SUBJECT: CONSIDER APPROVAL OF A CONTRACT WITH DAVID C.
BALDWIN FOR THE DESIGN OF THE MEDIAN LANDSCAPING
ON SH 26
RECOMMENDATION:
Staff recommends the City Council approve a contractwith David C. Baldwin for the design
of the median landscaping on SH 26 in the amount of$ 55,000. A copy of the contract is
attached for review.
FUNDING SOURCE:
Funds are available in account 121-44540-312-12-000010.
BACKGROUND INFORMATION:
Construction of the widening of SH 26 is taking place at this time with an estimated
completion date of January 2013. The construction project includes medians. The
proposed contract with David C. Baldwin is for the landscape design of the medians
utilizing low maintenance, low water requirement landscaping.
A total of four landscape design firms responded to a Request for Qualifications for the
design of the median landscaping on SH 26. The four firms were MESA Design, La Terra,
Conerstone and David C. Baldwin. Interviews were held on January 4, 2012.
Five city staff from the Public Works Department and the Parks& Recreation Department
made up the interview team. The interview team rated the consulting firms on professional
reputation, experience, understanding of the project, familiarity with TxDOT projects and
requirements and the references. At the end of the interviews, the team discussed the
strengths and weaknesses of each of the teams interviewed and then did a blind vote to
rank the firms. David C. Baldwin led the firms in the scoring.
In closing, staff recommends the Council approve the contract with David C. Baldwin for
the design of the median landscaping on SH 26 in the amount of$55,000.

This proposal/contact is for landscape architectural design and consulting services by
DAVID C. BALDWIN INC. (the Landscape Architect) for the CITY OF
GRAPEVINE,'TEXAS (the Client and the Owner).
i.0 SCOPE
1.1 The Landscape Architect's area of work shall consist of landscape median
improvements to S.H. 26 from near Pool Road /Brumlow Avenue to east
of Heritage / Kimball Avenues. Total project length is approximately
8,200 lineal feet(4:1.5 miles).
1.2 The construction budget for which this agreement is based is undefined.
1.3 Services shall consist of Schematic Design / Scone Definition, Design
Development, Construction Documents, and Bidding Services
Construction Administration.
2.0 BASIC SERVICES
The Landscape Architect's Basic Services shall consist of the five (5) phases
described in Paragraphs 2.1 through 2.5 as follows:
2.1 SC11EN1ATIC DESIGN/SCOPE DEFINITION
2.1.1 The Landscape Architect shall visit the site to verify and inventory
existing conditions,taking special note of the following:
• Views and vistas
* Relationship to adjacent properties
• Existing and proposed Vehicular and pedestrian circulation
• Special site features
2.1.2 Based on the Engineering Plans previously prepared by others for
the Client, the Landscape Architect shall prepare concept plans and
sketches specifically addressing:
Non-landscape design feature elements (i.e. monuments,
signage,etc.)
• Possible artwork locations and preliminary concepts
• Proposed trees,shrubs,and groundcovers
• Lighting for feature elements. Note: Street lighting not
included
• Irrigation
2.1.3 The Landscape Architect shall provide one (1) professional quality
perspective of proposed design concept to be used by the Client for
communication and presentation purposes. View for the
perspective shall be mutually agreed upon by Client and Landscape
Architect.
2.1.4 The Landscape Architect shall submit to the Client a detailed
Opinion of Probable Cost based on current area or unit costs.
2.2 DE�SMCGN DEVELOPMENT --Based on the approved Schematic Design
and Opinion of Probable Cost, the Landscape Architect shall work in
coordination with the Client to provide Design Development documents
consisting of drawings, sketch details, and other documents top fix and
describe the size and character of the project as to the elements described
under 2.1.2 above.
2.2.1 The Landscape Architect shall submit to the Client an updated
Opinion of Probable Cost.
2.3 CONSTRUCTION DOCUME NTS — Based on the approved Design
Development Documents. the Landscape Architect shall prepare for
approval by the Client, Construction Documents for components
consisting of
Key Plan at a scale of 1"= 300'-0"
• Layout Plans at a scale of 1"-20'-0"
• Paving 1 Layout enlargement plans
• Paving and hardscape details
W Feature element plans and details (i.e. monument, signage.
etc.)
• Detailed layout and specifications for all plantings showing
species, locations, sizes and quantities
Detailed layout and specifications for landscape irrigation
system
Landscape lighting plan for feature lighting (Note: Does
not include street lighting)
• Updated Opinion of Probable Construction Cost
•
Technical specification sections (i.e. enhanced paving, site
features. landscape,irrigation,etc.)
2.4 BIDDING SERVICES
2.4.1 Upon approval of the Construction Documents, the Landscape
Architect shall provide a reproducible plan and specification set to
the Owner for bidding purposes.
2.4.2 During the bidding process, the Landscape Architect shall assist in
preparing addenda as appropriate to interpret, clarify. or expand the
bidding documents.
2.5 CONSTRUCTION ADKAINIS i CATION
2.5.1 The Landscape Architect shall attend a Pre-Construction meeting.
2.5.2 The Landscape Architect shall consult with the Client concerning
the acceptability of substitute materials and equipment proposed by
Contractors when substitution prior to the award to contracts is
allowed by the bidding documents.
2.5.3 The Landscape Architect shall aid the Client in final bid tabulation
and evaluation as requested.
2.5.4 During Construction, the Landscape Architect shall perform the
following construction implementation services:
• Review shop drawings and submittals as requested
• Make a maximum four (4) trips to the site during
construction
• Make one(1)trip to inspect final construction and prepare a
Punch List. Note: Punch List inspection will include
irrigation design subconsultant.
3.0 'i FS
The Client shall compensate the Landscape Architect for the services described in
2.0 above as follows:
3,1 BASIC SERVICES - As outlined under 2.0 above, the Client agrees to
pay the Landscape Architect a lump sum fee of fifty-five thousand
dollars and no cents ($55,OC(4.00) to be billed monthly at a percentage of
the work completed.
3.2 REIMBURSABLE EXPENSES - Direct Expenses such as travel, hotel,
reproduction, long distance telephone, microfilming, plotting,
mylars, and reductions, and other out-ofpocket expenses relating solely
to the project will be invoiced separately at our direct cost times a
multiplier of 1.1. Our reimbursables are charged at the following rates:
• Mileage $ .55 /mile
• Large scale printing $ .b5 /S.F.
LIMITATIONS
Limitations to the work involved are as follows:
4.1 This agreement assumed digital (electronic)files in.dwg(2007)format for
the roadway pavement improvements will be provided to the Landscape
Architect by the Client at no cost to the Landscape Architect.
4.2 Basic Services do not include the following:
• Retainage of an independent artist or art subconsultant. Note:
7 his agreement assumes concept design of art and other feature
elements will be provided by David C. Baldwin Inc.
• Design or engineering for street lighting
Typical civil engineering services (i.e. vehicular paving design,
subsurface drainage calculations and piping,etc.)
• As-built surveys and drawings
• Redesign of project in attempt to reduce construction costs (after
budget approval)
• Attendance at formal meetings or presentations (i.e. Planning and
Zoning, City Council)
' Applying for and obtaining construction pennits
• TDLR Plan or Construction Review fees
• Design of any special site or landscape amenities not previously
outlined under Basic Services (including fountains, water features,
:etc.)
4.3 Clarification: Possible locations and concept design for artwork is
included in the scope of work in this proposal. However, if the Client
elects to proceed with installation(of art), the Landscape Architect will be
given consideration for Additional Services Design Development,
Construction Documents, Bidding, and Construction Services (for the
artwork).
4.4 All fees are due and payable upon receipt at the office of David C.
Baldwin Inc., 730 East Park Boulevard, Suite 100, Piano, Collin
County,Texas 75074.
4.5 Hourly rates of additional services or work requested by Client not under
this contract agreement are as follows:
Principal/Landscape Architect $ 150.00/hour
Senior Landscape Designer $ 105.00/hour
Junior Landscape Designer $ 90.00/hour
Technical(CAD drafting) $ 70.00/hour
Clerical $ 50.00/hour
5.0 STATIETWENT OF.WRISDICTION
The Texas Board of Architectural Examiners has jurisdiction over complaints
regarding the professional practices of persons registered as Landscape Architects
in Texas. The Board's address and phone is P. O. Box 12337,Austin,TX 78711,

6.0 TERMINATION
This contract shall remain in full force and effect until the above referenced work
has been completed. If either party defaults in the performance of this agreement
or materially breaches any of its provisions, the non-defaulting or non-breaching
party shall have the right to terminate this agreement by giving written notice of
termination within fourteen (14) days of the default or breach. Upon receipt of
said notice, the defaulting or breaching party shall have fourteen(14) days to cure
such default or breach. If said default or breach is not cured, the agreement shall
terminate automatically. All notices shall be mailed certified, return receipt
requested,to the following:

If this agreement is terminated, David C. Baldwin Inc. shall be paid a lump sunn
equal to the unpaid portion of the fee for services performed prior to termination,
together with reimbursement for reimbursable expenses.
