The Board approved a variance of 10 -feet allowing a front yard depth of 20 -feet for an existing lot. Section 15,G.2, "R-7.5" Single Family District, Area Regulations requires a minimum rear yard setback of 25 -feet. The Board approved a variance of three -feet (3') allowing a rear yard setback of 22 -feet for an existing lot. TRIPLETT JR, PLANNER II SUBJECT: BOARD OF ZONING ADJUSTMENT CASE #BZA13-12 1725 SILVERSIDE DRIVE MEETING DATE: MONDAY, AUGUST 26, 2013 RECOMMENDATION: Staff recommends the Board of Zoning Adjustment approve the following variances to Grapevine Comprehensive Zoning Ordinance 82-73 for property located at 1725 Silverside Drive, platted as Lot 59, Shorecrest Acres as follows: Section 15.G.1, "R-7.5" Single Family District, Area Regulations requires a minimum front yard setback of 30 -feet. The applicant is requesting a variance of 10 -feet (10') to this requirement, and if approved by the Board would allow a front yard depth of 20 -feet (20) for the existing lot. Section 15,G.2, "R-7.5" Single Family District, Area Regulations requires a minimum rear yard setback of 25 -feet. The applicant is requesting a variance of three -feet (3) to this requirement and if approved by the Board would allow a rear yard setback of 22 -feet (22') for the existing lot. Section 15.6.5., "R-7.5" Single Family District, Area Regulations, requires a minimum lot depth of 100 -feet. The applicant is requesting a variance of fifteen -feet (15') to this requirement and if approved by the Board, would allow a lot depth of 85 -feet (85') for the existing lot. SPECIAL CONDITION: Staff finds that a special condition exists for all of the requested variances. The subdivision was platted in 1951, which predates the City's first zoning ordinance adopted in 1955. Platted developed property exists to the west, eliminating the possibility of expanding the lot to meet the lot depth. Requiring a 30 -foot front yard setback combined with the required 25 -foot rear yard setback would leave 30 -feet of buildable depth for a structure, limiting the type of product that can be built on the property. The applicant intends to build an approximate 4,080 square foot single -story dwelling as shown on the plot plan. 0:\BZA\2013\Cases\BZA 13-12.4 To accommodate the reduced lot depth of properties in the immediate vicinity, the Board from 1994 through 2002 approved similar variances to lot depth, as well as encroachments into the front and rear yard setbacks for properties addressed at 1733, 1805, and 1833 Silverside Drive, 607 Redbud Lane, 1723 and 1834 Anglers Plaza, and 1821, 1836 and 1859 Chris Craft, which are also zoned "R-7.5" Single Family District. The front and rear yard variances approved in the immediate vicinity ranges from five feet to twelve feet and one foot to nine feet respectively. The subject site is currently zoned "R-7.5" Single Family District. A 15 -foot drainage easement exists adjacent to the south property line. The applicant and property owner have committed to relocating the storm drain pipe or reducing the proposed dwelling footprint outside of the easement. Mr. Triplett explained that Staff found a special condition existed for the requested special exception. Specifically, the lots were part of the College Heights addition, originally platted in 1909 predating the City's first zoning ordinance adopted in 1955. Developed property and right-of-way existed to the east and west eliminating the BRANCHWOOD DRIVE The next item for the Board of Zoning Adjustment to consider was BZA13-11 submitted by Patricia Jefferson for property located at 2136 Branchwood Drive, legally described as Lot 6, Block 1, Winding Creek Estates. Section 42.C.3, Supplementary District Regulations, Accessory Buildings requires accessory buildings in a residential district be located on the rear one- half of the lot and at least 10 -feet from any dwelling or building. Mr. Triplett explained that during the review process Staff determined that the variance requested for the subject site was not needed and therefore had been withdrawn. Ken White made a motion to accept Staff's recommendation to withdraw the variance requested. Section 15.6.1, "R-7.5" Single Family District, Area Regulations requires a minimum front yard setback of 30 -feet. The applicant requested a variance of 10 -feet (10') allowing a front yard depth of 20 -feet (20) for an existing lot. Specifically, the subdivision was platted in 1951, predating the City's first zoning ordinance adopted in 1955. Developed property existed to the west that eliminated the possibility of expanding the lot to meet the lot depth. He explained that a required 30 -foot front yard setback combined with the required 25 - foot rear yard setback would leave 30 -feet of buildable depth for a structure, limiting what could be constructed on the property.
