APPLICANT: William Tang
PROPERTY LOCATION AND SIZE:
The subject property is located at 4010 William D.
Tate Avenue #100. The addition contains 8.927
acres and is platted as Lot 1, Block 1, Tom Thumb
Addition No. 1. The property has approximately 400
feet of frontage along Hall- Johnson Road and
approximately 105 feet of frontage along the
southbound service road of State Highway 121.
REQUESTED SPECIAL USE AND COMMENTS:
The applicant is requesting a Special Use Permit to amend the previously approved site
plan of CU98 -44 (Ordinance 98 -114) for a planned commercial center, specifically to allow
for massage services.
The applicant intends to provide massages services (Reflexology) in a 1,400 square foot
lease space within a multi- tenant retail structure located in the Tom Thumb shopping
center on the southwest corner of the intersection of Hall- Johnson Road and William D.
Tate Avenue. Given the current mix of tenants within the building, 365 parking spaces are
required and 382 are provided. See the attached letter from the applicant describing the
services provided.
On February 18, 2014, Council approved Special Use Permit SU14 -01 (Ord. 2014 -10) for
massage services within a multi- tenant retail center located northwest of the subject site for

the same applicant. The applicant prefers the current proposed location and if approved
will not establish the service within the previously approved location. Please see the

The property is currently zoned "CC" Community Commercial District with a planned
commercial center designation. The site is developed with a Tom Thumb grocery store,
Wendy's Restaurant, Cotton Patch Restaurant, Catina Laredo Restaurant, Bank of The

Zoning Case Z83-29, approved in August 1983, rezoned the subject site from "R -1" Single
Family District to "R-MF-2" Multifamily Residential District (Ord. 83-47), however the site
never developed. In January 1986, Council approved Z86-01 (Ord. 86-09), rezoning a 16.3
acre portion of the site to "CC" Community Commercial District for a mixed use retail
concept that never developed. Zoning Case Z94-01 (Ordinance 94-17) revised the
stipulations set forth in Ordinance 86-09 by eliminating a 30 foot right-of-way dedication for
a proposed street that was to connect Heritage Avenue to the southbound service road of
William D. Tate Avenue/State Highway 121. Zoning Case Z97-18 (Ord. 97-134) and
CU97-47 (Ord. 97-135) were approved by Council on December 2, 1997, changing the
zoning of the entire site to "CC" Community Commercial District and approved a
conditional use permit for a Planned Commercial Center with the possession, storage,
retail sale, and off-premise consumption of alcoholic beverages (beer and wine only) in
conjunction with a grocery store. Conditional Use Permit CU98-23 (Ord. 98-75) was
approved at the June 16, 1998 meeting which modified the site plan for Tom Thumb by
realigning an internal drive and reallocating parking spaces to improve vehicle movement
within the center. At the same meeting Conditional Use Permit CU98-27 (Ord. 98-76) was
approved to allow for the development of a drive- thru restaurant (Wendy's) on Lot 2 of the
Tom Thumb Addition. Conditional Use Permit CU98-44 (Ord. 98-114) allowed the
reconfiguration of the signage on the existing lots of the planned commercial center.
Conditional Use Permit CU98-74 (Ord. 99-14) allowed for the on-premise consumption of
alcoholic beverages in conjunction with Cotton Patch restaurant. Conditional Use Permit
CU99-48 (Ord. 99-148) allowed for the development of a branch bank with drive-through
lanes. The Site Plan Review Committee at the May 29, 2002 meeting approved
Conditional Use Permit CU02-19 to allow for exterior elevation and floor plan revisions for

2002-61) allowed for the development of a retail nursery and garden supply. The Site Plan
Review Committee at the August 28, 2002 meeting approved revisions to Conditional Use
Permit CU02-30 to allow for an eight-foot wrought iron fence with masonry columns
adjacent to the outdoor storage areas of the nursery/garden center.
Property located north of the subject site was rezoned in the 1984 City Rezoning from "R-

(Ord. 01-06) approved at the January 16, 2001 meeting, allowed for the possession,
storage, retail sale and on-premise consumption of alcoholic beverages (beer, wine, and

Re: Letter in support of SUP application for BigfootReflexology
Bigfoot Reflexology will provide reflexology services to a wide variety of clientele. Reflexology
can be thought ofas foot and partial body massage, but reflexology is more specifically the
application of appropriate pressure to specific reflex points on the feet to stimulate the nervous
system to release tension and promote general health, Attached isamore detailed description
ofneflexo|ogy,
Bigfoot Reflexology will provide its reflexology services in a fully open environment, The
customer removes his or tier footwear, but otherwise remains fully clothed. Heor she sits ina
comfortable reclining chair while the therapist works on the feet and upper body, Couples or
friends can receive treatment at the same time in adjacent chairs from separate ref|exo!ogists,
much the same way as they might receive a pedicure or manicure, At the conclusion ofthe
therapy, the customer moves to a comfortable post-treatment area in another part of the room,
and when ready puts back on their footwear and exits.
8igfoot Reflexology will be staffed by experienced reMexo|ogists'and plans to be open for
treatments the following hours: 10-10 Daily
| am the owner and manager ofBi§footReflexology. While i only recently moved to the DFVV
area, I have successfully owned and operated a reflexology studio in my hometown of
Henderson, Nevada. That studio remains open. Through 8igfuotRef|exo!ogy' | look forward tu
providing beneficial and healthful reflexology services to the community.
The reason | have given up the space which was approved back in Feb at Hall Johnson rd is
because of the noise issue from Anytime fitness next door, Anytime fitness and my unit shares a
common wall and they play loud music to pomp up its members during peak hours. My business
must operate in a tranquil environment and the noise is obviously in conflict with my concept,
Originally |thought | could have thickened the wall tu reduce the noise, unfortunately it is not as
easy as| thought both technically and financially.

Reflexology
Reflexotogy is the application of appropriate pressure to specific points and areas,on the feet, hands, or
ears. Reflexcilogists believe that these areas and reflex points correspond to different body organs and
systems, and that pressing them has a beneficial effect on the organs and person's general health. For
example, reflexology holds that a specific spot in the arch of the foot corresponds to the bladder point.
When a reflexology practitioner uses thumbs or fingers to apply appropriate pressure to this area, it affects
bladder functioning.
Although reflexotogy is not used to diagnose or cure health disorders, millions of people around the world
use it to complement other treatments when addressing conditions like anxiety, asthma, cancer treatment,
diabetes, headaches, kidney function, PMS, stroke recovery and sinusitis.
Reflexology is growing increasingly popular across Europe and Asia as both a complement to other
treatments and as a preventive measure. One example is Denmark, where various municipalities and
companies have employed reflexcilogists since the early'90s.
Massage: Some people confuse reflexotogy with massage. While both massage and reflexology use touch,
the approaches are very different.
® Massage is the systematic manipulation of the soft tissues of the body, using specific techniques
(for example, tapping, kneading, stroking, and friction) to relax the muscles.
0 Reflexology focuses on reflex maps of points and areas of the body in the feet, hands, and ears
using unique micromovement techniques such as thumb or finger walking and hook and backup to
create a response throughout the body.
In short, massage therapists work "from the outside in," manipulating specific muscle groups or fascia to
release tension, Reflexology practitioners see themselves as working "from the inside out" -- stimulating
the nervous system to release tension.
Another difference between massage and reflexology is that a client will stay fully clothed for a reflexology
session except for removing footwear, whereas clients remove clothing for a massage session.
