HomeMy WebLinkAboutORD 1995-070 „�. _ ORDINANCE NO. 95-70 , AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF GRAPEVINE, TEXAS AMENDING THE GRAPEVINE CODE OF ORDINANCES, CHAPTER 7 BUILDINGS AND CONSTRUCTION, SECTION 7-3 BUILDING CODE AMENDMENTS, BY REPEALING TABLE N0. 5-B REQUIRED SEPARATION IN BUILDINGS OF MIXED OCCUPANCY; PROVIDING A SEVERABILITY CLAUSE; PROVIDING A PENALTY OF FINE NOT TO EXCEED THE SUM OF FIVE HUNDRED DOLLARS (5500.00) FOR EACH OFFENSE; DECLARING AN EMERGENCY AND PROVIDING AN EFFECTIVE DATE WHEREAS, the City of Grapevine has adopted , for the purposes of establishing rules and regulations for the construction, alteration, removal, demolition, equipment, use and occupancy, location and maintenance of buildings and structures, that certain building code, known as the Uniform Building Code, 1991 Edition, by Ordinance No. 92-17, adopted April 17, 1992; and WHEREAS, Chapter 7 Buildings and Construction, Section 7-3 of the Grapevine Code of Ordinances creates certain amendments to the Uniform Building code, 1991 Edition; and WHEREAS, the City of Grapevine is desirous of repealing certain portions of Section 7-3 to allow the enforcement of Table 5-B as written in the Uniform Building Code, 1991 Edition. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF GRAPEVINE, TEXAS: Section 1 . That all of the above premises are found to be true and correct and are incorporated into the body of this ordinance as if copied in their entirety. Section 2. That Chapter 7, Article I, Section 7-3, Table No. 5-B be and the same is hereby repealed. Section 3. That if any section, article, paragraph, sentence, clause, phrase or word in this ordinance, or application thereto any person or circumstance is held invalid or unconstitutional by a Court of competent jurisdiction, such holding shall not affect the validity of the remaining portions of this ordinance; and the City Council 4�_:� hereby declares it would have passed such remaining portions of the ordinance despite such invalidity, which remaining portions shall remain in full force and effect. Section 4. Any person violating any of the provisions of this ordinance shall be deemed guilty of a misdemeanor and upon conviction thereof shall be fined in a sum not to exceed Five Hundred Dollars (5500.00) and a separate offense shall be deemed committed upon each day during or on which a violation occurs or continues. Section 5. The fact that the present ordinances and regulations of the City of Grapevine, Texas are inadequate to properly safeguard the health, safety, morals, peace and general welfare of the inhabitants of the City of Grapevine, Texas, creates an emergency for the immediate preservation of the public business, property, health, safety and general welfare of the public which requires that this ordinance shall become effective from and after the date of its passage, and it is accordingly so ordained.
