BRIEFING SESSION Chairman Oliver announced the Planning and Zoning Commission would conduct a briefing session relative to the following cases: CU10 -30 BOTTLECAP ALLEY /ICEHOUSE GRILL CU10 -25A LEGOLAND /SEA LIFE CU10 -32 APPLEBEE'S CU10 -34 GRAPEVINE TOWNE CENTER HL10 -13 FOUST WAREHOUSE to discuss development issues. JOINT PUBLIC HEARINGS CONDITIONAL USE APPLICATION CU10 -30 - BOTTLECAP ALLEY /ICE HOUSE i,R11 1 First for the Commission to consider and make recommendation to City Council was conditional use application CU10 -30 submitted by Cencor Realty Services for property located at 1469 West State Highway 114 and platted as Lot 7, Block 1, Towne Center Addition. The applicant was requesting a conditional use permit to amend the previously approved site plan of CU10 -13 (Ord. 10 -28) for a planned commercial center with the possession storage, retail sales and on- premise consumption of alcoholic 011811 1 P & Z JOINT PUBLIC HEARING JANUARY 18, 2011 beverages (beer, wine and mixed beverages) in conjunction with a restaurant, specifically to allow outside dining. This application was tabled at the December 21, 2010 public hearing in order for the applicant to provide landscaping and the type of seating fixtures proposed. Mr. Larry Marshall, representing Bottlecap Alley, was available for questions and requested favorable consideration of the application. Mr. Marshall stated that live oak trees as well as shrubbery will be planted. Irrigation and bollards will be provided. Mr. Greg Colchin, representing the property owner, lent support for the application. With no further questions, guests to speak, one letter of support, the public hearing was closed. In the Commission's deliberation session, B J Wilson moved to approve conditional use application CU10 -30. Monica Hotelling seconded the motion, which prevailed by the following vote: Ayes: Oliver, Fry, Wilson, Hotelling, Tiggelaar, E. Martin and Szot Nays: None CONDITIONAL USE APPLICATION CU10 -25A - LEGOLAND /SEA LIFE Next for the Commission to consider and make recommendation to City Council was conditional use application CU10 -25A submitted by Sea Life US LLC for property located at 3000 Grapevine Mills Parkway and platted as Lot 1R3, Block 1, Grapevine Mills Addition Phase 1. The applicant was requesting a conditional use permit to amend the previously approved site plan of CU10 -25 (Ord. 10 -70) for a planned commercial center in excess of 1,000,000 square feet of gross leasable space, specifically to modify the site signage. At the December 21, 2010 public hearing, the signage was approved in it's entirety except for a proposed monument style sign located at the northwest corner of Grapevine Mills Boulevard South and State Highway 26. The applicant was asked to redevelop the look/design and its location. Mr. Mitch Bernstein, representing the applicant, was available to answer questions and requested favorable consideration. Mr. Bernstein addressed the concerns by adding decorative trellis and landscaping to the signage that matches the theme of other signage throughout the mall. With no further questions, guests to speak, nor letters or petitions, the public hearing was closed. 011811 2 P & Z JOINT PUBLIC HEARING JANUARY 18, 2011 In the Commission's deliberation session discussion, Monica Hotelling moved to approve conditional use application CU10 -25A. Elaine Martin seconded the motion, which prevailed by the following vote: Ayes: Oliver, Fry, Wilson, Hotelling, Tiggelaar, E. Martin and Szot Nays: None CONDITIONAL USE APPLICATION CU10 -32 - APPLEBEE'S Next for the Commission to consider and make recommendation to City Council was conditional use application CU10 -32 submitted by Civitarese /Morgan +Architecture, LLC for property located at 2215 East Grapevine Mills Circle and platted as Lot 3, Block 5, Grapevine Mills Addition, Phase 1. The applicant was requesting a conditional use permit to amend the previously approved site plan of CU09 -37 (Ord. 09 -51) for a planned commercial center with the possession storage, retail sales and on- premise consumption of alcoholic beverages (beer, wine and mixed beverages) in conjunction with a restaurant, specifically to revise the floor plan and exterior elevations. Mr. Rick Civitarese, the applicant, was available for questions and requested favorable consideration of the application. Discussion was held regarding the tower feature and signage. Mr. Civitarese and Mr. Gary Brown, representing Applebee's, informed the City Council and the Planning and Zoning Commission that due to the mature trees in the area that the extra height was needed for visibility. With no further questions, guests to speak, nor letters or petitions, the public hearing was closed. In the Commission's deliberation session, Herb Fry moved to approve conditional use application CU10 -32. Monica Hotelling seconded the motion, which prevailed by the following vote: Ayes: Oliver, Fry, Wilson, Hotelling, E. Martin and Szot Nays: Tiggelaar CONDITIONAL USE APPLICATION CU10 -34 - GRAPEVINE TOWNE CENTER Next for the Commission to consider and make recommendation to City Council was conditional use permit application CU10 -34 submitted by Cencor Realty Services for property located at 1449 West State Highway 114 and platted as Lot 10, Block 1, Grapevine Towne Center Addition No. 2. The applicant was requesting a conditional use permit to amend the previously approved site plan of CU99 -26 (Ord. 99 -96), for a planned commercial center with the possession, storage, retail sale and on- premise consumption of alcoholic beverages (beer, wine and mixed beverages) in conjunction with a restaurant, specifically to allow a multi- tenant monument sign for the center. 011811 3 P & Z JOINT PUBLIC HEARING JANUARY 18, 2011 Mr. Greg Colchin, the applicant, was available for questions and requested favorable consideration of the application. Mr. Colchin stated there will be panels for eight tenants. With no further questions, guests to speak, nor letters or petitions, the public hearing was closed. In the Commission's deliberation session, Monica Hotelling moved to approve conditional use permit application CU10 -34. Martin and Szot Nays: Tiggelaar HISTORIC LANDMARK SUBDISTRICT APPLICATION HL10 -13 - FOUST WAREHOUSE Next for the Commission to consider and make recommendation to City Council was historic landmark subdistrict application HL10 -13 submitted by Vanessa & Jorge Piedra for property located at 334 South Barton Street and platted as Lot 9R, Block 2, City of Grapevine Addition. The applicant was requesting a historic landmark subdistrict designation to be known as the Foust Warehouse. With no further questions, guests to speak, one letter of support, the public hearing was closed. In the Commission's deliberation session, B J Wilson moved to approve historic landmark subdistrict HL10 -13. Monica Hotelling seconded the motion, which prevailed by the following vote: Ayes: Oliver, Fry, Wilson, Hotelling, Tiggelaar, E. Martin and Szot Nays: None END OF PUBLIC HEARING FINAL PLAT APPLICATION OF LOT 1, BLOCK 1, BENNETT PLACE Next for the Commission to consider and make recommendation to the City Council was the Statement of Findings and Final Plat Application of Lot 1, Block 1, Bennett Place submitted by Mary L Wilson for property located at 1332 Dublin Street. The applicant was final platting 0.296 acres for residential development. In the Commission's deliberation session B J Wilson moved to approve the Statement of Findings and Final Plat Application of Lot 1, Block 1, Bennett Place. Monica Hotelling seconded the motion, which prevailed by the following vote: 011811 4 P & Z JOINT PUBLIC HEARING JANUARY 18, 2011 Ayes: Oliver, Fry, Wilson, Hotelling, Tiggelaar, E. Martin and Szot Nays: None FINAL PLAT APPLICATION OF LOT 1, BLOCK 1, W. B. TRIGG GROCERY ADDITION Next for the Commission to consider and make recommendation to the City Council was the Statement of Findings and Final Plat Application of Lot 1, Block 1, W. B. Trigg Grocery Addition submitted by Tim Lancaster for property located at 623 East Dallas Road. The applicant was final platting 0.24 acres to plat an existing building. In the Commission's deliberation session Monica Hotelling moved to approve the Statement of Findings and Final Plat Application of Lot 1, Block 1, W. B. Trigg Grocery Addition. Elaine Martin seconded the motion, which prevailed by the following vote: Ayes: Oliver, Fry, Wilson, Hotelling, Tiggelaar, E. Martin and Szot Nays: None CONSIDERATION OF MINUTES Next for the Commission to consider were the minutes of the December 21, 2010 Planning and Zoning joint public hearing. B J Wilson moved to approve the Planning and Zoning Commission minutes of December 21, 2010. Herb Fry seconded the motion, which prevailed by the following vote: Ayes: Oliver, Fry, Wilson, Hotelling, Tiggelaar and E.
