Mr. Pemberton:
This letter confirms on August 26, 2013, the Board of Zoning Adjustment approved the
following request:
Section 15.G.1, "R-7.5" Single Family District, Area Regulations requires a minimum
front yard setback of 30 -feet. The Board approved a variance of 10 -feet allowing a front
yard depth of 20 -feet for an existing lot.
Section 15,G.2, "R-7.5" Single Family District, Area Regulations requires a minimum
rear yard setback of 25 -feet. The Board approved a variance of three -feet (3') allowing a
rear yard setback of 22 -feet for an existing lot.
Section 15.G.5., "R-7.5" Single Family District, Area Regulations, requires a minimum
lot depth of 100 -feet. The Board approved a variance of fifteen -feet (15') allowing a lot depth
of 85 -feet for an existing lot.

RECOMMENDATION:
Staff recommends the Board of Zoning Adjustment approve the following variances to
Grapevine Comprehensive Zoning Ordinance 82-73 for property located at 1725 Silverside
Drive, platted as Lot 59, Shorecrest Acres as follows:
Section 15.G.1, "R-7.5" Single Family District, Area Regulations requires a minimum
front yard setback of 30 -feet.
The applicant is requesting a variance of 10 -feet (10') to this requirement, and if approved
by the Board would allow a front yard depth of 20 -feet (20) for the existing lot.
Section 15,G.2, "R-7.5" Single Family District, Area Regulations requires a minimum
rear yard setback of 25 -feet.
The applicant is requesting a variance of three -feet (3) to this requirement and if approved
by the Board would allow a rear yard setback of 22 -feet (22') for the existing lot.
Section 15.6.5., "R-7.5" Single Family District, Area Regulations, requires a minimum
lot depth of 100 -feet.
The applicant is requesting a variance of fifteen -feet (15') to this requirement and if
approved by the Board, would allow a lot depth of 85 -feet (85') for the existing lot.
SPECIAL CONDITION:
Staff finds that a special condition exists for all of the requested variances. The subdivision
was platted in 1951, which predates the City's first zoning ordinance adopted in 1955.
Platted developed property exists to the west, eliminating the possibility of expanding the
lot to meet the lot depth. Requiring a 30 -foot front yard setback combined with the required
25 -foot rear yard setback would leave 30 -feet of buildable depth for a structure, limiting the
type of product that can be built on the property. The applicant intends to build an
approximate 4,080 square foot single -story dwelling as shown on the plot plan.

To accommodate the reduced lot depth of properties in the immediate vicinity, the Board
from 1994 through 2002 approved similar variances to lot depth, as well as encroachments
into the front and rear yard setbacks for properties addressed at 1733, 1805, and 1833
Silverside Drive, 607 Redbud Lane, 1723 and 1834 Anglers Plaza, and 1821, 1836 and
1859 Chris Craft, which are also zoned "R-7.5" Single Family District. The front and rear
yard variances approved in the immediate vicinity ranges from five feet to twelve feet and
one foot to nine feet respectively.
The subject site is currently zoned "R-7.5" Single Family District. A 15 -foot drainage
easement exists adjacent to the south property line. The applicant and property owner
have committed to relocating the storm drain pipe or reducing the proposed dwelling
footprint outside of the easement. The application was submitted by Richard Pemberton,
representing property owner John Perrault.

4. Maximum Building Coverage: The combined area occupied by all main and
accessory buildings and structures shall not exceed forty (40) percent of the
total lot area.
5. Maximum Impervious Area: The combined area occupied by all buildings,
structures, off-street parking and paved areas shall not exceed sixty (60)
percent of the total lot area.
6. Minimum Floor Area: The minimum square footage of a dwelling unit shall
be not less than twelve hundred (1,200) square feet of floor area.
G. AREA REGULATIONS:
The following minimum standards shall be required:

A minimum of fifty (50) percent of the area of the lot within the required front
yard setback shall be a landscaped area.

Except reverse frontage lots shall be a minimum of ninety-five (95) feet in
width.
5. Depth of lot, feet - 100
6. DISTANCE BETWEEN BUILDINGS: The minimum distance between
principal or accessory buildings on adjacent lots shall be not less than twelve
(12) feet.
7. Only one single-family detached dwelling shall be permitted on each lot or lot
of record, as the case may be.
H. BUFFER AREA REGULATIONS:
Whenever an R-7.5 Single family development is located adjacent to an existing
multi -family district (RMF -1, RMF -2, R-3.75, R-TH) or a non-residential district,
without any division such as a dedicated public street, park or permanent open
space, all principal buildings or structures shall be set back a minimum of forty (40)

Proposal: The request is for the following variances to the Grapevine
Comprehensive Zoning Ordinance 82-73: Section 15.G.1., "R-7.5" Single Family District,
Area Regulations, requires a minimum front yard setback of thirty feet (30'). The applicant
is requesting a variance of ten feet (10') to this requirement and if approved by the Board
would allow a front yard setback of twenty feet (20') for the existing lot. Section 15.G.2.,
"R-7.5" Single Family District, Area Regulations, requires a minimum rear yard setback of
twenty-five feet (25'). The applicant is requesting a variance of three feet (3') to this
requirement and if approved by the Board would allow a rear yard setback of twenty-two
feet (22') for the existing lot. Section 15.G.5., "R-7.5" Single Family District, Area
Regulations, requires a minimum lot depth of 100 -feet. The applicant is requesting a
variance of fifteen feet (15') to this requirement and if approved by the Board would allow a
lot depth of eight -five feet (85') for the existing lot.
After all parties have been given an opportunity to speak, the public hearing will be closed

The Board approved the following request
Section 43.E.3., Nonconforming Uses and Structures allows the Board of Zoning
Adjustment to approve the remodeling and/or enlargement of a nonconforming
use. The Board approved a special exception to allow the existing residential structure
to remain as developed along with an expansion as shown on the plot plan.

DOOLEY STREET
The first item for the Board of Zoning Adjustment to consider was BZA13-08 submitted
by Tony Dierolf, for property located at 205 South Dooley Street, legally described as
Lots 1 & 2, Block 100, College Heights Addition.
Section 43.E.3., Nonconforming Uses and Structures allows the Board of Zoning
Adjustment to approve the remodeling and/or enlargement of a nonconforming
use.
The applicant requested a special exception allowing the existing residential structure to
remain as developed along with an expansion as shown on the plot plan.
Mr. Triplett explained that Staff found a special condition existed for the requested
special exception. Specifically, the lots were part of the College Heights addition,
originally platted in 1909 predating the City's first zoning ordinance adopted in 1955.
Developed property and right-of-way existed to the east and west eliminating the

The next item for the Board of Zoning Adjustment to consider was BZA13-11 submitted
by Patricia Jefferson for property located at 2136 Branchwood Drive, legally described
as Lot 6, Block 1, Winding Creek Estates.
Section 42.C.3, Supplementary District Regulations, Accessory Buildings
requires accessory buildings in a residential district be located on the rear one-
half of the lot and at least 10 -feet from any dwelling or building.
Mr. Triplett explained that during the review process Staff determined that the variance
requested for the subject site was not needed and therefore had been withdrawn.
Ken White made a motion to accept Staff's recommendation to withdraw the variance
requested. Robert Rainwater seconded the motion which prevailed by the following

The next item for the Board of Zoning Adjustment to consider was BZA13-12 submitted
by Richard Pemberton representing property owner John Perrault for property located at
1725 Silverside Drive, legally described Lot 59, Shorecrest Acres.
Section 15.6.1, "R-7.5" Single Family District, Area Regulations requires a
minimum front yard setback of 30 -feet. The applicant requested a variance of 10 -feet
(10') allowing a front yard depth of 20 -feet (20) for an existing lot.
Section 15,G.2, "R-7.5" Single Family District, Area Regulations requires a
minimum rear yard setback of 25 -feet. The applicant requested a variance of three -
feet (3) allowing a rear yard setback of 22 -feet (22') for an existing lot.
Section 15.6.5., "R-7.5" Single Family District, Area Regulations, requires a
minimum lot depth of 100 -feet. The applicant requested a variance of fifteen -feet (15)
allowing a lot depth of 85 -feet (85') for an existing lot.
Mr. Triplett explained that Staff found special conditions existed for the requested
variances. Specifically, the subdivision was platted in 1951, predating the City's first
zoning ordinance adopted in 1955. Developed property existed to the west that
eliminated the possibility of expanding the lot to meet the lot depth.
He explained that a required 30 -foot front yard setback combined with the required 25 -
foot rear yard setback would leave 30 -feet of buildable depth for a structure, limiting
what could be constructed on the property. The applicant intended to construct an
approximate 4,080 square foot single -story dwelling as shown on the plot plan
