The Board approved a variance allowing a lot depth of 85 -feet for an existing lot. TRIPLETT JR, PLANNER II SUBJECT: BOARD OF ZONING ADJUSTMENT CASE #BZA14-02 1715 SILVERSIDE DRIVE MEETING DATE: MONDAY, FEBRUARY 5, 2014 RECOMMENDATION: Staff recommends the Board of Zoning Adjustment approve the following variance and special exception to the Grapevine Comprehensive Zoning Ordinance 82-73 for property located at 1715 Silverside Drive, platted as Lot 58, Shorecrest Acres as follows: Section 15.G.5., "R-7.5" Single Family District, Area Regulations requires a minimum lot depth of 100 -feet. The applicant is requesting a variance of fifteen -feet (15'), and if approved by the Board, would allow a lot depth of 85 -feet (85') for an existing lot. Section 43.E.3., Nonconforming Uses and Structures allows the Board of Zoning Adjustment to approve the remodeling and /or enlargement of a nonconforming use The applicant is requesting a special exception to allow the existing structure to remain as developed along with an expansion as shown on the plot plan. SPECIAL CONDITION: Staff finds that a special condition exists for the variance and special exception requests. Specifically, the existing platted lot was originally platted in 1951 predating the city's first zoning ordinance adopted 1955. Developed property and right-of-way exist to the west and east respectively, eliminating the possibility to expand the site to meet the depth requirement. The site is an existing developed lot, and the existing structure was built in 1965 prior to the rezoning of the site in the 1984 City Rezoning to "R-7.5" Single Family District. To accommodate the reduced lot depth of properties in the immediate vicinity, the Board from 1994 through 2013 has approved variances to lot depth, as well as encroachments into the front and rear yard setbacks for properties addressed at 1725, 1733, 1805, and 1833 Silverside Drive, 607 Redbud Lane, 1723 and 1834 Anglers Plaza, and 1821, 1836 and 1859 Chris Craft, which are also zoned "R-7.5" Single Family District. The front and rear yard variances approved in the immediate vicinity range from five feet to twelve feet and one foot to nine feet respectively. In 2002 the Board approved a special exception 0ABZA\2014\Cases\BZA14-02.4 4 located at 1723 Anglers Plaza, to allow for an expansion for a detached garage to extend to the 25 -foot (25') front yard setback line. BACKGROUND INFORMATION: The applicant intends to expand the existing dwelling from approximately 1,600 -square feet to approximately 2,329 -square feet. The proposed expansion includes adding an approximate 550 -square foot two car garage plus living space above the garage and adding an approximate 130 -square foot master closet to the south elevation. The Board of Adjustment may grant a change of use from one nonconforming use to another nonconforming use provided such change is to a use permitted in a zoning district where the original nonconforming use would be permitted, or provided that such change is to a use permitted in a more restrictive classification. However, such change of use and occupancy shall not tend to prolong the life of a nonconforming use. Upon review of the facts in accordance with Section 67A, the Board of Adjustment may establish a specific period of time for the return of the occupancy to a conforming use. 3. The Board of Adjustment may approve the remodeling or enlargement of a nonconforming use when such an enlargement would not tend to prolong the life of the nonconforming use. The number of dwelling units or rooms in a nonconforming residential use shall not be increased so as to exceed the number of dwelling units or rooms existing on the effective date of this Ordinance. The proposed widening of Grapevine Mills 4 Board of Zoning Adjus ment 213/2014 Parkway (F.M. 2499) and acquisition of approximately 17 -feet (17') of frontage and 7,056 -square feet for the widening of Grapevine Mills Parkway (F.M. 2499) had created a condition in which the proposed location of the sign could no longer meet the minimum ten -foot (10') setback requirement from the property line.
