HomeMy WebLinkAboutORD 1994-050 ORDINANCE NO. 94-50 AN ORDINANCE OF THE CITY OF GRAPEVINE, TEXAS AMENDING ORDINANCE NO . 82-73 , THE COMPREHENSIVE ZONING ORDINANCE OF THE CITY OF GRAPEVINE, TEXAS, SAME BEING ALSO KNOWN AS APPENDIX "D" OF THE CODE OF ORDINANCES OF THE CITY OF GRAPEVINE, TEXAS, BY PROVIDING FOR AMENDMENTS AND CHANGES TO ZONING REGULATIONS BY AMENDING SECTION 23A GRAPEVINE VINTAGE DISTRICT, SECTION 58 PARKING AND LOADING AREA DEVELOPMENT STANDARDS, AND SECTION 60 SIGN REGULATIONS; PROVIDING A PENALTY OF FINE NOT TO EXCEED THE SUM OF TWO THOUSAND DOLLARS ($2,000.00) FOR EACH OFFENSE AND A SEPARATE OFFENSE SHALL BE DEEMED COMMITTED EACH DAY DURING OR ON WHICH AN OFFENSE OCCURS OR CONTINUES; PROVIDING A SEVERABILITY CLAUSE; DECLARING AN EMERGENCY AND PROVIDING AN EFFECTIVE DATE BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF GRAPEVINE, TEXAS: Section 1 . That Ordinance No. 82-73, the Comprehensive Zoning Ordinance of the City of Grapevine, Texas same being also known as Appendix "D" of the Code of Ordinances of the City of Grapevine, Texas is hereby amended in the following particulars, and all other sections, subsections, paragraphs, definitions, words and phrases of said Appendix "D" are not amended but are hereby ratified, verified and affirmed: A. That Section 23A, Grapevine Vintage District, is hereby amended by amending Subsection 23A.1.1, to read as follows: "1 . No principal structure shall be erected or altered to a height exceeding thirty-five (35) feet, except buildings located contiguous to an R-20, R-12.5, R-7.5 or R-5.0 Residential District shall be limited to one (1) story. A winery or wine tasting facility not adjacent to a R-7.5, R-12.5 or R-20 „�..,, Single Family Residential District, may exceed the maximum heigh� requirements of Section 23A.1.1 (thirty-five [35] feet) not to exceed a maximum height of fifty (50) feet, provided a conditional use permit is �� issued in accordance with Section 48 of the ordinance." _ _ _ _ __ _ __ __ ___ __ _ _ _ _ B. That Section 58, Parking and Loading Standards, is hereby amended by the addition of Subsection 58.0., to read as follows: "O. Internal traffic cross access providing interconnecting access between developments or lots, exclusive of public street access, shall be required between all non-residential developments to alleviate traffic hazards in the public right-of-way. Cross access will not be required between Light Industrial zoning and other non-residential zoning districts. All exceptions are noted in the Driveway Design and Placement Standards, Chapter 20, Article III, of the City of Grapevine Code of Ordinances. Internal cross access will not be required for properties having driveways approved by a concept plan in accordance with Section 45, or a site plan in accordance with Section 47, prior to June 21, 1994." C. That Section 60, Sign Standards, is hereby amended by amending Subsection 60.G.4, to read as follows: "4. Maximum Height: No sign shall protrude above the roof or eave line of the principal structure. Projecting signs shall be a minimum of eight (8) feet above sidewalk grade and shall not protrude above the roof or eave line of the principal structure." Section 2. Any person violating any of the provisions of this ordinance shall be deemed guilty of a misdemeanor and upon conviction thereof shall be fined in a � sum not to exceed Two Thousand Dollars (52,000.00) for each offense and a separate offense shall be deemed committed each day during or on which an offense occurs or continues. Section 3. If any section, article, paragraph, sentence, clause, phrase or word in this ordinance, or application thereto any person or circumstances is held invalid or unconstitutional by a Court of competent jurisdiction, such holding shall not affect the validity of the remaining portions of this ordinance; and the City Council hereby declares it would have passed such remaining portions of the ordinance despite such invalidity, which remaining portions shall remain in full force and effect. Section 4. The fact that the present ordinances and regulations of the City of Grapevine, Texas are inadequate to properly safeguard the health, safety, morals, peace and general welfare of the public creates an emergency which requires that this ordinance become effective from and after the date of its passage, and it is accordingly so ordained. �r;� PASSED AND APPROVED BY THE CITY COUNCIL OF THE CITY OF GRAPEVINE, TEXAS on this the 21st day of June , 1994. �.� ORD.
