On June 10, 2013, the Building Board of Appeals approved Building Board of Appeals
Case BBA13-03 for 3710 Kelsey Court, legally described as Lot 26, Block 1, Woodland
Estates. The following request was to Grapevine Code of Ordinances, Chapter 7, Article
IV:
Section 7-127, Fences, Front Yard Requirements, to allow a six-foot (6') wood fence within
the required and established front yard as shown on the site plan.

RECOMMENDATION:
Staff recommends the Building Board of Appeals Approve the following request
to City of Grapevine Code of Ordinances, Chapter 7, Article IV, Fences, for
property addressed as 3710 Kelsey Court, legally described as Lot 26, Block 1,
Woodland Estates Addition:
Section 7-127, Fences, Front Yard Requirements, requires fences constructed in
a required or established front yard to be 36 inches or less in height, and have at
least 50 percent through vision.
The applicant is requesting to construct a six-foot tall (6') wood fence within the
required and established front yard.
SPECIAL CONDITION:
Staff feels a special condition exist for this request, as the portion of the front
yard in which the fence encroaches does not resemble a typical front yard, nor
function as a typical front yard.
BACKGROUND INFORMATION:
The application was submitted by property owner Terrie Walsh. The proposed
fence will replace an existing chain link fence. Because of the shape of the lot
and its location in the cul-de-sac, the front building line extends well into the area
in which the side yard is typically designated. The fence does not encroach into
the portion of the front yard adjacent to the street. Lastly, the fence intersects the
property line in a way in which it does not impair the view from adjacent homes.

My property sits at a very strange angle to the street. I would like a fencing variation that would allow me to put up a 6 foot wood fence
lat the front of the house. Due to the odd angle, this fence will cross the front of the house line. Although it crosses the line, the fence
will actually look like it does not due to the strange angle. If the fence was place on the front house line, it would be an unattractive
eyesore and detract from the neighborhood appearance.
5. State justification for the appeal and explain how a hardship would be created if the appeal is not granted. Explain how your
situation is peculiar to the circumstances contemplated by the ordinance and attach drawings necessary to help explain the case
to the Board. {You do not need to attach the same drawings as attached to your application for a building permit as the Building
Official will provide the Board with those records.
It is hard to explain in written why this property is unique in how it is situated. My neighbors, to the left when facing my house, side
would still be about 60 feet in front of the location I would like to place my fence. On the right side, I would like to replace the
,chain link fence with a privacy fence.
The area of my backyard were all the kids play is visible from the street. I feel it is important to

ve a safe, protected place for my kids and the neighborhood kids to play. We always have kids over and they can been easily seen
the street. It is easier to hop over a 4 foot chain link fence than a 6 foot wood fence. Thank you for considering my request.

(a) Corner lots: It shall be unlawful to erect a fence in the required front yard building
setback area or the established front yard area, whichever area is greater in depth, on any
corner lot, except along the interior lot line in accordance with subsection (b).
(b) Interior lots:
(1) It shall be unlawful to erect a fence, hedge or vines over 36 inches in height
in the required front yard area or the established front yard area, whichever area is
greater in depth, on any interior lot.
(2) It shall be unlawful to erect a fence, hedge or vines in the required front yard
area or the established front yard area, whichever area is greater in depth, on any
interior lot that does not have at least 50 percent through vision.
(3) It shall be unlawful to maintain a fence, hedge or vines in the required front
yard area or an established front yard area, whichever area is greater in depth, of
an interior lot in a manner that does not permit at least 50 percent through vision.
(4) For the purpose of this section, "established front yard area" shall mean an
open, unoccupied space on a lot facing a street and extending across the front of a
lot between the side yard. lines and extending from the abutting street to a
principal building or structure. The phrase "required front yard" shall have the
meaning ascribed to it in the Grapevine Zoning Ordinance No. 82-73.

Public meeting, but NOT a Public Hearing; public and applicants may
attend, but may not participate unless asked a specific question for
clarification.
• New business — Building Official will present the case. Board members
should use this opportunity to make sure they are clear on the specifics of
the case. Asking questions at this point will help to make the public
hearing more efficient. Board members should not use this briefing
session to deliberate for or against the case.
• Building Official will present miscellaneous reports.
REGULAR MEETING:
• Call to order
New business
■ Chairman will open Public Hearing.
■ Building Official will present the case. Board members may ask
Building Official questions.
■ Applicant will give presentation; Board may ask applicant
questions.
■ Any other interested party may speak and be questioned.

Scott Williams explained that Staff recommended the Building Board of Appeals
approve the applicant's request for approval of a six-foot (6) tall wood fence within the
required and established front yard as shown on the site plan.
Mr. Williams explained that Staff found a special condition existed for the request.
Specifically, the portion of the front yard in which the fence encroached did not
resemble a typical front yard, nor function as a typical front yard.
He stated that because of the shape of the lot and its location at the curve in the road,
the front building line extended well into the area in which the side yard was typically
designated. The fence would not encroach into the portion of the front yard adjacent to
the street and the fence intersected the property line in a way in which it did not impair
the view from adjacent homes.
With no questions for Mr. Williams, Terrie Walsh of 3710 Kelsey Court, Grapevine,
Texas, took the Oath of Truth; she requested favorable consideration of her request
and offered to answer any questions of the Board.
With no further questions for Ms. Walsh, and no additional speakers, Hal Hardister
made a motion to close the public hearing. Clint Hallman seconded the motion which
prevailed by the following vote:

Session and Public Hearing, with an amendment to Public Hearing Minutes page two,
to reflect Clint Hallman seconding the motion that a special condition existed. Clint
Hallman seconded the motion which prevailed by the following vote:
