ORDINANCE NO. 95-07
�, AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF
GRAPEVINE, TEXAS AMENDING ORDINANCE 90-35
WHICH ADOPTED THE 1990 COMPREHENSIVE PARKS &
RECREATION MASTER PLAN UPDATE, BY AMENDING
SECTIONS 1 AND 2 TO INCLUDE THE 1995 PARKS,
RECREATION, AND OPEN SPACE MASTER PLAN;
PROVIDING A SEVERABILITY CLAUSE; DECLARING AN
EMERGENCY AND PROVIDING AN EFFECTIVE DATE
WHEREAS, the City Council adopted the Comprehensive Parks and Recreation
Master Plan on April 20, 1982 upon the passage of Ordinance No. 82-17; and
WHEREAS, the City Council amended Ordinance No. 82-17 by the adoption of
Ordinance No. 90-35 on July 3, 1990, to incorporate the 1990 Comprehensive Parks
and Recreation Master Plan Update; and
WHEREAS, the City Council desires to amend Ordinance No. 90-35 to adopt
the 1995 Parks, Recreation, and Open Space Master Plan; and
WHEREAS, the 1995 Parks, Recreation, and Open Space Master Plan is in the
� � best interest of the public and in support of the health, safety, morals and general
welfare of the City.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
GRAPEVINE, TEXAS:
Section 1 . That all the above premises are found to be true and correct and are
incorporated into the body of this ordinance as if copied in their entirety.
Section 2. That Section 1 of Ordinance No. 90-35 is hereby amended to read
as follows:
"That the January 1995 Parks, Recreation, and Open Space Master Plan
prepared by Carter & Burgess, Inc. (Consultants in Engineering,
Architecture, Planning, and the Environment►, hereinafter called the
"Approved Plan", which is on file in the office of the City Secretary, is
,� hereby approved and adopted."
Section 3. That Section 2 of Ordinance No. 90-35 is hereby amended to read
� as follows:
"That the Approved Plan shall be filed for record in the official City
records and the Approved Plan shall be available to the public and to all
landowners and used as an officially approved Parks, Recreation, and
;,�,, Open Space Master Plan by the City Administration, City Parks and
Recreation Advisory Board, and City Council".
Section 4. If any section, article, paragraph, sentence, clause, phrase or word
in this ordinance, or application thereto any person or circumstance is held invalid or
unconstitutional by a Court of competent jurisdiction, such holding shall not affect the
validity of the remaining portions of this ordinance; and the City Council hereby
declares it would have passed such remaining portions of the ordinance despite such
invalidity, which remaining portions shall remain in full force and effect.
Section 5. The fact that the present ordinances and regulations of the City of
Grapevine, Texas, are inadequate to properly safeguard the health, safety, morals,
peace, and general welfare of the public creates an emergency which requires that
this ordinance become effective from and after the date of its passage, and it is
accordingly so ordained.
