Burgess expressing approval of the request; and with nothing further to consider, the public hearing was then closed. Robert Price advised that the developer is correcting the storm drainage problem into Altacrest. Larry Frassinelli advised that the preliminary plat was approved April 3, 1990, and cash-in-lieu-of open space fees had been accepted, and all the requirements of the Thoroughfare Plan for Glade and Baze will be fulfilled. Following a brief discussion, Commissioner Robert Hinson's motion and Michael Palpant's second was to recommend the City Council approve the plat, with the prevailing vote as follows: Ayes: Cook, Oliver, Martin, Meyer, Atchley, Hinson and Palpant Nays: None FD,qAL PLAT OF GLADE TREE ESTATES Next the Commission was to consider the Final Plat of Glade Tree Estates Addition being 4.37 acre tract east of Baze, west and north of Glade, the tract is zoned "R-7.5", Single-Family District Regulations, being platted into 16 lots. Larry Frassinelli discussed the 15 foot right-of-way dedication for Glade Road and that existing utilities provided by the Glade Lane Addition will be adequate. Following a brief discussion relating to a forty foot (40') buffer requirement, a motion from Commissioner Hinson and second from Larry Atchley was to recommend the City Council approve the final plat as submitted, with the prevailing vote as follows: Ayes: Cook, Oliver, Martin, Meyer, Hinson, Atchley and Palpant Nays: None PROPOSED AMENDMENTS TO PLANNING AND ZONING COMMISSION BY -LAWS GRAPEVINE CODE OF ORDINANCES, SECTION 19 Next for the Commission to consider was proposed amendments to their By-Laws, Section 19 of Grapevine Code of ordinances. Marcy Ratcliff advised City Assistant Attorney Chris Caso changed the By-Laws to comply with current State Statutes; that a change to Section 19-31 changed Appendix A to Appendix D; and since the Commission does not make an annual report to the City Council, Section 19-22-C was amended to eliminate the requirement. With no further discussion, Robert Hinson's motion and Cathy Martin's second was to approve the Amendments to the By-Laws as recommended, with the prevailing vote as follows: Ayes: Oliver, Martin, Meyer, Atchley, Hinson and Palpant Nays: None Absent: Cook TREE REMOVAL PERMIT TR90-02 - TOM THUMB TRACT Next for the Commission to consider was Tree Removal Permit 90-03. Marcy Ratcliff introduced Larry Cates and Mike Bailey to address the subject tree removal permit. Following a brief discussion, Commissioner Atchley made a motion to approve the permit with the condition that a preconstruction conference be held between the contractor for the dirt work and City Staff to identify the trees it is possible to save. The motion failed for lack of a second.
