x� p AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF
GRAPEVINE, TEXAS AMENDING THE CODE OF
ORDINANCES BY AMENDING CHAPTER 25 UTILITIES
AND SERVICES RELATIVE TO WASTE WATER RATES
AND WATER RATES; PROVIDING A SEVERABILITY
CLAUSE; DECLARING AN EMERGENCY AND PROVIDING
AN EFFECTIVE DATE
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF GRAPEVINE,
TEXAS:
Section 1. That Chapter 25 Utilities and Services, Article II, Water and Sewers is
amended by amending Section 25-36 in its entirety relative to application and cost
deposit for water, waste water and refuse service as attached in Exhibit "A".
Section 2. If any section, article, paragraph, sentence, clause, phrase or word in
this ordinance, or application thereto any person or circumstance is held invalid or
unconstitutional by a Court of competent jurisdiction, such holding shall not affect the
" validity of the remaining portions of this ordinance; and the City Council hereby declares it
would have passed such remaining portions of the ordinance despite such invalidity,
� � which remaining portions shall remain in full force and effect.
Section 3. The fact that the present ordinances and regulations of the City of
Grapevine, Texas, are inadequate to properly safeguard the health, safety, morals,
peace, and general welfare of the public creates an emergency which requires that this
ordinance become effective from and after the date of its passage, and it is accordingly
so ordained.
Section 4. That this ordinance shall become effective on May 1, 1998.

EXHIBIT A
AMENDMENT TO SECTION 25-36 OF THE CODE
Application and cost deposit for water, waste water and refuse service.
(a) Any person desiring to obtain water and/or waste water and/or refuse collection
service shall make application to the utility billing department for said service(s).
Applications may be made in person, by mail or by facsimile (fax) machine. All
applications require a copy of applicant's valid driver's license and the applicant's
social security card number.
(b) Applicants will be approved for service upon payment of a cash deposit or cash
bond, or authorization for the City to bill the deposit on the first month's bill for
service, in accordance with the deposit required by the deposit table listed in
Section 25-36 (d) below. At the applicant's request, the City may authorize the
initial deposit for services to be included on the first month's bill for service. Should
the first month's bill for service not be paid, including the service deposit, in
accordance with the provisions of Section 25-37 of this code, service will be
a terminated and not reconnected until all fees are paid.
;�*^� The City reserves the right to reject an application to include the deposit on the first
month's bill if the customer has at any time in the finro year period prior to the date of
application had a cut-off for late or non-payment of any City of Grapevine utility
charge, or if any monies are due to the City in that applicant's name.
(c) Real estate brokers, licensed to conduct business in the State of Texas and
landlords owning multiple properties, may at their discretion apply for a master
deposit account and put up a master deposit in accordance with the requirements of
the deposit table listed below. Such deposit will be used as security for multiple
accounts listed in the broker's or landlord's name. Applicants must provide evidence
of having a bonafide real estate listing contract or ownership of each property
address to be secured by the master deposit. Brokers may secure accounts due to
a listing agreement only if the account has previously been closed out by the
owner/tenant. The master account holder is responsible for payment of all service
provided during the period that the account holder's name is on the account.
Brokers and landlords may not use the master deposit to secure accounts for
permanent tenants. Permanent tenants must put up a deposit in accordance with
the other provisions of this code.
