� PUBLIC HEARING CONTINUATION, WILLIAM D. TATE AVENLTE ASSESSMENTS
i ''
� Mayor Powers requested Assistant City Attorney Adrienne Leonard review the
' procedures and guidelines the City Attorney's office rec�nded the City
Council follow in the continuation of the public hearing on the prop�sed fi
assessments to William D. Tate Avenue. She stated that although permissible,
the law does not require cross-examination during paving assessnent hearings.
' Ms. Leonard outlined the procedures and noted that all parties would be
provided adequate opportunity during the public hearing process to state their w
� testimony.
During the City Council deliberation of the rec�nded guidelines, it was the °
� general consensus of the Council to allaw all interested land awners to
� present their testimony prior to Mr. Conner Lam, property o�mmer at
� 1017 William D. Tate Avenue, conti.nuing his cross-examination of Mr. Jam�es �
Cullar of Ebaluation Associates, Inc. �
�
I Mayor Powers then declared the public hearing be continued from the public
hearing held on April 5, 1988. He invited guests present to address the
Council. �

' Mr. James Robertson, 5846 Morningside Drive, Dallas, representing BCC Olympic, �'
was given the Oath of Truth by Mayor Powers. Mr. Robertson stated that his ;
company was the largest assessed property owner along William D. Tate Avenue, .:
and he wished to extend to the City Council, Mayor, and Staff continued �
� support for the progressive policies utilized to meet the growth needs of the
cc�munity. Also, he expressed support for the proposed project. c
�

j The following guests addressed the Council, after being ach�iinistered the Oath ;
� of Truth by Mayor Powers. Al1 expressed concern regarding the methodology v
; utilized in the property evaluations. �

Mr. Fred Joyce, business partner of Ms, Mary Stone Myers, spoke on behalf o� �
Ms. Myers, property owner at 1017 William D. Tate Avenue. He noted the z
proposed realignm�nt of William D. Tate Avenue would be a deterrent to their {
business, a

Mr. W. Scott Kinns.mer, 4112 Hart��, Fort Worth, awner o� property located
at the iantersection of William D. Tate Avenue and Dallas Road, expressed
cancern that he was being assessed for enhancenx:�.nts after danating certai.n =
requested rights-at-way to the City along Dal].as Road. s

Mr. Cerald Hartsell, 1701 River Run Road, Fort Worth, and Mr. John Evans, g
5959 Berkshire Lane, Dallas, bath owners of praperty along William D. Tate
Avenue, voiced cancern over the n�e�.hodalogy utilized in valuing the
enhancements to the properties. Mr. Evans stated his objectian to the �
proposed median.

�'ollowing the stateme:nts, Nlayor Powers announced the Cauncil would take a
brief recess. Upon reconvening mc�nentarily, alI memb�rs of the Cauncil were �
present. �

Mr. Conner Lam, 1280 Past Oak Trail, Sout.hlake, business owner at �
101? William D. Tate Avenue, reques�ed permission to continu� his �
cross-examination of Mr. James C�illar, of Evaluation Associates, Inc. , that �
was began during the April 5, 2988 public heari.ng. Mr. Lam continued to �
question the me�hodolcagy and pracess utilized in the evaluation of the �
properties abutting Williarn D, Tate Avenue. �Verbatim transcript was being �
taken by Mr. David Chance, Caurt Reporter, and will be filed in the City r
Secretary's office.) �

Mr. Robert Ma.rtin, 3406 Country Club Circle, Grand Prairie, was given the Oa�.h �
of Truth by Mayor Powers. Mr. Mar�in offered testimany on behalf of Mr. Lam �
regarding the evalua�.ion methadology and process utilized by Evaluation �
Assaciates, Inc, He affered his evaluation arid analyzation af Mr. Cullar's
report, noting that special benefi�s and general benefits are not the same �
issue. He made reference to the case of Byrd, et al vs. the City af �
Arlington, Texas, and testimony that Mr. Cullar had offered at that time. �
Mr. Lam requested that a portion Mr. Cullar's transcript be su}snitted into the �
recard.

During discussion, Mr. Lam also su�mitted inta record a Petition a£ Camplain� �
relative to the pending and proposed pavi.ng assessm�ent by the City o� ;
Grapevine, Te.�cas against his property. E

Following the lengthy testimony of Mr. Martin and the additianal remarks by �
Mr. Lam, Mayor Pow�rs no�ed the Council wauld take a brief recess. Upan �
recanvening, all members of the Council were present. At that time, Mr. Cullar ;-
offered his closing remarks. Lengthy Council discussion fol�.ow�d with >
question� and corranents regarding the assessments, if any on the South Main `
Street improvemen�.s. �t.�f� nated there w�re no assess�ments on �he Main Street �
Zmprovem�.nts, it was a State Highway project. Cauncil expressed concern over €
the amounts of the proposed assessn�nts �or William D. Tate Avenue, �

During the lengthy deliberation, it was the consensus of the City Council ta `
nat consider the award of the bid for the improvements ta William D. Tate �
Avenue until the assessnent issue is resovled and to cantinue �he public �
hearing at a Iater date to allaw fur�.her testimany to be su�ti.tted into �
recard. Staff was directed ta pravide additional iza£orma:tion regarding the �
following: (1} rights-of-way abandonment, {2) cc;mpa.rison af curb and gutter �
only, (3) comparison of curb, gutter, and starm sewer, (4) value and appraisal �
on each trac�., (5) value of any rights-of-way t.hat might be a.b�ndoned, (6) �:
value of any rights-of-way previously dedicated and various ccxnbinations �
thereof and (7) possible funding for the praject, if the e.nhancements are nat
adapted as groposed. T`he Assistant City Attarney advised that if the Council �
had requests for any additional i.nformation, that they }�e sukmitted �.o the �
City Secretary in writing. It was noted that the additional infaz�ation w�uld �
not be provided to the Council until the next public hearing. �'

Mr. Cuilar addressed the Council once again, noting that his value opinion of �
the befare improv�aments on each tract and the value op.a.nion after improv�ments �
on each fixact had been su�nitted to the Council, and that apinion wc�uld nat =
change with the �ception af the i.nquiries that w�ere made tonight, regarding �
the trac�.s c�wned by Mr. Lam, Ms. Myers, Mr. Kinnimer and Mr. Hartsell, �

The continuation the public hearing was then discussed. Council Niember
Wilbanks made a motion to continue the public hearing on the William D. Tate
Avenue proposed assessme.nts on Monday, May 9, 1988 at 7:00 p.m. in the Council
Ch�mbers. Council N1e.mber Traverse offered a second to the motion which a
prevailed by the following vote: ;�
Ayes: Powers, Ware, Glynn, Spencer, Wilbanks, Niedermeier, & Traverse `
Nays: None �

There being no further business to consider, Council Nlember Niedernleier �
offered a motion to adjourn at 11:15 p.m. Mayor Pro Tem Ware seconded the �
motion which prevailed as follows: �
