JOINT PUBLIC HEARINGS CONDITIONAL USE APPLICATION CU11 -20, ZONE CHANGE Z11 -05 ESPARZA'S RESTAURANT First for the Commission to consider and make recommendation to City Council was conditional use application CU11 -20 and zone change application Z11 -05 submitted by EZB Restaurants for property located at 124 East Worth Street and platted as Lot 2RA, Block 32, City of Grapevine Addition. The applicant was requesting a conditional use permit to amend the previously approved site plan of CU97 -31 (Ord. 97 -69) for a restaurant with the possession, storage, retail sale, and on- premise consumption of 081611 1 P & Z JOINT PUBLIC HEARING AUGUST 16, 2011 alcoholic beverages (beer, wine and mixed beverages) specifically to allow outside dining. The applicant is also requesting a zoning change to rezone approximately 0.2 acres from "R -7.5" Single Family District to "CBD" Central Business District to expand the restaurant site specifically to add more parking. This is the first reading of the ordinance. Rezoning the rear portion of the lot immediately adjacent to the east will create a slight nonconforming issue with encroachment into the front yard for the existing structure and buffer area separation along the western property line, which will require Board of Zoning Adjustment action. This application was tabled from the July 19, 2011 public hearing after discussion was held regarding the need for additional parking and a new drive entrance off Franklin Street. Additional parking was added to the rear portion 204 East Worth Street providing 71 on- site parking spaces. The City of Grapevine has agreed to purchase the property owned by Jon Michael Franks at Jenkins and East Worth Street, which will provide 36 public parking spaces, along with 70 current public parking spaces. Mr. F. C. LeVrier and Mr. Steve Brown were available to answer questions and requested favorable consideration. Discussion was held regarding helping to eliminate the street parking. Lighting and drainage issues for the new parking lot were also discussed. The applicant agreed to not provide outside dining on the patio until the construction of the new on -site parking lot is complete. Ms. Susan Finch and Ms. Jane Johnson expressed concerns regarding lighting, traffic, trash and drainage. With no further questions, guests to speak, two letters of support, two letters of opposition and one letter of concern, the public hearing was closed. Martin and Szot Nays: None In the Commission's deliberation session, Wayne Szot moved to approve conditional use application CU11 -20 with the condition that no outdoor dining take place until the new on -site parking lot has been completed and the applicant shall provide bollard style lighting in the new on -site parking lot. Martin and Szot Nays: None 081611 2 P & Z JOINT PUBLIC HEARING AUGUST 16, 2011 ZONE CHANGE APPLICATION Z11 -03, CONDITIONAL USE APPLICATION CU11 -15, PLANNED DEVELOPMENT OVERLAY APPLICATION PD11 -04 - RESIDENCES AT GRAPEVINE STATION Next for the Commission to consider and make recommendation to City Council was zone change application Z11 -03, conditional use application CU11 -15 and planned development overlay application PD11 -04 submitted by North American Properties for property located at 1022 Texan Trail and proposed to be platted as Lot 2R, block 4, Grapevine Station Addition. The applicant was requesting to rezone approximately 4.3 acres from "CC" Community Commercial District and 5.86 acres from "BP" Business Park District to "R -MF" Multifamily District for the development of a three story, 278 unit multifamily development. The applicant is also requesting a conditional use permit to vary from the established standards relative to density, open space, height and parking and a planned development overlay to include but not be limited to deviation from rear yard buffer area, landscaping, building length, building separation, building articulation, and accessory uses. With the conditional use application, the applicant was proposing to vary from the established standards in four areas: • Density:20 units /acre maximum allowed; proposed, 27.4 units /acres • Open space: 250 square of recreation open space per unit required; proposed 100 square feet per unit • Height: two stories, 35 feet maximum allowed; proposed 50 feet • Parking: 2.5 spaces required per unit; proposed 1.74 spaces per unit With the planned development overlay application, the applicant was proposing to vary from the ordinance in these areas: • Rear yard buffer requirement: required 40 foot buffer area whenever an "R -MF" Multifamily District is located adjacent to an existing or zoned residential district of lower density; the applicant proposes a buffer area of 30 feet • Side yard setback: required 20 foot setback along the north property line relative to the two story structures; applicant proposes ten feet • Parking within the front yard setback area: the ordinance establishes the front yard as both a building setback' and landscaped setback area; applicant proposes to provide parking in the front yard and near adjacent property lines • Design requirements relative to building location and vehicle use /parking areas: ordinance requires a minimum 15 foot separation between buildings and vehicle use areas; applicant proposes separation of less than ten feet in numerous areas • Design requirements relative to the length of buildings: ordinance requires a maximum length of any building shall not exceed 200 feet; building range from approximately 205 feet to approximately 235 feet • Design requirements relative to building articulation: buildings must have a vertical break of at least three feet every 60 continuous feet; applicant proposes 081611 3 P & Z JOINT PUBLIC HEARING AUGUST 16, 2011 a break of one foot within every 30 feet • Design requirements relative to building separation: minimum separation between any two unattached buildings shall be 20 feet or the height of the building whichever is greater; the applicant proposed a separation of 21 feet (27 feet required) for five structures at the rear of the site along the western property line Mr. Gary Hazelwood and Mr. Mike Pacillio, the applicants, were available to answer questions and requested favorable consideration. Discussion was held regarding the buildings on the west side of the property adjacent to the Box Addition. The applicant agreed to work with the Historic Preservation Manager to revise the elevations to blend with the architecture of the Box Addition. Discussion was also held regarding the number of variances requested by the applicant. It was felt that the maximum length of the buildings and the open space variance requests could be eliminated. Ms. Brenda Stuckert, Ms. Debi Meek and Mr. Fabien Goury spoke in support of the development. With no further questions, guests to speak, four letters of support within the notification area and seven letters of support that were not within the notification area, the public hearing was tabled. In the Commission's deliberation session, Herb Fry moved to table zone change application Z11 -03, conditional use application CU11 -24 and planned development overlay PD11 -04 to the September 20, 2011 public hearing. Martin and Szot Nays: None CONDITIONAL USE APPLICATION CU11 -21 -GRAPEVINE STATION Next for the Commission to consider and make recommendation to City Council was conditional use application CU11 -21 submitted by North American Properties for property located at 1024 Texan Trail and platted as Lots 1 -7, Block 1, Lots 1 RA and 2A, Block 2A, Lots 1 R, 2, 3, Block 3, Grapevine Station Addition. The applicant was requesting a conditional use permit to amend the previously approved site plan of CU05 -26 (Ord. 05 -46) for a planned business park specifically to reduce the size of the planned business park to accommodate the development of an apartment complex. The applicant, Mr. Mike Pacillio, requested that this application be tabled to the September 20, 2011 public hearing in order to work out issued associated with Z11 -03, CU 11-20 and PD11 -04. With no further questions, guests to speak, one letter of opposition, the public hearing was tabled. 081611 4 P & Z JOINT PUBLIC HEARING AUGUST 16, 2011 In the Commission's deliberation session, Herb Fry moved to table conditional use application CU11 -21 to the September 20, 2011 public hearing. Martin and Szot Nays: None CONDITIONAL USE APPLICATION CU11 -22 - EATZI'S Next for the Commission to consider and make recommendation to City Council was conditional use application CU11 -22 submitted by Adam Romo for property located at 1200 West State Highway 114 and platted as Lot 3R1, Block 1, Towne Center Addition No. 2. The applicant was requesting a conditional use permit to amend the previously approved site plan of CU93 -05 (Ord. 93 -29) for a planned commercial center, specifically to allow the possession, storage, retail sale and off - premise consumption of alcoholic beverages (beer, and wine only) outdoor dining, a 40 -foot pole sign and outdoor speakers in conjunction with a market and bakery. Mr. Adam Romo, the applicant, was available to answer questions and requested favorable consideration. Mr. Romo stated that they intend to open in March 2012. With no further questions, guests to speak, nor letters or petitions, the public hearing was closed. Martin and Szot Nays: None CONDITIONAL USE APPLICATION CU11 -23 - TOWERS OF GRAPEVINE Next for the Commission to consider and make recommendation to City Council was conditional use application CU11 -23 submitted by John T Evans for property located at 1301 and 1401 William D Tate Avenue and proposed to be platted as Lot 1 R2R -1 R, Block 1, Hayley Addition. The applicant was requesting a conditional use permit to amend the previously approved site plan of CU10 -18 (Ord. 10 -35) for a planned commercial center, specifically to revise the lot configuration for a restaurant with drive - through service, outdoor speakers and to relocate a 20 -foot pole sign. Mr. John Evans, the applicant, requested that conditional use permit CU11 -23 be tabled to the September 20, 2011 public hearing to revise plans for the drive - through restaurant. 081611 5 P & Z JOINT PUBLIC HEARING AUGUST 16, 2011 With no further questions, guests to speak, nor letters or petitions, the public hearing was tabled. AM11 -05 AMENDMENTS TO GRAPEVINE COMPREHENSIVE ZONING ORDINANCE SECTION 52, TREE PRESERVATION Next for the Commission to consider and make recommendation to City Council was possible amendments to Grapevine Comprehensive Zoning Ordinance, Section 52, Tree Preservation. Staff had recently encountered a situation where a renter of a single family residence cut down a very large oak tree on the property he was renting. Section 52, Tree Preservation had always been intended to apply to both developed and undeveloped properties. It has also always been intended to apply to both residential and non - residential property with the only exception being developed, owner occupied single family property. The City Attorney recommended minor changes to help clarify the ordinance. In the Commission's deliberation session, B J Wilson moved to approve amendments to Grapevine Comprehensive Zoning Ordinance, Section 52, Tree Preservation AM11 -05. Martin and Szot Nays: None END OF PUBLIC HEARING CONDITIONAL USE APPLICATION CU11 -19 AND PLANNED DEVELOPMENT OVERLAY APPLICATION PD11 -02 - BANK OF THE WEST Next for the Commission to consider and make recommendation to City Council was conditional use application CU11 -19 and planned development overlay application PD11 -02 submitted by Bank of the West for property located at 201 North Main Street and platted as Lot 2, Block 1, Bank of the West Addition. The applicant was requesting a conditional use permit to amend the previously approved site plan of CU09 -35 (Ord. 09 -46) to extend approval of a temporary bank facility to October 20, 2012, specifically to remove the temporary designation from the building. The applicant was also requesting a planned development overlay to deviate from but not limited to: • Front yard setback: minimum front yard landscape by ordinance is 25 feet; requested landscape area adjacent to North Main Street is 16 feet. • Screening requirements: ordinance requires a screening wall or fence of not less than six feet in height when non - residential uses are adjacent to a residential zoned district; the proposed screening request is to install a six -foot, wood 081611 6 P & Z JOINT PUBLIC HEARING AUGUST 16, 2011 privacy fence approximately 180 - linear feet in length along the north property line and use the existing chain link fencing with vinyl slats for the remainder of the length of the property along the north property line. • Perimeter landscaping: ordinance requires vehicle use areas have a ten foot wide landscaping buffer when adjacent to property lines; the proposed request is to allow the existing pavement adjacent to the south property line to remain. • Perimeter landscaping: ordinance requires one tree for each 50 feet along the perimeter; the applicant proposes utilizing the unsurveyed row of trees found adjacent to existing fencing along the north, west and a portion of the south property line. Martin and Szot Nays: None PARKING PLAN PP11 -01 - ESPARZA'S Next for the Commission to consider was parking plan application PP11 -01 submitted by Esparza's for property located at 124 East Worth Street and platted as Lot 24R, Block 1, Original Town of Grapevine Addition. The applicant was requesting approval of a parking plan. Mr. F C LeVrier and Mr. Steve Brown, representing the applicant, asked consideration for the potential of 70 current public parking spaces, proposed 36 public parking spaces at 115 East Worth Street along with 71 on -site parking spaces will provide 177 parking spaces with a requirement of 97 parking spaces. Herb Fry moved to approve parking plan application PP11 -01. B J Wilson seconded the motion, which prevailed by the following vote: Ayes: Oliver, Fry, Wilson, G. Martin, Tiggelaar, E. Martin and Szot Nays: None 081611 7 P & Z JOINT PUBLIC HEARING AUGUST 16, 2011 FINAL PLAT APPLICATION LOTS 2R AND 3, BLOCK 4, GRAPEVINE STATION ADDITION Next for the Commission to consider and make recommendation to the City Council was the Statement of Findings and Final Plat Application of Lots 2R and 3, Block 4, Grapevine Station Addition submitted by Triple T Farms, Ltd. for property located at Texan Trail and Wall Street. The applicant was final platting 13.64 acres for apartment and commercial development. In the Commission's deliberation session B J Wilson moved to deny the Statement of Findings and Final Plat Application of Lots 2R and 3, Block 4, Grapevine Station Addition.
