Specific Nature of Appeal: The existing gate that is located at the rear of our home at 517 Dove Creek Circle was constructed 23 Years ago. Received an email from Larry Gray, Plans Examiner/Inspector, per City Ordinance the gate "must be set back a minimum of 20'-0" from the property line on the street side and sight triangles must not be obstructed from the street, pedestrian walkway, or drive or removed". Since this rear fence, gate and driveway were constructed approx.1997 (23 years ago), long before we bought this home in July 2000, we feel this gate accents the home and poses no safety issues and should not be changed. Any changes would be a hardship and take away from the beauty of our home. We are requesting this gate be Grandfathered. 5. State Justification for the appeal and explain how a hardship would be created if the appeal is not granted. Explain how you situation is peculiar to the circumstances contemplated by the ordinance and attach drawings necessary to help explain the case to the board. (You do not need to attach the same drawing as attached to your application for a building permit as the building official will provide the board with those records).: In June of 2000 1 retired after 24 years serving in the United States Air Force and my family relocated to Grapevine Texas. After looking at homes and schools we bought the home at 517 Dove Creek Circle. The home was amazing and one of the selling points was an 8 foot privacy fence, a 16x8 foot gate and a driveway at the rear of the home. A current home owner on Dove Creek Circle, Larry Gentry, 541 Dove Creek Circle stated that he knows the constructed the fence, gate and driveway was in 1997/1998. He has confirmed this (See attached Letter1) in an email. In 2001 1 drew plans to have concrete poured and provided the City of Grapevine the plans for a Carport. The plans clearly show an entry to this Carport through an existing Driveway and Gate. (See Attached A) These plans were approved and the Carport constructed to be accessed through the existing Driveway and Gate. Upon completion, a City Inspector from Grapevine (Bret is the only name I have) arrived at this gate and inspected the Carport build and approved it. The City Inspector left through this gate. One would hope before I spent a significate amount of money involved with a Carport something would be brought up concerning this gate. Kay and Donald Coker 517 Dove Creek Circle Grapevine, Texas 76051 o The Concrete work was complete on March 28, 2001 at a cost of$3,913.00 o The Carport build was complete and approved on July 20, 2001 at a cost of$3,342.00 (Please see ATTACHED A, B and C)(Also see Picture 1) In Sep 2019 after 22 years of aging fence boards we hired a fencing company to replace 173' of new 8' board on board wood fence using the existing post. The replacement fence was identical to the fence that was there since we bought the home in 2000. Only fence boards were changed and no boundaries or poles were moved. The new fence adds beauty to our home, adds beauty to the neighborhood, and adds beauty the City of Grapevine. As to requesting a building permit for this work, I researched the City of Grapevine "When Is a Permit Required" document. It stated that replacement of less than 50% of fence, provided the location and height is not being changed, does not require a permit". Measuring all my fencing I have approx. 397'. The fence I had replaced was well under 50% (See Picture 2-8). o The replacement fence complete on September 30, 2019 at a cost of$5,300.00 What confuses us is that from what we understand from the City Of Grapevine is that the previous owners on 517 Dove Creek Circle constructed the existing fence, gate and driveway and never requested a permit. Our concerns are why this error should fall on us. We had no knowledge of this when we purchased the home. Why should we be responsible for changing something that has been in place for the 23 years? We had a Title Search completed at the time we purchased this home and were satisfied that everything was in order. For 23 years this pate and driveway has not caused an _accident or been a safety issue To move the Chain Drive gate back a minimum of 20'-0" from the property line would be impractical to impossible and be a Hardship on us. Looking at the measurements of the current area, it would take away our back yard property and the beautification we have added over the years. Our back yard comes to an angle in that area. The gate would be inches from the City Approved Carport making it a safety issue to back a vehicle in. The sidewalk comes to a complete stop at the edge of our property line and does not continue to another sidewalk so there is little if any foot traffic through this area. To remove the gate and construct a fence in its place blocking the existing driveway would render the City Approved Carport and Shop useless. This would be a hardship and take away the home value and a selling point for this home not to mention what it cost of installation. This Carport is where I part my vehicle to keep it secure. Without this Carport I would have to park my vehicle on the street and it would no longer Kay and Donald Coker 517 Dove Creek Circle Grapevine, Texas 76051 be secure or safe from weather. This will have an adverse effect on our property value. This would take away from the beauty of our backyard which we have worked on for many years. I am a Retired, Disabled Veteran and we live on a fixed income and to do any changes would affect our Quality of Life and significantly put us in a Financial Hardship. Cost estimates to Move or Remove gate from Anchor Fencing would be estimated $7,000415,000. This, in itself would be a great Hardship on us. Yes this is my second house on the street so I go back to the 1990s on this street. Funny you ask as we were friends with the previous owners Jay and Charlene, and were always over at the house. I remember the gate and fence. If I recall, I made several comments about the functionality and practical use of the gate,which slid alongside the fence and allowed access to Autumn drive. I'll try to recall more info if you need additional details. Sony been a while. Specifically I would like to know if the 8 foot Board on Board fence,Gate and Driveway entering the back of my property was constructed before the year 2000.
