HomeMy WebLinkAboutORD 1994-040 ORDINANCE NO. 94-40 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF GRAPEVINE, TEXAS AMENDING THE GRAPEVINE CODE OF ORDINANCES CHAPTER 7 BUILDING AND CONSTRUCTION, SECTION 7-4 TO PROVIDE FOR ALTERNATE MEMBER POSITIONS AS DEEMED NECESSARY TO THE HOUSING AND BUILDING BOARD OF APPEALS; DECLARING AN EMERGENCY AND PROVIDING AN EFFECTIVE DATE WHEREAS, there currently exists numerous boards, commissions and committees within the City of Grapevine, Texas, handling a variety of affairs for the City; and WHEREAS, Section 3.07(f) of the Charter of the City of Grapevine empowers the City Council to provide for appointment to such boards and committees; and WHEREAS, the City Council deems it in the best interest of the City to amend the structure of certain boards and committees to provide for alternate member � -- positions. �.. . NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF GRAPEVINE, TEXAS: Section 1 . That all of the above premises are found to be true and correct and are incorporated into the body of this ordinance as if copied herein in their entirety. Section 2. That the City Council hereby deems it necessary to provide for alternate member positions and hereby amends the Grapevine Code of Ordinances to alter the structure of the Housing and Building Board of Appeals by amending Chapter 7 Building and Construction, Section 7-4 Creation of the Housing and Building Board of Appeals to read as follows: "Sec. 7-4. Creation of housing and building boards of appeals; membership. The city council shall appoint five (5) members to the housing advisory and appeals board as authorized by the Uniform Housing Code, 1973 Edition, and five (5) members to the board of appeals as authorized by the 1985 Edition of the Uniform Building code, and the membership of both boards shall consist of the same five (5) individuals. The five (5) members appointed to the two (2) boards shall qualify as members of both boards as required by the respective codes. There is hereby established the position of first aiternate member of the board who shall meet with the board and serve in the place and with the full power of a member in the absence of a member. Such alternate member shall be designated as first alternate and shall serve in the place of a member in such designated priority. The alternate member shall serve for a period of one year. Each of the five citizen members shall occupy a Place on the Building Boards of Appeals, such Places being numbered 1, 2, 3, 4, and 5. Upon approval and adoption of this ordinance, Places 1 , 2, and 3 to be appointed June 7, 1994, to serve for a period of two years. Subsequent appointments to Places 1, 2, and 3 shall be for a term of two years. Places 4 and 5 to be appointed June 7, 1994 shall serve for a period of one year. Subsequent appointments to Places 4 and 5 shall be for a term of two years. Terms of the board members shall be staggered two year (2) terms and all other duties and responsibilities shall be as required by the codes." Section 3. The fact that the present ordinances and regulations of the City of Grapevine, Texas are inadequate to properly safeguard the health, safety, morals, peace and general welfare of the inhabitants of the City of Grapevine, Texas creates an emergency for the immediate preservation of the public business, property, health, safety and general welfare of the public which requires that this ordinance shall become effective from and after the date of its passage, and it is accordingly so ordained. Section 4. That this ordinance shall take effect from and after the date of its �. .; passage.
