CITY OF GRAPEVINE
The City Council of the City of Grapevine met in Special Session on
this the 26th day of January, 1989 at 6: 30 p.m. in Cancord I af �he
Grapevine Convention Center, 1209 S. Main Street, with the follow-
ing members present to-wit:

CALL TO ORDER
Mayor Tate called the meeting to order at 6 : 40 p.m.
INVOCATION
Council Member Wilbanks delivered the Invocation.
DFW AIRPURT PROPOSED RUAfWAY 26�34 WEST, DISCUSSION
Mayor Tate welec�med thase in attendance and advised that this
special meeting was called to provide infarmation and direction
pertaining �.o the City' s position regarding the DFW Airport Baard' s
authorization to purchase additianal land for the proposed 16/34
West runway. He advised that the Airpr�rt Board, on January 26, had
authorized the purchase of 153 acres sauth af S. H. 114 in the
; vicinity o� Metraplace Drive and authorized negotiation for pur-
chase of additianal land on the north side of S. H. 114 east of
Main Street.
The City' s official position, as detailed in the Mayar' s letter to
the Airport Board dated January 26, 1989 (Exhibit "A" , attached
hereto and made a part hereaf} , was outlined. The City of Grape-
vine does object ta the lacation and configuration of the prc�posed
north-south runway.
Acting City Manager Kelvin Knauf then gave a brief presentation,
noting on an aerial photograph �he propased runway locatian, the
praposed clear zone, and the immediate area ta be affected by a new
flight path.
Camments fram the Council Members ensued. It was noted that the
City has cooperated over the years with Airport o�ficials, that the
City' s Mas�er Land Use Plans and ather of�icial plans have be,.ren_�as�#�v�
developed in conj unction with the Airport Plan, and (,.�,�l•dse :;
that the proposed Runway 16J34 West was not reflected on the ��
original Airport B�zelx�.pm��. Plan. Council Members alsa expressed
cancern that the City was n t contacted at an� �.ime regarding �.he 3�b�$�!
proposed new runway, and that the City was not allowed to publicly
comment at the Board meeting. (�u�?f�� ��,Kd �C�;c �, 3��,���
City A�torney John F. Boyle, Jr. advised of his opinion regarding
immediate actians available to protect the City' s interests. These
included 1) cantact the Airport Board and Airport Staff and let
them know af aur concerns (which was done by hand delivery of

� Exhibit "A" , attached) ; 2) get with other affected cities in a
! unified effort; and 3 ) look into hiring legal counsel familiar with
this specific area of the law, particularly on acquisition of
property, which is the immediate threat.
! Mayor Tate offered additional concern that the Airport Board had E:
taken this action prior to completion of the Airport Development r
Plan Update currently underway and before filing an Environmental i
Impact Statement with the Federal Aviation Administration. He
r
noted that an attorney specializing in airport environmental and
development problems was going to meet with City of Irving offi-
% cials in the near future and, perhaps, would be available that same
', day to brief the Grapevine Council. ��
Members of the audience were invited to comment. Unidentified `
residents expressed concern about their rights to the airspace [
above their real property and the problems with home financing and �
insurance availability this runway would create. Mr. Mike Shelly,
1228 Oxford Lane, questioned the possibility of injunctive relief.

It was noted by Mayor Tate that avigation releases had been ob- :

tained by the City at the request of the Airport in many of the
newer developments, but that avigation releases had not been
executed for the older neighborhoods which were established at the �
time the airport was developed, many of which neighborhoods would ;
be impacted by Runway 16/34W. He advised the citizens to stay �
informed and be prepared to take a role in the FAA review of the
Environmental Impact Statement by giving public testimony. �.
The letter stating the City' s official position (Exhibit "A"
attached hereto) was read publicly in its entirety by Council �:
Member Wilbanks.
Council Member Spencer then made a motion to instruct the City
• Attorney to evaluate the possibility of filing suit to stop the
acquisition of the land by the Airport and to notify the City
Council as soon as possible when the City Attorney would be pre- "
pared to brief Council in a closed session meeting to discuss ``
contemplated or pending litigation. Ms. Spencer ' s motion also
included authorization of City Staff to search for legal counsel
who may be qualified to represent and advise the City on this
issue. Council Member Wilbanks seconded the motion, which pre-
vailed by the ensuing vote:

Further discussion followed. It was announced that the City
Council would meet in Executive Session on Wednesday, February 1 ,
1989, to discuss pending or contemplated litigation and to inter-
view a lawyer from Washington, DC, who would be briefing the City �
of Irving on that same day.
ADJOURNMENT
Mayor Pro Tem Ware then made a motion to adjourn the meeting at `
7: 25 p.m. The motion was seconded by Council Member Traverse and =
prevailed by the ensuing vote:
Ayes: Tate, Ware, Glynn, Spencer, Wilbanks, Niedermeier & Traverse
Nays: None

Re: Series of Proposed Actions Relative to Runway 16/34 West " °
The City of Grapevine is unalterably opposed to the construction � r'
�� of Runway 16/34 West as described in various material that you - �
reviewed during your meeting of January 24, 1989 and that the �
City of Grapevine just received. � c

We strongly urge and request that you take no action to approve �
any of the items that are on your agenda for January 26, 1989 � �
. relative to Runway 16/34: West. The only prudent and govern- "
mentally sound action that you should take at this time relative `
to those matters is to table each item and set up immediate ;
meetings with City of Grapevine officials and representatives to �•
review all of the startling and devastating ramifications of this � � �
proposed runway on the citizens of Grapevine and their property. `
�
The City of Grapevine ' s opposition to this runway is strong, `
deep, and well founded. The following are the City' s principal :.:��; �'
reasons for such heated opposition: , :�-� "

1. The runway, which is proposed to be at least 6,000 linear
feet, is aimed directly into the heart of Grapevine, almost
on a line with Main Street. The increased safety hazards ,

air traffic , noise, smoke, fumes , and general disruption of
lifestyle will severely damage and harm individuals and
families and result in a significant decrease in property E
values and, in essence, a blight on property values through- ,
� � out the City.

�ax rolls and wi21, in all probability, remain undevelc�ped
3 and exempt �rom taxes. �

' 3 . The City of Grapevine vehementl.y opposes �he payment of �30 �
� million to three property owners for the purchase of prap- �
� erty, when the impac�s from building a runway in the pro-
� posed location will expand noise zanes A and B, will affect
� height res�ric�ions on land outside the Airport boundary, �
� thereby negatively affecting property values in the Gity of �
� Grapevine and future development o� proper�y adjacent ta and
� near the proposed purchase of land. St is un�hinkable that I
s the taking and damaging of the property affected by this �
� proposal would be done wi�hout compensation �a those prop- �
erty owners.
� �
4. This runway was not in the original Airpor� Master Plan, and i
� ali of the City of Grapevine ' s p2anning and zoning and �
j projectians for the future have been based upon the original �
a plan. The Cit�y of Grapevine has worked closeZ�r with �he �
iAirport Board and staff in making plans relative to Iand ;
� use, utility extensions , and its projected tax base. This ;
� runway, if constructed, wou2d destroy much of �he City' s
� planning and would result in great economic loss to the City �
' and its citizens. �

� 5, The clear zone proposed is significantly shorter anc3 smaller �
�t than all of the clear zones acquired for existing runways. �

; It would appear that, in the event of a mishap similar to .. �
; �he F�ight I93 mishap, £acilities such as the Grapevine �- �
; Public Library, Grapevine retail businesses , and Baylor �
� Hasgital would be endangered. ; �

� 6. The City of Grapevine has nat agreed in any manner to the �
� exercise of the power of eminent domain in its City limits
by the _Airport Board to aequire the 153 additional acres.
, The Airpart Baard does not have the iegal power or authority �
' to exercise the power, or the threat of this power, in the �
City limits of Grapevine withau� the approval of the City �
Council. _

7. The purchase of addi�.ional land makes it obvious that �
Da11as1Fort tdorth International �.irport now has land which �
was originally purchased for future deveiopment for which �
there are no future plans for utilization. Grapevine �
demands that this land be dispased of to private property �

It is shocking tha� �he Airport Board wau3.d even consider taking
such drastic action as authorizing the expenditure of thir�.y ;
million dollars withaut firs� considering the matter carefully �
and in detail with the City of Grapevine, and �hen canducting the �
legally required environmen�aZ impact study. To expend thirty �
miliion dallars of public money in advance of taking these two . �
critical and Iegally necessary and prudent s�eps is tantamount �o `
gross negligence on the part of the officials involved. �� �
�.
Considering the fact that the Airport Baard and the City af f
Grapevine have worked together c3osely and in harmony z.n the �
;
planning, building, and apera�.ing of this Airport for over twenty �
( �Ol years, it is beyond belief that the Airport' s Staff would �
recommend such precipitous and premature action by the Airport €
Board. ,
The City of Grapevine, again, respectfully but strongly requests n
thA Airpart Board ta �able all. af the ma�ters on its agenda �
rela�ing to Runway 16134 tdest and to work clasely with City of �
Grapevine officials to review their concerns and to consider �
acceptable alternatives, � g
�� Due to the seriousness af the pro�osed actions and the deadly and �
devastating consequences to the City af Grapevine anci its citi- �
zens, the City will have no chc�ice bu� �o take aIl available �.
