ORDINANCE NO. q2_� 2 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF GRAPEVINE, TEXAS ABANDONING AND VACATING A PORTION OF A PUBLIC STREET RIGHT-OF-WAY AS DESCRIBED IN EXHIBIT "A" LOCATED IN THE HAYLEY ADDITION, SUBJECT TO RETENTION AND DEDICATION AS AN ACCESS, UTILITY AND DRAINAGE EASEMENT AS DESCRIBED IN EXHIBIT "B" ; PROVIDING A PLAT OF VACATION AND RETENTION AS DESCRIBED IN EXHIBIT "C"; PROVIDING A SEVERABILITY CLAUSE; DECLARING AN EMERGENCY AND PROVIDING AN EFFECTIVE DATE WHEREAS, the owners of Lot 5R-B2, Block 1 and Lot 1, Block 2 located in the Hayley Addition have requested a portion of a public right-of-way for South Ball Street as described in Exhibit "A", attached hereto and made a part hereof, be vacated and abandoned and that a portion of this right-of-way be retained as an access, utility and drainage easement; and WHEREAS, a portion of this public right-of-way as described in Exhibit "B", attached hereto and made a part hereof, must be �:.,�, retained and continue to be dedicated to the public as an access, utility and drainage easement for the welfare, use and benefit by the City of Grapevine and the general public; and �,:,�, WHEREAS, abandoning and vacating a portion of this public right-of-way and the retaining a portion of this right-of-way will insure the access the City of Grapevine must have to provide utility, drainage and other access to the property. ' / NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF GRAPEVINE, TEXAS: / Section 1. That all the matters stated in the preamble of this ordinance are true and correct and are hereby incorporated into the body of this ordinance as if copied in their entirety. Section 2. That a portion of the City of Grapevine's 50' wide public right-of-way located in the Hayley Addition dedicated to the City by plat filed in the Tarrant County Plat Records as the Hayley Addition, and as described in Exhibit "A" attached hereto and made a part hereof, is hereby abandoned and vacated for public use subject to the retention by, and continued and remaining dedication �� w, to the City of Grapevine for the public use as an access, utility and drainage easement that portion of said right-of-way as described in Exhibit "B" , attached hereto and made a part hereof. �. � .-- -� -R - :-, .-, - �- t v V J �� .; ,J /' V Section 3 . That a plat of vacation and retention of easement accurately displaying the portions of the above described public right-of-way vacated in part and retained in part is hereby attached hereto as Exhibit "C" and made a part hereof. Section 4. That the terms and provisions of this ordinance shall be deemed to be severable, and that if the validity of any section, subsection, word, sentence or phrase shall be held to be ' invalid, it shall not affect the remaining part of this ordinance. ' Section 5. The fact that the present ordinances and regulations of the City of Grapevine, Texas are inadequate to properly safeguard the health, safety, morals, peace and general welfare of the public creates an emergency which requires that this ' ordinance become effective from and after the date of its passage.
