Briefing Session on this the 21 st day of June 2011 at 7:00 p.m. in the Planning and

AM 11-03 AMENDMENTS TO THE COMPREHENSIVE ZONING
ORDINANCE RELATIVE TO ASSISTED LIVING FACILITIES
to discuss development issues.

1. Consider Conditional Use Application CU11-10(Pappadeaux Seafood Kitchen)and
make a recommendation to the City Council.
2. Consider Conditional Use Application CU11-11 (First Financial Bank) and make a
recommendation to the City Council.
3. Consider Conditional Use Application CU11-13 (Gaylord Paradise Springs) and
make a recommendation to the City Council.
4. Consider proposed amendments to the Grapevine Code of Ordinances,Appendix
D, Comprehensive Zoning Ordinance No. 82-73, as amended, Sections 12
Definitions, Section 21 "R-MF-1" Multifamily District Regulations, Section 22 "R-MF-
2" Multifamily District Regulations, 24 "CN" Neighborhood District Regulations and
27 "PO" Professional District Regulations and make a recommendation to the City
Council.
5. Consider the final plat of Lots 1R-5R, Block 1, Nightingale Court and make a
recommendation to the City Council.
6. Discuss possible amendments to Appendix D, Comprehensive Zoning Ordinance
No. 82-73, as amended, Section 21 "R-MF-1" Multifamily District Regulations and
Section 22 "R-MF-2" Multifamily District Regulations and take any necessary action.

Mayor Tate called the joint meeting to order at 7:33 p.m. and Chairman Oliver called the
Planning and Zoning Commission deliberation session to order at 8:04 p.m.
INVOCATION AND PLEDGE OF ALLEGIANCE
Commissioner Gary Martin delivered the Invocation and led the Pledge of Allegiance.
JOINT PUBLIC HEARINGS
CONDITIONAL USE APPLICATION CU11 -10 PAPPADEAUX SEAFOOD KITCHEN
First for the Commission to consider and make recommendation to City Council was
conditional use application CU11 -10 submitted by JDJR Engineers and Consultants for
property located at 600 West State Highway 114 and platted as Lot 6, Block 1, Hayley
Addition. The applicant was requesting a conditional use permit to amend the
previously approved site plan of CU10 -03 (Ord. 2010 -10) for a planned commercial
center, in conjunction with a restaurant with the possession, storage, retail sale and on-
premise consumption of alcoholic beverages (beer, wine and mixed beverages), outside

dining, and a 40 -foot pole sign specifically to increase seating and allow for outdoor
speakers.
Mr. Jim Dewey and Mr. David Richards were available to answer questions and
requested favorable consideration. The outdoor dining /waiting area will have ten
speakers for low level background music contained within the patio area. The
restaurant will close at 10:00 pm weekdays and 11 :00 pm weekends. Discussion was
held regarding the fence between the restaurant and residential area. The applicant
stated that the fence will be rebuilt.
With no further questions, guests to speak, two letters of opposition, the public hearing
was closed.
In the Commission's deliberation session, B J Wilson moved to approve conditional use
application CU11 -10. Monica Hotelling seconded the motion. The motion prevailed by
the following vote:
Ayes: Oliver, Wilson, Hotelling, G. Martin, Fechter, Tiggelaar and E. Martin
Nays: None
CONDITIONAL USE APPLICATION CU11 -11 - FIRST FINANCIAL BANK
Next for the Commission to consider and make recommendation to City Council was
conditional use application CU11 -11 submitted by Tom Malone for property located at
1015 West Northwest Highway and platted as Lot 1, Block 1, Alamo Addition. The
applicant was requesting a conditional use permit to allow for a bank with drive through
service.
Mr. Tom Malone was available to answer questions and requested favorable
consideration. Mr. Malone stated that they would save the existing trees.
With no further questions, guests to speak, nor letters or petitions, the public hearing
was closed.
In the Commission's deliberation session, Monica Hotelling moved to approve
conditional use application CU11 -11. Elaine Martin seconded the motion, which
prevailed by the following vote:
Ayes: Oliver, Wilson, Hotelling, G. Martin, Fechter, Tiggelaar and E. Martin
Nays: None
CONDITIONAL USE APPLICATION CU 11-13 - GAYLORD TEXAN
Next for the Commission to consider and make recommendation to City Council was
conditional use application CU 11-13 submitted by Gaylord Texan for property located at
1000 Gaylord Trail and platted as Lot 1, Block 1, Opryland Fourth Addition. The

applicant was requesting a conditional use permit to amend the previously approved
site plan of CU10 -22 (Ord. 2010 -54) for a planned commercial center in conjunction with
a hotel, convention center and a pool /waterpark complex, along with the possession,
storage, retail sale and on- premise consumption of alcoholic beverages (beer, wine and
mixed beverages), specifically to allow seasonal signage for the resort pool /event area.
Ms. Angela Mitcham, was available to answer questions and requested favorable
consideration.
With no further questions, guests to speak, one letter of support, the public hearing was
closed.
In the Commission's deliberation session, B J Wilson moved to approve conditional use
application CU11 -13. Monica Hotelling seconded the motion, which prevailed by the
following vote:

PROFESSIONAL OFFICE DISTRICT REGULATIONS
Next for the Commission to consider and make recommendation to City Council was
AM11 -03 Grapevine Code Of Ordinances, Appendix D, Comprehensive Zoning
Ordinance No. 82 -73, as amended, Section 12, Definitions, Section 21, "R -MF -1"
Multifamily District Regulations, Section 22, "R -MF -2" Multifamily District Regulations,
Section 24, "CN" Neighborhood Commercial District Regulations and Section 27, "PO"
Professional Office District Regulations relative to amending "Personal Care Facility" to
"Assisted Living Facility" as per Chapter 247 of the Texas Administrative Code:
Assisted living facility shall mean an establishment that furnishes, in one or
more facilities, food and shelter to four or more persons who are unrelated to the
proprietor of the establishment and that provides personal care services as
defined by Chapter 247 of the Texas Administrative Code. Personal care
services include assistance with meals, dressing, movement, bathing, or other
personal needs or maintenance; the administration of medication; or the general
supervision or oversight of a person's physical and mental well- being.

In the Commission's deliberation session, B J Wilson moved to approve AM11 -03
amendments to the Grapevine Comphrensive .Zoning Ordinance. Gary Martin
seconded the motion, which prevailed by the following vote:

FINAL PLAT APPLICATION LOTS 1R -5R, BLOCK 1, NIGHTINGALE COURT
ADDITION
Next for the Commission to consider and make recommendation to the City Council was
the Statement of Findings and Final Plat Application of Lots 1 R -5R, Block 1, Nightingale
Court Addition submitted by Gary Nightingale for property located on Dunn Drive. The
applicant was final platting 2.449 acres for the development of five residential lots.
In the Commission's deliberation session B J Wilson moved to approve the Statement
of Findings and Final Plat Application of Lots 1 R -5R, Block 1, Nightingale Court
Addition. Monica Hotelling seconded the motion, which prevailed by the following vote:

AM11 -04 GRAPEVINE CODE OF ORDINANCES APPENDIX D, COMPREHENSIVE
ZONING ORDINANCE NO. 82 -73 SECTION 22, "R -MF -2" MULTIFAMILY DISTRICT
REGULATIONS
Next for the Commission to discuss was possible amendments to Section 22, "R -MF -2"
Multifamily District Regulations.
At a workshop the Commission discussed current trends in multifamily development in
the City and discussed possible amendments to the ordinance to accommodate the
changing state of multifamily development in those areas that now require the use of the
Planned Development Overlay. Primarily the discussion centered on creating a
mechanism to consider varying from the ordinance in four key areas — density, open
space, height, and parking— without the use of a Planned Development Overlay. The
Commission also discussed the elimination of the "R -MF -1" Multifamily District since it is
basically obsolete given the current state of higher density projects that have recently
been approved. During the work session, it was generally agreed that a new conditional
use category could be created that could give the Commission and Council the ability to
consider and allow standards that vary from the above referenced categories.

In the Commission's deliberation session Jimmy Fechter moved to set a public hearing
on Section 22, "R -MF -2" Multifamily District with the addition of Section 22.G.1. Front
Yard Setback being included in the conditional use section of the ordinance. B J Wilson
seconded the motion, which prevailed by the following vote:
Ayes: Oliver, Wilson, Hotelling, G. Martin, Fechter, Tiggelaar and E. Martin
Nays: None
CONSIDERATION OF MINUTES
Next for the Commission to consider were the minutes of the May 17, 2011 Planning
and Zoning joint public hearing.
Monica Hotelling moved to approve the Planning and Zoning Commission minutes of
May 17, 2011. B J Wilson seconded the motion, which prevailed by the following vote:
Ayes: Wilson, Hotelling Fechter and Tiggelaar
Nays: None
Abstain: Oliver, G. Martin and E. Martin
DJOURNMENT
With no further business to discuss, Jimmy Fechter moved to adjourn the meeting at
8:07 p.m. Elaine Martin seconded the motion which prevailed by the following vote:
