The additian contasns 0.91 acres and has , � ' approximately 110 feet of frontage along East Worth � � Hall-Johnson S�',�s ADP� � Street and 166 feet of frontage along Franklin Street. o a I L, � � I `".—_—.m o I Lr '�y � �' GIadB Rd. �, 1 ; 1@ c 0 � REQUESTED CONDITIONAL USE AND COMMENTS: The applicant is requesting a conditional use permit to amend the previously approved site plan of CU97-31 (Ord. 97-69)for a restaurant with the possession, storage, retail sale, and on-premise consumption of alcoholic beverages (beer, wine and mixed beveraqes) specificallv to allow outside dininq. At a July 1, 1997 public hearing, a zone change request and conditional use permit were considered on the subject property to expand the restaurant site to the south to provide more parking and to allow outside dining, specifically along the west side of the restaurant. The zone change request and the conditional use permit relative to the inclusion of the additional parking area were approved; however, the request to allow outside dining was denied. _ With this request the applicant proposes to allow outside dining at th�front of the property O•1ZCU1CU11-20.4 1 July 13,2011(4:38PM) �_ along East Worth Street and along the western property line. Total outdoor seating will � � accommodate 80 patrons. No outside speakers are associated with this request and the interior seating will remain unchanged at 211 seats. In an effort to provide adequate parking for the increased seating associated with the outside dining the applicant has also submitted a parking plan for consideration. A total of 97 parking spaces are required for the restaurant including both inside and outside dining (291 seats). On-site the applicant has provided 51 spaces. The applicant is asking consideration for the potential of 31 on- street parking spaces along both sides of East Worth Street befinreen Jenkins and Smith Streets. The owner of the subject restaurant, Mr. Steve Brown, has entered into a contract to purchase the multi-tenant commercial/office building (contingent upon the approval of this conditional use permit) at the northeast corner of Jenkins and East Worth Street that will allow for an additional 16 off-street parking spaces to be utilized by restaurant patrons during non-business hours. Lastly, Mr. Brown proposes to construct a pedestrian walkway along the east side of the multi-tenant building previously mentioned so that patrons of the restaurant can access the existing public parking lot that contains 70 off-street spaces. On-site spaces = 51 On-street spaces = 31 Multi-tenant spaces = 16 Public parking = 70 Total available = 168 Total required = 97 Along with the request to allow for the outside dining,the applicant proposes to construct a new drive at the southern end of the site to allow access to and from Franklin Street. PRESENT ZONING AND USE: The subject property is currently zoned "CBD" Central Business District and is developed as a restaurant. HISTORY OF TRACT AND SURROUNDING AREA: The subject property was rezoned from "C-2"Community Business District to Specific Use Permit for the possession, storage, retail sale, and on-premise consumption of alcoholic beverages incidental to the operation of a restaurant in accordance with the approved site plan (Ordinance 80-69). The subject property was rezoned from the Specific Use Permit in the 1984 City Rezoning to Central Business District. Conditional Use Permit CU89-20 (Ordinance 90-10) allowed for the sale, storage and on-premise consumption of alcoholic beverages (beer, wine and mixed drinks only). Zone Change Request Z97-14 and Conditional Use Request CU97-31 were considered at Council's July 1, 1997 meeting to allow for a .44 acre lot immediately to the rear of the subject site zoned "R-7.5" Single � Family District, to be utilized for parking for the existing restaurant and to allow for outside dining at the front (north) and along the west side of the restaurant. The zone change -- application was approved however, the conditional use application specifically relative to 0:1ZCU\CU11-20.4 2 July 11,2011(6:31PM) , the outside dining on the patio area to the west was denied. The Site Plan Review - Committee at their August 29, 2001 meeting approved a small modification to the existing � ___ ' site plan for the subject site(CU01-43)to accommodate upgrades to the kitchen area. The Site Plan Review Committee at their April 24, 2002 meeting approved a conditional use permit (CU02-06)which amended the exterior elevations to the existing restaurant on the subject site and the interior seating area but with no increase in seating. The Site Plan Review Committee at their December 17,2003 meeting approved a conditional use permit (CU03-49) that simply reconsidered the previous amendments associated with CU02-06 that had expired with no action taken. No other changes were proposed. The properties to the north, south and west were rezoned from "C-2" Community Business to "CBD" Central Business District during the 1984 City Rezoning and are developed as commercial uses. The properties to the east were rezoned from "R-1" Single Family District to "R-7.5" Single Family District and are developed as residential uses. SURROUNDING ZONING AND EXISTING LAND USE: NORTH: "CBD" Central Business District—commercial/office uses SOUTH: "CBD" Central Business District—Foust Funeral Home parking lot EAST: "R-7.5" Single Family District—residential property WEST: "CBD" Central Business District—restaurant (Lazy Bones) AIRPORT IMPACT: The subject tract is located within "Zone A" zone of minimal effect as defined on the "Aircraft Sound Exposure: Dallas/Fort Worth Regional Airport Environs" map. Few activities will be affected by aircraft sounds in Zone A, except for sound sensitive activities such as auditoriums, churches, schools, hospitals, and theaters. The applicant's proposal is an appropriate use in this noise zone. MASTER PLAN APPLICATION: The Master Plan designates the subject property as a Central Business District land use. Based on this information,we propose the following Site Parking options. Said proposed options would provide a positive and orderly solution for both the City of Grapevine and Esparza's Restaurant. II AREA"A"—ESPARZA'S RESTAURANT—124 E.WORTH STREET: The existing Seating/Parking Ratio has been described above under(Existing Site Date), and based on said scenario, we provide the following improvements to said site. 1. We propose that a new concrete drive approach be allowed to be constructed on the South Property onto Franklin Street. This improvement would accomplishes the followi.ng: • Provide needed access onto the restaurant properiy during the upcoming reconstruction/improvements to E. Worth Street,thus facilitating scheduled Public Works Scope of Work. • Would provide an alternative route for emergency response vehicles and greatly improve site access from two City Streets. • Contribute to creating a positive on site tr�c flow and onto City Streets. 2. The proposed new site driveway approach would not negatively impact the continuity of sense of community in the City or surrounding azeas. 3. This solution would improve the existing entry driveway off E. Worth Street and contribute to the ongoing enjoyment of the Ciiy of Grapevine Down Town District. Based on the positive information provided above,we request approval of said proposed new Franklin Street Driveway Approach. III AREA"B"—EAST WORTIi STREET: It is our understanding that in the neaz fuhue E. Worth Street is scheduled to be improved,by means of installing new service utilities,to include new concrete curb&gutter and complete regarding/paving improvements. Based on this opportunity,we propose the followi.ng option: 1. We propose that existing on street parking allowance be continued in an orderly manner. 2. Based on our Area"B"E. The parking space street mazkings illustrated on the overall site plan, are only used to indicate approximate locations for each potential space—and no way suggesting that said street be marked with parking spaces. 4. Also in an effort to salvage/save the existing large oak tree located in front of Esparza's Restaurant,we illustrated a possible curb planter island around said tree,which would not only contribute to prolonging the life expectancy of said tree,but also eliminate potential future damage to the new street curb from the tree roots. Based on the information provide above we request approval for the allowance of the 31 available public street pazking spaces to be counted and contribute towazds the additional needed parking by Esparza's Restaurant. IV AREA"C"—SINGLE STORY OFFICE BLDG.—115 E.WORTH STREET: Mr. Steve Brown, Owner of Esparza's Restaurant,has entered into a property purchase - � agreement for said property. This purchase agreement is contingent upon receiving City approval of this Conditional Use/Site Plan submittal request. The basic intent is to own said property and allow the Restaurant Customers,the use of the pazking area during non office business hours. Based on this information we propose the following options as illustrate on our site plan. 1. The overall existing site would be improved as follows: • Per discussion with City Public Works desire to have a more controlled access onto - the site, and our understanding,we propose that the City construct a new curb drive approach on E. Worth Street as illustrated, during the scheduled street improvement phase. • As part of said street re-construction, it is our understanding that new concrete side walks would also be installed as illustrated on site plan. • We also propose that a new drive approach on Jenkins, Street. • The above stipulated new driveway approaches on both streets would elimi.nate the existing continuous curb cuts and create an organized and positive traffic circulation flow on and off said streets. • Part of the site improvements,would be to construct a new concrete sidewalk along the East property line from E. Worth Street to the existing Public Parking Lot Area. • Tlus solution would provide public access from the Public Parking Lot to E. Worth Street and Esparza's Restaurant, in a safe and orderly manner. - 2. V AREA"D"—EXISTING PUBLIC PARHING LOT: Due to the close proximity of the existing public parking lot to Esparza's Restaurant,we propose that the existing parking spaces be counted towards the additional required parking. Based on this information we offer the following solution: 1. With the introduction of the proposed pedestrian side walk delineated in Area"C"— 115 E. Worth Street property,this effort would provide the necessary pedestrian walk path from Area"D"—Public Parking Lot to Area"A"—Esparza's Restaurant. 2. This Public Lot contains 70 parking spaces, for use by the general public in support of other existing Downtown Business, with Esparza's Restaurant being one major playero Based on this information,we request approval for the allowance of the 70 available parkuig spaces to be counted and contribute towards the additional needed parking by Esparza's Restaurant. VI PARHING CALCULATION SUMMARY: With the combination of the various available options,we believe that these proposed solutions would benefit not only Esparza's Restaurant,but also the city of Grapevine. The parking calculations described above,present an opportunity to not only meet said needs but exceed the required number and still provide 71 available general public parking spaces beyond the Esparza's Restaurant required needs. effect on the congestion of the streets, the fire hazards, panics and other dangers possibly present in the securing of safety from same, the effect on the promotion of health and the general welfare, effect on adequate light and air, the effect on the overcrowding of the land, the effect on the concentration of population, the effect on the transportation, water, sewerage, schools, parks and other public facilities; and WHEREAS, all of the requirements of Section 48 of Ordinance No. 82-73 have been satisfied by the submission of evidence at a public hearing; and WHEREAS, the City Council further considered among other things the character of the existing zoning district and its peculiar suitability for particular uses and with the view to conserve the value of buildings and encourage the most appropriate use of land �- throughout this City; and WHEREAS, the City Council of the City of Grapevine, Texas, does find that there is a public necessity for the granting of this conditional use permit, that the public demands it, that the public interest clearly requires the amendment, that the zoning changes do not unreasonably invade the rights of those who bought or improved property with reference to the classification which existed at the time their original investment was made; and WHEREAS, the City Council of the City of Grapevine, Texas, does find that the conditional use permit lessens the congestion in the streets, helps secure safety from fire, panic and other dangers, prevents the overcrowding of land, avoids undue concentration of population, facilitates the adequate provisions of transportation,water, sewerage, schools, parks and other public requirements; and WHEREAS, the City Council of the City of Grapevine, Texas, has determined that there is a necessity and need for this conditional use permit and has also found and determined that there has been a change in the conditions of the property surrounding and in close proximity to the property requested for a change since this property was originally classified and, therefore, feels that the issuance of this conditional use permit for the particular piece of property is needed, is called for, an is in the best interest of the public at large, the citizens of the City of Grapevine, Texas, and helps promote the general health, safety and welfare of this community. - ORD. That the zoning regulations and districts as herein established have been made in accordance with the comprehensive plan for the purpose of promoting health, safety, morals and the general welfare of the community. They have been designed with respect to both present conditions and the conditions reasonably anticipated to exist in the foreseeable future; to lessen congestion in the streets; to secure safely from fire, panic, flood and other dangers; provide adequate light and air; to prevent overcrowding of land, to avoid undue concentration of population; facilitate the adequate provisions of transportation, water, sewerage, drainage and surFace water, parks and other public requirements, and to make adequate provisions for the normal business, commercial needs and development of the community. That this ordinance shall be cumulative of all other ordinances of the City of Grapevine, Texas, affecting zoning and shall not repeal any of the provisions of said ordinances except in those instances where provisions of those ordinances which are in direct conflict with the provisions of this ordinance. , � Section 6. That the terms and provisions of this ordinance shall be deemed to be severable and that if the validity of the zoning affecting any portion of the tract or tracts of ORD.
