SPECIAL CONDITION: Staff feels a special condition exist for this request, as the portion of the front yard in which the fence encroaches does not resemble a typical front yard, nor function as a typical front yard. BACKGROUND INFORMATION: The application was submitted by property owner Terrie Walsh. The proposed fence will replace an existing chain link fence. Because of the shape of the lot and its location in the cul-de-sac, the front building line extends well into the area in which the side yard is typically designated. The fence does not encroach into the portion of the front yard adjacent to the street. Speck nature of appeal: I -- N/A My property sits at a very strange angle to the street. I would like a fencing variation that would allow me to put up a 6 foot wood fence lat the front of the house. Due to the odd angle, this fence will cross the front of the house line. Although it crosses the line, the fence will actually look like it does not due to the strange angle. If the fence was place on the front house line, it would be an unattractive eyesore and detract from the neighborhood appearance. 5. State justification for the appeal and explain how a hardship would be created if the appeal is not granted. Explain how your situation is peculiar to the circumstances contemplated by the ordinance and attach drawings necessary to help explain the case to the Board. {You do not need to attach the same drawings as attached to your application for a building permit as the Building Official will provide the Board with those records. It is hard to explain in written why this property is unique in how it is situated. My neighbors, to the left when facing my house, side would still be about 60 feet in front of the location I would like to place my fence. On the right side, I would like to replace the ,chain link fence with a privacy fence. The area of my backyard were all the kids play is visible from the street. I feel it is important to F ve a safe, protected place for my kids and the neighborhood kids to play. We always have kids over and they can been easily seen the street. It is easier to hop over a 4 foot chain link fence than a 6 foot wood fence. Thank you for considering my request. Front yard requirements. (a) Corner lots: It shall be unlawful to erect a fence in the required front yard building setback area or the established front yard area, whichever area is greater in depth, on any corner lot, except along the interior lot line in accordance with subsection (b). (b) Interior lots: (1) It shall be unlawful to erect a fence, hedge or vines over 36 inches in height in the required front yard area or the established front yard area, whichever area is greater in depth, on any interior lot. The Building Board of Appeals considered BBA13-03 submitted by property owner Terrie Walsh for property located at 3710 Kelsey Court, legally described as Lot 26, Block 1, Woodland Estates. The request was to Grapevine Code of Ordinances, Chapter 7, Article IV, Fences: Section 7-127, Fences, Front Yard Requirements, requires fences constructed in a required or established front yard to be 36 inches or less in height, and have at least 60 percent through vision. Scott Williams explained that Staff recommended the Building Board of Appeals approve the applicant's request for approval of a six-foot (6) tall wood fence within the required and established front yard as shown on the site plan. Mr. Williams explained that Staff found a special condition existed for the request.
