HomeMy WebLinkAboutItem 06 - Electronic CigarettesMEMO TO: HONORABLE MAYOR AND MEMBERS OF THE CITY COUNCIL
FROM: BRUNO RUMBELOW, CITY MANAGER
MEETING DATE: MARCH 18, 2014
SUBJECT: CONSIDER APPROVAL OF AN ORDINANCE RELATIVE TO
TOBACCO FREE PARKS AND PARK FACILITIES AND
INCLUSION OF ELECTRONIC CIGARETTES AS UNLAWFUL
AND APPROVAL OF A RESOLUTION CLARIFYING NAMES OF
PARKS AND FACILITIES
The Parks & Recreation Advisory Board and staff recommend the Council consider an
ordinance amending Chapter 16 Parks & Recreation, Article I, Section 16 -18, Tobacco
Free Parks and Park Facilities by including electronic cigarettes as being unlawful in parks
and park facilities that are posted "This Park/Park Facility is Tobacco and E- cigarette Free."
Staff also recommends the Council consider a resolution naming the parks and park
facilities. Copies of the ordinance and resolution are attached for review.
The Council discussed electronic cigarettes at the March 7 meeting and directed staff to
draft an amendment to the ordinance to include electronic cigarettes for discussion and
consideration.
The Parks & Recreation Advisory Board discussed E- cigarettes at the February 13, 2014
meeting and passed a motion to amend the ordinance to include electronic cigarettes as
being unlawful in parks and park facilities that are currently non - smoking. The discussion
centered around the fact that children cannot differentiate between electronic cigarettes
and cigarettes and that it sends the wrong message to the children if electronic cigarettes
are allowed in parks and park facilities. Staff recommends approval of the ordinance and
the resolution. Below are the parks and park facilities that staff recommends be tobacco
and electronic cigarette free. Those listed in bold print are currently the only facilities
designated as non - smoking by ordinance.
