Chairman Oliver announced the Planning and Zoning Commission would conduct a work session relative to the following cases: CU13 -01 RIVERWOODS MEMORY CARE AND BEAR CREEK LODGE ASSISTED LIVING CU13 -02 FARINA'S WINERY to discuss development issues. Consider the minutes of the February 19, 2013 Planning & Zoning Commission meetings and take any necessary action. Brown V % Cit ecretary . . � P & Z JOINT PUBLIC HEARING MARCH 19, 2013 STATE OF TEXAS COUNTY OF TARRANT CITY OF GRAPEVINE The Planning and Zoning Commission of the City of Grapevine, Texas met in Joint Public Hearing with the City Council, on this the 19th day of March 2013, in the City Council Chambers, 200 South Main Street, 2nd Floor, Grapevine, Texas with the following members present -to -wit: Larry Oliver Herb Fry B J Wilson Monica Hotelling Jimmy Fechter Gary Martin Beth Tiggelaar Dennis Luers Chairman Vice - Chairman Member Member Member Member Member Alternate constituting a quorum with Elaine Martin absent and the following City Staff: Ron Stombaugh John Robertson Albert Triplett Susan Batte CALL TO ORDER Planning and Development Manager Manager of Engineering Planner II Planning Technician Mayor Tate called the joint meeting to order at 7:33 p.m. and Chairman Oliver called the Planning and Zoning Commission deliberation session to order at 7:56 p.m. INVOCATION AND PLEDGE OF ALLEGIANCE Commissioner Jimmy Fechter delivered the Invocation and led the Pledge of Allegiance. JOINT PUBLIC HEARINGS CONDITIONAL USE APPLICATION CU13 -01 - RIVERWOODS MEMORY CARE AND BEAR CREEK LODGE ASSISTED LIVING First for the Commission to consider and make recommendation to City Council was conditional use application CU13 -01 submitted by Rosco Construction for property located at 3721 & 3729 Ira E Woods Avenue and platted as Lots 1 & 2, Block 1, Riverwoods. The applicant was requesting a conditional use permit to amend the previously approved site plan of CU08 -30 (Ord. 08 -68) for a planned office center, 031913 1 P & Z JOINT PUBLIC HEARING MARCH 19, 2013 specifically to allow the development of a 19,304 square foot, 60 bed memory care center and a 40,250 square foot 48 bed assisted living facility. The applicant requested to table this request to the April 16, 2013 public hearing to make some changes to the site plan. With no further questions, guests to speak, nor letters or petitions, the public hearing was tabled to April 16, 2013. CONDITIONAL USE APPLICATION CU13 -02 - FARINA'S WINERY Next for the Commission to consider and make recommendation to City Council was conditional use application CU13 -02 submitted by Gary Farina for property located at 418 & 420 South Main Street and platted as Lots 11 & 12, Block 3, Original Town of Grapevine. The applicant is requesting a conditional use permit to amend the previously approved site plan of CU11 -04 (Ord. 11 -14) specifically, to allow the possession, retail sales, storage and on- premise consumption of alcoholic beverages (beer, wine and mixed beverages) in conjunction with a restaurant. The applicant proposed to change the use on the subject site from a wine tasting room to a restaurant with outside dining and alcoholic beverage sales (beer, wine and mixed beverages) for on- premise consumption only. Mr. Gary Farina, the applicant, was available to answer questions requested favorable consideration. Discussion was held regarding changing the business from a winery to a restaurant. Mr. Farina stated he wanted to be able to serve wine and beer to compete with other restaurants on Main Street. The hours of operation for the restaurant would not change. The following persons spoke regarding the application: John Mayfield - support Carl Young - opposed, due to parking concerns in the downtown area. With no further questions, guests to speak, one letter of support, the public hearing was closed. In the Commission's deliberation session, discussion about using the public parking lot for the majority of their parking requirements. B J Wilson moved to approve conditional use application CU13 -02 with the condition that the restaurant serves beer and wine only and the restaurant will close at 10:00 pm Sunday thru Thursday and 11:00 pm Friday and Saturday. Jimmy Fechter seconded the motion, which prevailed by the following vote: Ayes: Oliver, Fry, Wilson, Hotelling, Fechter, G. Martin and Tiggelaar Nays: None 031913 2 P & Z JOINT PUBLIC HEARING MARCH 19, 2013 END OF PUBLIC HEARING FINAL PLAT APPLICATION - LOT 3B, BLOCK 31, THE ORIGINAL TOWN OF GRAPEVINE Next for the Commission to consider and make recommendation to the City Council was the Statement of Findings and Final Plat Application of Lot 3B, Block 31, The Original Town of Grapevine on property located at 510 Smith Street. The applicant was final platting 0.2794 acres to plat a tract parceled out of a larger tract. In the Commission's deliberation session B J Wilson moved to approve the Statement of Findings and Final Plat Application of Lot 3B, Block 31, The Original Town of Grapevine. B J Wilson seconded the motion, which prevailed by the following vote: Ayes: Fry, Wilson, Hotelling, Fechter, G. Martin and Tiggelaar Nays: None CONSIDERATION OF MINUTES Next for the Commission to consider were the minutes of the February 19, 2013 Planning and Zoning joint public hearing. Herb Fry moved to approve the Planning and Zoning Commission minutes of February 19, 2013. Beth Tiggelaar seconded the motion, which prevailed by the following vote: Ayes: Fry, Wilson, Hotelling, G. Martin and Tiggelaar Nays: None Abstain: Oliver and Fechter ADJOURNMENT With no further business to discuss, Jimmy Fechter moved to adjourn the meeting at 8:03 p.m. Monica Hotelling seconded the motion which prevailed by the following vote: Ayes: Oliver, Fry, Wilson, Hotelling, Fechter, G.
