Approval of the consent agenda authorizes the City Manager, or his designee, to implement each item in accordance with Staff recommendations. A. Consideration of an Ordinance amending Chapter 18 of � the City Code by providing for an Employee Assistance Program and allowing the City Manager to adopt reasonable personnel rules and regulations for implementing the program. City Staff recommends approval. B. Consider award of the bid to the lowest bid meeting specifications to Goldthwaite' s of Texas, Inc. in the amount of $6, 100. 00 less trade-in allowance of $500. 00 for a GX 800 utility vehicle for a final amount of $5, 600. 00 for the purchase of a utility vehicle. � Director of Golf and Purchasing Agent recommend , approval. C. Consider award of the bid to the lowest and best bid meeting all specifications to Watson Distributing Company in the amount of $5, 988. 00 less trade-in allowance of $350 . 00 for a five year old Smithco rake for a final amount of $5, 638 . 00 for the purchase of a trap rake. Director of Golf and Purchasing Agent recommend approval. D. Consider approval of the priority list for street reconstruction by County forces : 1 . Hughes Road, between Country Lane and S.H. 121 ($26, 667. 00) ; 2. Cheek-Sparger Road, between the Colleyville city limits and Hall-Johnson Road ($18, 843 . 00) ; and the striping and lining ($800. 00) of the following streets : a. Consider an ordinance amending the Code of Ordinances, Appendix B, Subdivisions, Section 2 (B) (14) to exempt one lot single-family subdivisions from the require- ment of peripheral street fees and require only the cost of curb, gutter, sidewalk and driveway aprons be assessed as a fee for issuance of a building permit. Director of Public Works recommends approval. F. Consider an ordinance amending the Code of Ordinances, Appendix E, Article I, Item 2. 3 relative to Horizontal Curve Limitations to correspond with recommended � design speeds for street classifications and Item 2. 11 � relative to Street Grades to allow for a reduction in the design speeds for Type A through D thoroughfares. Director of Public Works recommends approval. G. Consideration of the minutes for the October 20 and November 3 , 1987 meetings . City Secretary recommends approval as published. VIII . NEW BUSINESS A. City Council to discuss procedures and guidelines regarding assessing roadway improvements to property owners abutting William D. Tate Avenue and take any necessary action. B. City Council to discuss appointments to the Capital Improvements Program Advisory Committee and take any necessary action. C. City Council to consider an ordinance amending Chapter 14 of the Code of Ordinances relating to Occupational Licenses, Taxes and Regulations and repeal those provisions of Chapter 15 relatinq to Offenses and Miscellaneous Provisions. BILL YSVAPP Mr. Bill Knapp, 521 Post Oak, representing his neighbarhood addressed the Ci�,y Council and the Planning & Zoning Cccc�n.issian relative ta concerns abaut the deve].o�nt of Glade Crossing 4. Issues mentianed were drainage, possible tree r�val, restric�ions on the development, and had there been a study to � determine the need for additional hausing in the area. PUBLIC HEARING, ZQNING APPLICATION Z$7-20, CITY OF C�PEVINE ; The first order of busine$s was for the City Council and Planning & Zoning Cc�mission to conduct a public hearing relative to Zaning Application Z87-20 � su�rn.itted by the City of Grapevine. �; � The public hearing was declared open by Mayor Paw�rs. ; z � � � � 11/17/87 � Director of Community Developnent H. T. Hardy advised the subject 12.15 acre tract was located east of the Grapevine Library and south of Nash Street. The requested rezoning is frcm "PO" Professional Office Zoning District to "GiJ" Governmental Use Zoning District. He noted this was a Staff initiated rezoning to be consistent with the zoning immediately to the west. There were no questions or comments fran the City Council or the Planning & Zoning Conmission. Mayor Pow�ers inquired if there were any guests present who wished to c�nment either for or against the requested rezoning. There were none, and there was no correspondence to report. A motion to close the public hearing was then offered by Corrmission Member Atchley and seconded by Ccar�ission Member Engholm. The motion prevailed by the ensuing vote: Ayes . T. Hardy, Director of Ccinmunity Development, then reviewed the proposed ;� am�enc�nents to Section 12 that would clarify the definition of an autanotive � repair garage. Section 25 proposed amendments to the permitted use section � would delete autcgnotive repair garages as a principal use and include it as a conditional use. Section 26 proposed amendments would delete autanotive body shops and autcmotive repair shops as a permitted use and insert them as a conditional use. ; There were no questions or com�ents fro�n the City Council or the Planning & ` � Zoning Cc�ussion. f Mayor Pow�ers then invited those present to speak relative to the proposed £ amenc�nents. � Mr. Fred Tomlin, owner of Prestige Auto Body, 120 North Dooley, noted the F differences in automotive repair shops and bod.y shops. He su�mitted pictures E of the current business location of B & B Auto Body. He stated auto body � repair shops can be "eye sores" and hazardous waste materials must be stored � �- �: within the shops. F � �: Mr. Etiigene LhaBose, representing Mr. Bob Lindley (cx�mer of B & B Auto Body) , ` addressed the City Council and the Planning & Zoning Ccarmission regarding the � background of the zoning change request sulsnitted in October, 1987, by Mr. s Lindley relative to 515 East Northw�est Highway. (The case was denied.) He ` spoke in favor of the proposed amendments to the zoning ordinance noting the ; changes v�uld eliminate sane autan�atic uses and allaw conditional uses. # � Ms. Darlene White, one of the awners of Auto �cpress Tire & Service Center � located at 846 East Northwest Highway, spoke regarding ccxnpliance with the � City Code and restrictions when they w�ere constructing their business one year � € � [ � � } (2) � 4 } � ; I i 11/17/87 ago. She stated that auto service centers and auto body repair shops are two entirely different types of business. Mayor Powers opened the public hearing. Director of C�ity Develognent H. T. Hardy reported the request for a k conditional use permit for a body shop canpletely within an enclosed building located at 515 East Northwest Highway. The subject 15,000 square foot tract is currently zoned "CC" Ccetmunity Commercial. The site plan su�mitted � � indicates an existing develognent with a one story, 4,395 square foot building providing 27 parking spaces with no outside screened area indicated. ; Mr. Bob Lindley, awner, briefly addressed the City Council and the Planning & Zoning Ccnmission concerning additional landscaping in the front of the bLtilding and removal of two parking spaces. ; Questions and c�nts fran the Council and Planning & Zoning Cce�unission included dumpster placemPalt, screening, number of parking spaces, and storage location of cars waiting to be repaired. Lengthy discussion ensued regarding the placemPalt of wrecked vehicles inside the building, nwnber of vehicles the :: building would accc�modate, turn around time on repair jobs, and approx�mate ` nLUnber of cars bei.ng repaired at any given time. Mayor Powers then invited those present to speak relative to the proposed conditional use request. Mr. Arthur White, a�mer of the builcling where Mr. Bob Lindley currently operates a busi.ness, addressed the Council. Ms. Darlene White, 846 Ea.st Northw�est Highway, inquired about the rnunber of variances requested by Mr. Lindley. Mr. Fred '1'cmlin, 120 North Dooley, expressed concern that Mr. Lindley would co�nply with City ordinances at a new business location. Council MemL�er Spencer requested the Planning & Zoning Coarm.ission to work on a definition for damaged vehicles with the City Attorney's office as soon as possible. Coamtissioner Meyer made a motion to close their portion of the public hearing. The City Council w�uld take a brief recess. Upon reconvening momentarily in the Council Chamt�ers, all member of the City Council were present. CITIZENS REQUEST, DR. TERRY V+1AL�R ; € Dr. Terry Walker, 3830 W. T. Parr Road, addressed the City Council concerning ; zoning ordinances and management of old business items. He noted that sane time ago, an ordinance was adopted that tended to neutralize an individual, or � developer, who repeatedly pursued a particular case. He stated it to be difficult to agree with Council to continue to leave items (Zoning Application Z87-02, su�mitted by Henry S. Miller) under Old Business. One more delay on this particular zoning case and the City would once again be faced with the issue of politics and elections intervening. He expressed concern that this particular zoning case (Z87-02/Miller) is being treated in a manner that the ; ordinance originally was created to shield citizens against. He inquired as to why the council was not follo�ving their awn rules. City Attorney John Boyle, responded that the Council had not taken any formal � action regarding the Henry S. Miller Zoning Application Z87-02. He noted the ability to refile a case, as discussed by Dr. Walker, is one year fran the time that Council takes formal action to approve or disapprove the zoning � request. ZONING APPLICATION Z87-02, I�TRY S. NiIr,T,�.0 � The next order of business was for the City Council and the Planning & Zoning Coa�mission to consider an ordinance relative to Zoning Application Z87-02 sukmitted by Henry S. Miller. Approximately 19+ acres located north east of '_ S.H. 114, north of Wall Street and south of Northwest Highway, requesting � rezoning frc�n "PO" Professional Office Zoning District to "CC" Ccannunity Comt�rcial Zoning District. � Mr. Barry Knight, representing the Henry S. Nliller Co., Develognent Group, f requested consideration frcm the Council to continue to table the zoning case � until the January 19, 1988 meeting. The case was tabled from the August 18, } 1987 City Council meeting to allaw the developer additional time for negotiation with the Living Word Lutheran Church concerning alternative �: solutions for develoFanent of the site. The extensive negotiation sessions � between his client and the church were mentioned, and he noted the church has ccampleted its master plan that w�uld allow for the expansion of its facilities at its present location while allowing for the develognent of the reta.il � center. Mr. Kurt Wandrey, Chairman of the Building Steering C�Hnittee for the Living � Word Lutheran Church, gave the background of the negotiations frcan the � Church's point of view. He stated a detailed analysis had been completed by > the Church to determi.ne the feasibility of offering any portion of property � for sale and yet be able to meet the building needs of the Church. The review �' � and approval process of the Church is also a public process requiring ; cce�mittee meeting as well as congregational meetings. He stated negotiations � should be ccanpleted by the January 19, 1988 meeting. � After brief Council discussion, Council Me.mber Glynn made a motion to table � Zoning Application Z87-02 su}�nitted by Henry S.
