SUBJECT: SPEED LIMITS — LAKE POINTE SUBDIVISION
RECOMMENDATION:
City Council to consider adopting an ordinance amending Section 23-26, Speed Limits-
Schedule for Certain Public Streets and Ways, of the City Code of Ordinances to
establish a 25 mph speed zone in both directions on Canyon Lake, Falcon Drive, Huron
Drive, Lake Pointe Drive, and Lavon Drive within the Lake Pointe subdivision; and take
any necessary action,
BACKGROUND:
Under the Texas Transportation Code (Sect. 545.352), the prima facie speed limit on
streets within an "urban district" is 30 MPH. The City has the authority under Sect.
545.356 of that Code to reduce the speed limit to 25 MPH on local streets without a
formal engineering and traffic investigation "if the governing body determines that the
prima facie speed limit on the highway is unreasonable or unsafe".
When the plat forte Lake Pointe subdivision was prepared, curves on Falcon Drive
were designed for a reduced speed to meet the site configuration bordering Farris
Branch tot west. Given the presence of these curves, the very short segment lengths
of the other streets in the subdivision, the two 90 degree turns at the no and south
end of Canyon Lake, and the generally isolated nature o f t his subdivision with its single
point of public access from Dove Loop, it is recommended that all streets in the
subdivision be zoned at 25 MPH for consistency throughout the neighborhood.
The final plat is attached as an exhibit to illustrate the layout oft streets affected. This
subdivision is currently under construction, and the roadways are not yet built.
As is the current practice for new signing installations, ones ee limit sign will be posted
at the entrance to the subdivision on Lake Pointe Drive following the completion of
construction.

Section 1. That Chapter 23 Traffic, Section 23-26 Schedule for Certain Public
Streets n d Ways of the r evin of r in n s is hereby amended upon the
sip of an engineering and traffic investigation heretofore made as au horiz y the
provisions i n 167 and 169 of Article XIX, R.C.S. 6701d, Uniform .

Section 2. That the City r® or his designee, is hereby authorized to have
the proper traffic signs erected, constructed, and placed at such points along said
highways, streets or alleys, or portions hereof under construction, maintenance or repair so
that travelers will be reasonably notified of said traffic regulations.
Section 3. That all ordinances or any parts thereof in conflict with the terms of this
ordinance shall be and hereby are deemed repealed and of no force or effect; provided,
however, that the ordinance or ordinances under which the cases currently filed and
pending in the Municipal Court of the City of Grapevine, Texas, shall be deemed repealed
only when all such cases filed and pending under such ordinance or ordinances have been
disposed of by a final conviction or a finding not guilty or nolo contendere, or dismissal.
Section 4. That any person violating any of the provisions oft is ordinance shall
be deemed guilty of a misdemeanor and upon conviction thereof shall be fined in a sum
not to exceed Two Hundred Dollars ($200.00) and a separate offense shall be deemed
committed upon each day during or on is a violation occurs or continues.
Section 5. That if any section, article, paragraph, sentence, clause, phrase or
or in this ordinance, orapplication thereto any person or circa mstances is of invalid or
unconstitutional by a Court of competent jurisdiction, such holding shall not affect the
validity of the remaining portions of this ordinance; and the City Council hereby declares it
would have passed such remaining portions oft ordinance despite such invalidity, is
remaining portions shall remain in full force and effect.
Section 6. Thatthe fact thatthe present ordinances and regulations oft Cityof
Grapevine, Texas are inadequate to properly safeguard the health, safety, morals, peace
and general welfare of the public creates an emergency is requires that this ordinance
become effective from and after the date of its passage, and it is accordingly so ordained.
