Home My WebLink AboutORD 1999-033 :. - , ORDINANCE NO. 99-33 ,�:� AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF : GRAPEVINE, TEXAS, ABANDONING AND VACATING A = PORTION OF THE POOL ROAD RIGHT-OF-WAY IN THE -= CITY OF GRAPEVINE, TEXAS AS HEREINAFTER DESCRIBED; SAVE AND EXCEPT THE RETENTION OF -= SAID RIGHT-OF-WAY FOR A DRAINAGE AND UTILITY � EASEMENT; PROVIDING A SEVERABILITY CLAUSE; DECLARING AN EMERGENCY AND PROVIDING AN EFFECTIVE DATE WHEREAS, the owners of the tracts of land described in Volume 11608, Page 2095, and Volume 13126, Page 36, Deed Records of Tarrant County, Texas and the property owner of Lot 1, Block 1, Grapevine High School Addition as filed in Volume 388-197, Page 6, Cabinet A, Slide 1808, Plat Records of Tarrant County, Texas, the properties containing said right-of-way, more specifically described in Exhibit "A" attached hereto and incorporated herein for all purposes, have requested the said right-of-way, as herein after described, be abandoned and vacated; and �:�M WHEREAS, the said right-of-way is not needed for public use and will not be needed in the future for public use; and WHEREAS, abandoning and vacating the said right-of-way will relieve the City of Grapevine, Texas from the cost and expense of maintaining said property. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF GRAPEVINE, TEXAS: Section 1. That the said portion of right-of-way for Pool Road, described in Exhibit "A", attached hereto and incorparated h�r�ir #cr all purp�s�s, is hereby abandoned and vacated for public use and the same is hereby abandoned and vacated insofar as all public right, title, and interest in and to said described portion of said right-of-way is concerned save and except the retention of said right-of-way as a drainage and utility easement for public use. Section 2. This ordinance effectively abandons and vacates the referenced right-of-way releasing the City's rights to said right-of-way described in Exhibit "A" of this ordinance. �`" Section 3. The fact that the said right-of-way is no longer needed by the public for public usage or traveling and would create a hardship or burden upon the City of � Grapevine to keep open and maintain such right-of-way and such street creates an '.��y,,� urgency and an emergency for the immediate preservation of the public health, safety, and , general welfare which requires that this ordinance shall take effect immediately from and �:�� after its passage and it is accordingly so ordained. ' Section 4. That the terms and provisions of this ordinance shall be deemed to be severable, and that if the validity of any section, subsection, word, sentence or phrase shall be held to be invalid, it shall not affect the remaining part of this ordinance. :.. Gibson Survey, Abstract No. 591, : and the Harrison Decker Survey, Abstract No. 438, City of Grapevine, Tarrant County, �.�; Texas, being a portion of Pool Road fo�merly known as Doss-Knight Road as recorded in Tarrant County Commissioner's Easement Field Notes of Public Roads, Book 3, • Page 54 & 55, Tarrant County, Texas, and being a portion of a 15 foot wide right-of-way dedication by plat of Lot 1, Btock 1, Grapevine High School Addition, an addition to the City of Grapevine, Texas as recorded in Volume 388-197, Page 6 of the Plat Records of ,,.
