Staff recommends the Board of Zoning Adjustment approve the following special
exception to Grapevine Comprehensive Zoning Ordinance 82-73 for property located at
2639 Peninsula Drive, platted as Lot 2, Block 9, Placid -Peninsula Addition as follows:
Section 43.E.3., Nonconforming Uses and Structures allows the Board of Zoning
Adjustment to approve the remodeling and /or enlargement of a nonconforming use
The applicant is requesting a special exception to allow the existing residential structure
and accessory structures to remain as developed as show on the plot plan.
SPECIAL CONDITION:
Staff finds that a special condition exists for the special exception requested. The subject
site is an existing developed lot and the existing structure was built in 1958 prior to the site
being annexed into the City of Grapevine in 1966. The site is noncompliant with the
current zoning ordinance (82-73) relative to the required 25 -foot rear yard setback and the
6 -foot east side yard for the existing dwelling. The detached accessory structures are
noncompliant relative to the location on the subject site and the distance from the dwelling.
The subject site is currently zoned "R-7.5" Single Family District. The existing dwelling
encroaches into the 25 -foot rear yard and 6 -foot east side yard setbacks approximately 18 -
feet and 4 -feet respectively. The two detached accessory structures are located
approximately less than 10 -feet from the dwelling and the cabana is located in the front half
of the lot. The applicant as the prospective owner of the subject site applied for the current
case to proactively address potential title issues related to the existing structures. The
application was submitted by Amy Anderson, representing the property owners James and
Leann Baber.

of Section 67A of this Ordinance.
E. CHANGING NONCONFORMING USES:
Any nonconforming use may be changed to a conforming use, and once
such change is made, the use shall not thereafter be changed back to a
nonconforming use.
2. The Board of Adjustment may grant a change of use from one
nonconforming use to another nonconforming use provided such change is
to a use permitted in a zoning district where the original nonconforming use
would be permitted, or provided that such change is to a use permitted in a
more restrictive classification. However, such change of use and occupancy
shall not tend to prolong the life of a nonconforming use. Upon review of the
facts in accordance with Section 67A, the Board of Adjustment may establish
a specific period of time for the return of the occupancy to a conforming use.
3. The Board of Adjustment may approve the remodeling or enlargement of a
nonconforming use when such an enlargement would not tend to prolong the
life of the nonconforming use. Upon review of the facts, the Board of
Adjustment may establish a specific period of time for the return of the
occupancy to a conforming use.
F. LIMITATIONS ON CHANGING NONCONFORMING USES: No nonconforming use
shall be changed to another nonconforming use, which requires more off-street
parking spaces or off-street loading space than the original nonconforming use,
unless additional off-street parking and loading space is provided so as to comply
with the requirements of Sections 55 and 56.
The number of dwelling units or rooms in a nonconforming residential use shall not
be increased so as to exceed the number of dwelling units or rooms existing on the
effective date of this Ordinance.
No nonconforming use may be expanded or increased beyond the lot or tract upon
which such nonconforming use is located as of the effective date of this ordinance
except to provide off-street loading or off-street parking space upon approval of the
Board of Adjustment.
All nonconforming uses being expanded under the provisions of this Ordinance shall
comply with the other applicable provisions of this Ordinance.
G. TERMINATION OF NONCONFORMING STRUCTURES:

At their November 4, 2013 meeting, the Board of Zoning Adjustment acted on the
following cases:
BZA13-13- Robert Baldwin, 301 South Park Blvd, legally described as Lot 1,
Block 1, Park and Wall Addition
The Board approved the following request
Section 43.E.3., Nonconforming Uses and Structures allows the Board of Zoning
Adjustment to approve the remodeling and/or enlargement of a nonconforming
use. The Board approved a special exception to allow the site to remain as developed
as shown on the plot plan.
Section 60.J.5.a., "Sign Standards" Required Setback, requires a minimum
setback of 10 -feet (10'). The Board approved a variance of nine -feet (9') for an existing
pole sign allowing a setback of approximately one -foot (1) as shown on the plot plan.

The Board approved the following request
