Woods Avenue (S.H. 26) as shown on the plot plan. SPECIAL CONDITION: Staff finds that a special condition exists for the special exception request. Specifically, the existing platted and developed lot was in complete compliance with all development criteria as stated within the zoning ordinance however, the front yard landscape setback area of the subject site adjacent to Ira E. Woods Avenue and Pool Road no longer comply with the required landscape area due to right-of-way acquisition of approximately 10,400 -square feet of frontage from the subject property. BACKGROUND INFORMATION: On November 19, 2013 the Council approved on the first reading of an ordinance a conditional use request to amend the previously approved site plan for a gasoline station and convenience store, specifically to revise the site layout. The widening of Ira E. Woods Avenue and Pool Road has necessitated a road realignment of Pool Road and Ira E. Woods Avenue adjacent to the west and north property lines of the subject site. As a result of widening Pool Road and Ira E. Woods Avenue the applicant proposes replacing the canopy, removing three existing gasoline pumps and adding one new gasoline pump. A seven foot high, 77 -square foot monument sign is proposed adjacent to Pool Road. The subject site is currently zoned "HC" Highway Commercial District and is developed with an approximate 4,299 -square foot gasoline station and convenience store. The application was submitted by Walid Aiameddine, representing the property owner Victron Stores, LP. O:\BZA\2013\Cases\BZA13-16A terminated by the Board of Adjustment in accordance with provisions of Section 67A of this Ordinance. E. CHANGING NONCONFORMING USES: Any nonconforming use may be changed to a conforming use, and once such change is made, the use shall not thereafter be changed back to a nonconforming use. 2. The Board of Adjustment may grant a change of use from one nonconforming use to another nonconforming use provided such change is to a use permitted in a zoning district where the original nonconforming use would be permitted, or provided that such change is to a use permitted in a more restrictive classification. However, such change of use and occupancy shall not tend to prolong the life of a nonconforming use. Upon review of the facts in accordance with Section 67A, the Board of Adjustment may establish a specific period of time for the return of the occupancy to a conforming use. 3. The Board of Adjustment may approve the remodeling or enlargement of a nonconforming use when such an enlargement would not tend to prolong the life of the nonconforming use. Upon review of the facts, the Board of Adjustment may establish a specific period of time for the return of the occupancy to a conforming use. F. LIMITATIONS ON CHANGING NONCONFORMING USES: No nonconforming use shall be changed to another nonconforming use, which requires more off-street parking spaces or off-street loading space than the original nonconforming use, unless additional off-street parking and loading space is provided so as to comply with the requirements of Sections 55 and 56. The number of dwelling units or rooms in a nonconforming residential use shall not be increased so as to exceed the number of dwelling units or rooms existing on the effective date of this Ordinance. No nonconforming use may be expanded or increased beyond the lot or tract upon which such nonconforming use is located as of the effective date of this ordinance except to provide off-street loading or off-street parking space upon approval of the Board of Adjustment. The first item for the Board of Zoning Adjustment to consider was BZA13-15 submitted by Evon Harris, for property located at 404 East Worth Street, platted as a portion of Lots 3 & 4, Block 33, City of Grapevine Addition. Section 43.E.3., Nonconforming Uses and Structures allows the Board of Zoning Adjustment to approve the remodeling and/or enlargement of a nonconforming use. The applicant requested a special exception allowing the existing residential structure and detached garage to remain as developed along with an expansion to the dwelling and the addition of a new detached garage as shown on the plot plan. Mr. Triplett explained that Staff found a special condition existed for the requested special exception. Specifically, the dwelling was built in 1925 and the subject site was platted in 1913 predating the City's first zoning ordinance adopted in 1955. He explained that the applicant intended to expand the living area, add a new porte cochere, detached garage and convert the existing garage into a cabana. The proposed conversions would not increase the level of nonconformance to the subject site. The site was noncompliant with the current zoning ordinance (82-73) relative to the required 6 -foot east side yard for the dwelling and the required 6 -foot west side yard setback for the detached garage. With no questions for Mr. Triplett, applicant Evon Harris, of 2925 River Crest, Grapevine, Texas, took the Oath of Truth; she gave a brief presentation to the Board and requested favorable consideration of her request and offered to answer any questions of the Board. Specifically, the existing platted and developed lot was in complete compliance with all development criteria as stated within the zoning ordinance however, the front yard landscape setback area of the subject site adjacent to Ira E. Woods Avenue and Pool Road no longer complied with the required landscape area due to right-of-way acquisition of approximately 10,400 -square feet of frontage from the subject property. He went on to state that the widening of Ira E. Woods Avenue and Pool Road had necessitated a road realignment of Pool Road and Ira E. Woods Avenue adjacent to the west and north property lines of the subject site. As a result of widening Pool Road and Ira E. Woods Avenue the applicant proposed replacing the canopy, remove three (3) gasoline pumps, install one (1) new gasoline pump and install a seven -foot (7') high, 77 - square foot monument sign adjacent to Pool Road.
