TATE AVENLTE � � Mayor Pow�ers declared the public hearing open. � Director of Public Works Jerry Hodge gave a brief introduction regarding the � proposed street improvement assessments to William D. Tate Avenue, stating - that citizens should not carry the full burden of capital improvements. Ft Senate Bill 336 established the criteria to be followed when charging impact ` � fees. An impact fee is a way for cities to finance capital improvements f through developer participation. Major street, drainage and widening '. projects, such as the William D. Tate Avenue project, afford an opportunity � for cities to spread the costs of a project to abutting properties that � receive any enhancement benefits fram the project. The William D. Tate Avenue � project is surrounded totally by c�rcial property and all the surrounding � properties will receive some special enhancement. Under the City's current ; ordinances, if there are no assessments made for the William D. Tate Avenue � project, and the improvements are carried through as intended, there will not � be any money collected for periphery street fees upon ccgnpletion of the g construction project. � � Mayor Powers requested all persons that would be giving test�mony during the ; public hearing to stand and take the oath of truth. ' S Manager of �gineering Stan Laster then addressed the Council, identifing the � 19 parcels abutting the proposed improvements to William D. Tate Avenue, and � gave a slide presentation regarding each parcel. � He then reviewed the current status of William D. Tate Avenue and advised the � proposed improvements would extend frcgn S.H. 114 to the north, almost to � Dallas Road. This would include 2,489 linear feet of improvements; a � five-lane section 66 feet in width, with curb, gutter, sidewalk and storm 4 drainage for a length of 1,298 linear feet frctn S.H. 114 north; and frcan that ` point further it w�uld be a four-lane divided roadway with median, with a f minimum pavement width of 26 feet for each direction and include curb, gutter, 6 sidewalk and storm drainage. M�edian openings are planned at William D. Tate � Avenue and South Ball Street, and William D. Tate Avenue and Nash Street. � Total project construction cost is $1,010,868.92 with the proposed assessment � E, � of abutting property owners being estimated at $549,233.78 (based on a figure � of $157.55 per front foot) . � � Mr. Laster continued by reviewing the South Ball Street drainage outfall, which � is necessitated by the improvements to William D. Tate Avenue, and noted the � cost of that project to be $170,120.00. Therefore, resulting in a total cost � of $1,445,824.67 for the William D. Tate Avenue improvements and the South � Ball Street drainage outfall project. He then sukxn.itted into the record the � documents and inforntiation presented (slides, maps, notice, construction plans € and specifications) . � � � � i 1' E E � � l�� : E � # � 04/05/88 i Mr. James Cullar, Senior Partner of E�raluation Associates Inc. , gave a brief overview of the work performed by the real estate evaluation consulting firm and a brief history of his company. He stated case studies had been developed to measure the positive impact, if any, on abutting properties where roads are widened or improved. All parcels abutting William D. Tate Avenue �re individually evaluated, a traffic study was conducted and then, based on previously developed case studies, the special benefits to individual properties along William D. Tate Avenue was valued at ten percent (10�) , that was then applied to the estimated base value of each parcel. Variables � included in the base evaluation of each site are affected depth and frontage of each site. The conclusions of the study are highlighted in the engineer's roll. ! There were no questions fran the Council. Mr. Conner Lam, 1280 Post Oak Trail, Southlake, business owner at 1017 William D. Tate Avenue, addressed the Council requesting permission to allaw property owners to question the consultant presenting testimony regarding the proposed assessments to property owners as to the methodology used to arrive at the market values. He stated this one public hearing would be the property awner's only t�me to present all evidence to the Council. He requested a fair and impartial hearing be allowed. Assistant City Attorney Adrienne Leonard advised the statue provides that the governing body must allow all abutting property owners to be heard. However, it does not impose an obligation on the City Council to allow cross examination. The abutting property owners can make statements and address all questions to the Council and the Mayor, the presiding officer, who may then address the questions to various witnesses. The substantial evidence rule does apply in the paving assessment hearings and essentially that means all evidence must be presented at the public hearing before the City Council in order for the Court to be able to review the evidence. If an abutting property owner exercises his appeal rights, there wr�uld not be a full court hearing to allow presentation of new facts. However, the decision of the court does not �mply that the substantial rule requires, or mandates, cross examination to be conducted. All that is required under the law is that the abutting property owners be given the opportunity to be heard, state their positions, ask questions of the Council. The statue provides that the Council can establish its own rules governing the conduct of the public hearing. The Council has no obligation to conduct the public hearing as a nozmal trial with cross examination of each of the witnesses. The purpose of the public hearing is for the City Council to take evidence and make a decision based on the evidence as to whether or not the benefits to the property are equa.l, or greater than, the proposed assessments, and determine whether Council wants to proceed with the levying of the assessments. Mayor Powoers stated this Council has always allowed citizens to be heard, but requested the public hearing not be turned into a full trial. Mr. Lam requested to begin by questioning Mr. James Ctiillar. Ms. Leonard requested the enhancement study prepared by Ebaluation Associates Inc. be sukmitted into evidence. Mayor Powers then announced the Council would take a brief recess. Al1 members of the Council w�ere present upon reconvening in the Council Chambers. Mr. Jerry Pittman, property owner on Pebblebrook, Main Street, Ball Street and College Street, addressed the Council as a concerned citizen and not an u abutting property awner on William D. Tate Avenue. He expressed concern regarding the concrete medians proposed for William D. Tate Avenue and asked about incongruities in not assessing Main Street owners when improvp�nts were made and yet proposing to assess another major artery property owners for improvements. Main arteries represent a need of all the people of the cce�munity and all of the people should pay for such improvements through ad valorem taxes and bond issues. He stated the condition of Wall Street, Mustang Drive, and Kimball Road should possibly be considered and the Tate Avenue project tabled. � Mr, Lam then requested Mr. James Clallar be asked to come fozward to answer questions relative to the methodology used in the property evaluation. Lengthy discussion followed, with Mr. Cullar responding to questions regarding � the process and m�thodology utilized in evaluating the properties abutting (3) i i � 04/05/88 ; William D. During discussion, Mr. Lam requested all of the consultant's documentation , relative to evaluating the properties on William D. Tate Avenue be brought to ' the Council meeting. ' The possibility of continuing the public hearing was discussed and following , the discussion, Council Member Spencer made a motion to continue the public ' hearing on the William D. Tate Avenue assessments on Monday, April 18, 1988 at 7:00 p.m. in the Council Chambers. This item was tabled at the March � 15, 1988 meeting to allow Staff to conduct reference checks and to clarify the ; wording in Paragraph 5 of the agreement to the effect the City Council would � have the sole discretion to determine whether a law suit would be filed to � pursue collection of monies due the City. � Mr. Seeley noted this wr�uld be the first time the City has conducted an audit � of the franchise agreements. He advised area cities are considering the audit � jo�ntly; therefore, the firm has agreed to a reduction from 50� to 30g of its � normal contingency fee. Each of the four cities contacted for reference, � highly rec�nded the firm.
