Home My WebLink AboutORD 1995-047 Duplicate for Correction ORDINANCE NO. 95-47 AN ORDINANCE OF THE CITY OF GRAPEVINE, TEXAS RESCINDING AND CORRECTING ORDINANCE NO. 95-47 AS ADOPTED JUNE 20, 1995; CORRECTING AND AMENDING ORDINANCE NO. 95-47 TO REPLACE AND RESCIND SAID PREVIOUSLY APPROVED ORDINANCE AMENDING ORDINANCE NO . 82-73, THE COMPREHENSIVE ZONING ORDINANCE OF THE CITY OF GRAPEVINE, TEXAS, SAME BEING ALSO KNOWN AS APPENDIX "D" OF THE CODE OF ORDINANCES OF THE CITY OF GRAPEVINE, TEXAS, BY PROVIDING FOR AMENDMENTS, CHANGES AND CORRECTIONS OF TYPOGRAPHICAL ERRORS TO ZONING REGULATIONS BY AMENDING SECTION 26 "HC" HIGHWAY COMMERCIAL DISTRICT REGULATIONS RELATIVE TO AUTOMOTIVE RENTAL, BOAT AND MARINE SALES AND/OR SERVICE AND CAMPER AND CAMPER TRAILER SALES; AND SECTION 28, "CBD" CENTRAL BUSINESS DISTRICT RELATIVE TO AUTOMOTIVE SERVICE; PROVIDING A PENALTY OF FINE NOT TO EXCEED THE SUM OF TWO THOUSAND DOLLARS (52,000.00) FOR EACH OFFENSE AND A SEPARATE OFFENSE SHALL BE DEEMED COMMITTED EACH DAY DURING OR ON WHICH AN OFFENSE OCCURS OR CONTINUES; PROVIDING A SEVERABILITY CLAUSE AND PROVIDING AN EFFECTIVE DATE BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF GRAPEVINE, TEXAS: Section 1 . That Ordinance No. 95-47 as adopted on June 20, 1995 by the Grapevine City Council amending Ordinance No. 82-73, as amended, the Comprehensive Zoning Ordinance of the City of Grapevine, Texas same being known as Appendix "D" of the Code of Ordinances of the City of Grapevine, Texas is hereby rescinded and corrected by replacing and rescinding previously approved ordinance adopted on June 20, 1995 and by approval of Ordinance No. 95-47 as corrected and amended, to replace and rescind said previously approved ordinance. Section 2. That Ordinance No. 82-73, the Comprehensive Zoning Ordinance of the City of Grapevine, Texas same being also known as Appendix "D" of the Code of Ordinances of the City of Grapevine, Texas is hereby amended in the following particulars, and all other sections, subsections, paragraphs, definitions, words and &�:.� phrases of said Appendix "D" are not amended but are hereby ratified, verified and affirmed: Duplicate for Correction A. That Section 26, HC Highway Commercial District, is hereby amended by deleting Subsection 26.A.21 Automotive Rental; by renumbering the remainder of the subsection beginning with Subsection 26.A.7 Reserved; and by amending 26.A.1 1 and 26.A.12 and 26.A.20 to read as follows: "1 1 . Boat and marine sales and/or service within a completely enclosed building. 12. Camper sales and camper trailer sales and service, lease and rental within a completely enclosed building. 20. Pawn shops." B. That Section 26, HC Highway Commercial District, is hereby amended by the addition of Sections 26.C.16, 26.C.17, and 26.C.18 to read as follows: "16. Automotive rental. 17. Outside display boat and marine sales and/or service. 18. Outside display camper sales and camper trailer sales and service, lease and rental." C. That Section 28, CBD Central Business District is hereby amended by the deletion of Section 28.A.7. and renumbering the remainder of the Section. Section 2. Any person violating any of the provisions of this ordinance shall be deemed guilty of a misdemeanor and upon conviction thereof shall be fined in an sum not to exceed Two Thousand Dollars (52,000.00) for each offense and a separate offense shall be deemed committed each day during or on which an offense occurs or continues. Section 3. If any section, article, paragraph, sentence, clause, phrase or word in this ordinance, or application thereto any person or circumstances is held invalid or unconstitutional by a Court of competent jurisdiction, such holding shall not affect the validity of the remaining portions of this ordinance; and the City Council hereby declares it would have passed such remaining portions of the ordinance despite such invalidity, which remaining portions shall remain in full force and effect. Section 4. This ordinance shall become effective from and after the date of its passage, and it is accordingly so ordained. �... :t. ORD.
