HomeMy WebLinkAboutORD 1995-086 � . �,.:.� ORDINANCE NO. 95-86 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF GRAPEVINE, TEXAS ABANDONING AND VACATING WEST TEXAS STREET PUBLIC ROAD RIGHT-OF-WAY LOCATED BETWEEN SOUTH MAIN STREET AND BARTON STREET, BARTON STREET PUBLIC ROAD RIGHT-OF-WAY LOCATED BETWEEN WEST WALL STREET AND WEST TEXAS STREET, AND A PUBLIC ALLEY RIGHT-OF-WAY LOCATED BETWEEN WEST WALL STREET AND WEST TEXAS STF{F�Ti pRr1�,i�n�ni� n cE�JFR.!:�lL!TY C�AUSE; DECLARING AN EMERGENCY AND PROVIDING AN EFFECTIVE DATE WHEREAS, the public street right-of-way of West Texas Street between South Main Street and Barton Street and a portion of the public street right-of-way of Barton Street between West Wall Street and West Texas Street, and the public alley right-of- way located adjacent to the east side of Barton Street between West Wall Street and West Texas Street, are no longer needed for public vehicular use and will not be needed in the future for public vehicular use; and WHEREAS, abandoning and vacating these rights-of-way will relieve the City �""' of Grapevine, Texas from the cost and expense of maintaining said street and alley rights-of-way. ! NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF GRAPEVINE, TEXAS: Section 1 . Section 2. Within an area owned by the City in fee title, the public street right- of-way of West Texas Street between South Main Street and Barton Street, as described by metes and bounds in Exhibit A, attached hereto and made a part hereof, ' is hereby abandoned and vacated for public vehicular use and the same is hereby abandoned and vacated insofar as all public right to title and interest in and to said �° right-of-way is concerned, subject to the retention by the City of the area described in Exhibit A as a public pedestrian access and utility easement. Section 3. Within an area owned by the City in fee title, the east fifteen (15') feet of the public street right-of-way of Barton Street between West Wall Street and West Texas Street, as described by metes and bounds in Exhibit B, attached hereto � � _ a ._, �, i � .r,� i .,� _, � � � i� and made a part hereof, is hereby abandoned and vacated for public street right-of- way purposes. The City as the owner of fee title retains all such interest. �, Section 4. Within an area owned by the City in fee title, the public alley right- of-way adjacent to the east side of Barton Street between West Wall Street and West Texas Street, as described by metes and bounds in Exhibit C, attached hereto and made a part hereof, is hereby abandoned and vacated for public street right-of-way purposes. The City as the owner of fee title retains all such interest. Section 5. That the terms and provisions of this ordinance shall be deemed to be severable, and that if the validity of any section, subsection, word, sentence or phrase shall be held to be invalid, it shall not affect the remaining part of this ordinarcz. Section 6. The fact that the present ordinances and regulations of the City of Grapevine, Texas are inadequate to properly safeguard the public health, safety, morals, peace and general welfare of the public creates an emergency which requires that this ordinance become effective from and after the date of its passage, and it is accordingly ordained.
