' Mayar Tate declared the public heari.ng open. �

� Econcenic Develogr�ent Director Robert Vick reviewed the original request,
� presented to City Council on January 5, 1988, by Mr. Glen Fowler to operate a
� riverboat an Grapevine Lake, At that time, Council direc�ed Staff ta pursue
� an evaluation of sites suitable for the riverboat operation. On Februar.y 2,
� 2988, the evaluation was presented recr�enenc�ing tw� sites: (1} Silver Lake
Park off Ruth Wall and (2) Oak Grove Park at the north end of Dove Loop Road,
aft�r whieh the Cauncil tabled the proposal with directian to Staff to
identify and define the concerns of lake residents and users.

Mr. Vick presented a brief video hic�hiight of the Queen Maria as it currently �
operates on Bob Sandlin Lake and gave a slide presentation :relative ta the
prapc>sed site {Silver Lake Park} on Grapevine Lake. City Staff mPSnbers, Mr.
Bob Mur�ahy, Ms. Diane Williams and Mr. Michael Ayers, U.S. Army Corps of
Engineers Reservoir Manager, met ta revie�v possible loca�.ians ar�I proposal.s �
for the area. The follawing issues were addressed during the meeting:
lacation, parking lot, vehicular traffic, noise, site ar�l lake Iit�er, safety
and econc�nic impact. Mr. Ayers has agreed to support an agr�nt
transferring control of the site narth of Scott's Silver Lake Marina fio the
City for the loca�ion of the riverbc�at. Mr. Vick noted the parking lot tn�uld
be 112 X 300 feet and it is recalmended the $40,OOO.qp cost to construct the
parking lot be paid fr� Hote1lMotel Occupancy T� funds and the funds w�uld
be reimbursed by �he first $40,OOO.QO in lease fees collected by the City fram
Mr. Fowler. AIl fees collected after �he CVB's reimbursemerit wauld go into
the General k�ind. The presentation included c�nts tha� the proposed
location w�uld no�. create additional residential t.raffic, prapased and planned �
improvements to State Highways I14, 26 and 121 and Farm Road 2499 would �
improve access to the praposed. site; there w�uld be a noise clause in the
agreemen�.; the safety issue and adequa�.e Izability insurance coverage were
discussed; the econo�n.i.c i�npac� on the local econcany wa.s ou�lined and the
responsibility af the boat owner ta pravide all upkeep and maintenance �.a the �

� suggested terms and conditions of the lease including an escrow account, or �
� perforniance bond, in the ampunt of $40,000.00 be secured by the lessee in the �
� event of leasee's bankruptcy or default of the lease conditions. t

� Mayor Tate then invited guests present to address the Council regarding the i
� proposed riverboat. ;

� Ms. Clydene Johnson, President of the Grapevine Chamber of Coim�erce, stated
� the Board of Directors had met and expressed unanimous support for the
� proposed riverboat on Grapevine Lake.
� Mr. G. Richard Grant, 1846 Anglers Plaza, expressed appreciation for the
thorough presentation and requested consideration of the following items
� before the operation is allow�d an the lake: (1) rules and regulations for �
€ the operation of the large vessel, (2j Police and Fire DepartmP-nts plans for �
jsupport and safety, and (3) Corps of Engineers plan and responsibilities.

� The purpose of this letter is to endorse the implementation of a �
� riverboat on Lake Grapevine. We believe this added attraction would �
greatly increase roc�n revenue for the Hyatt Regency DFW. Thus, 4
� through roan tax revenues, add revenue to the City of Grapevine. �
t As you are aware, annually, the s�mer mpnths mzke or break the �
! entire year's financial perfornnance. The successful opening of Sea
� World in San Antonio has and will continue to negatively impact �
Grapevine tourist traffic. To counter attack, we strongly recannend '
that the City of Grapevine vote favorably and support the riverboat �
�
concept. This would be a giant step fozward to help us campete in �
the market place. Thank you. a

Mr. Totin stated the riverboat cx�uld be a positive way to bring revenue to the
� City and he briefly addressed ways the hotel would market the riverboat in
I convention and conceirge packages.
Ms. Dovie Pilney, 1366 Tipperary, questioned why the riverboat was not '
�� successful at Bab Sandlin Lake and what wr�uld happen when Grapevine Lake gets
� lav. Mr. Fawler responded the n�nk�r of people in the current area could not
support the riverboat and the riverboat only draws 19 inches of water.
Mr. Charlie McCall, 3249 Princess Street, Bedford, Comrodore of the Grapevine
Sailing Club, addressed the Council concerning safety on the lake. He noted a
large number of people utilize Grapevine Lake and the cross traffic in m�tor
boats and sail boats wc�uld present a safety factor. The Club as a whole would
be opposed to the riverboat, even if all safety factors were addressed, based
on the size of the lake.

Mrs. Diane Williams, 1830 Silverside Drive, briefly addressed the Council �
questioning whether Mr. Fawler could meet the performance bond and if CVB �
funds are available to construct the parking lot. Both questions wpxe
� answered positively. �`

Mr. Bob Murphy, 1869 Chris Craft Drive, stated the proposed site is an �
excellent choice and noted that safety is conditional at all times on the �
lake. �
Ms. Julie Fisher, 1642 Sonnet Drive, questioned the City's liability and what
would be the taxpayers cost. Also, wuuld alcoholic beverages be served aboard
� the riverboat when gassing through the Denton area. The riverboat w�uld be
treated as a floating restaurant and the proposed liability insurance coverage
� is five million dollars per occurrence and one million dollars per person per
� event. Assistant City Attorney Adrienne Leonard advised a high amount of
insurance coverage would be recam�ended, if alcoholic beverages are served on
the boat.
Mr. Don Bigbie, 4 Windy Knoll, requested the safety issue of sail boats and
riverboats be addressed. Mr. Alan Bernstein, President of the National
Association of Passenger Vessel Owners, addressed the Council regarding the
successful operation of riverboats on lakes and rivers in the United States.
He stated the Code of Federal Regulations, CRF33, w�uld provide guidelines and
' rules and regulations for operation of the riverboat but the riverboat is not
governed by the U. S. Coast Guard.

� Ms. Cathy Martin, 1034 Mockingbird Trail, questioned whether the Army Corps of
� Engineers wc�uld allaw the conditional use permit for alcoholic be�erages. 4
; City Manager Dennis E. Dawson stated alcoholic beverages are currently
; permitted on the Grapevine Golf Course.
� Ms. Joan Dale, 537 Dove Creek Circle, a m�nber of the Grapevine Sailing Club,
stated she supported the proposed riverboat issue and that the majority of the
members of the Grapevine Sailing Club are not citizens of Grapevine. During �
� the public hearing concerns were expressed on the following issues: safety of
the riverboat, annual licensing of the riverboat, �nergency disaster plans, �
� possible routes on the lake, hours of operation, fueling facilities.
' Council Member Glynn made a motion to close the public hearing. Council
Member Traverse offered a second to the motion, which prevailed by the
' following vote:

Absent: Niedermeier
` Council deliberation followed with Mayor Pro Tem Ted Ware requesting Staff to
i research the limits on the liability insurance coverage, as well as coverage
under the current City insurance policies. Council Member Wilbanks expressed
� opposition to the City building the proposed parking lot.
City Manager Dennis E. Dawson requested direction fran the Council to enter
into negotiations with the U. S. Army Corps of �gineers, Mr. Fawler and then
to develop a lease format to be brought back to the Council for full
consideration.
Council M�mber Glynn made a motion to authorize the City Manager to enter into
negotiations with the U. S. Army Corps of IIzgineers to obtain a lease fran
Silver Lake Park, north of Scott's Silver Lake Marina, for a potential site;
and also authorize tYie City Manager to enter into negotiations with Mr. Glen
Fawler to develop a riverboat attraction on Grapevine Lake in accordance to
the outline proposed. Once the package is together, bring it back to the
Council for consideration. Mayor Tate expressed support for the riverboat and
requested the issues mentioned be addressed as well as an alternate proposal
for the site be sukmitted in the event the riverboat is not successful. Mayor
Pro Tem Ware offered a second to the motion which prevailed by the following
vote:

Nays . Wilbanks
Absent: Niedernteier
