AN ORDINANCE OF THE CITY COUNCIL OF THE CITY
OF GRAPEVINE, TEXAS, ABANDONING AND VACATING
TWO (2) TEN-FOOT WIDE SANITARY SEWER LINE
EASEMENTS LOCATED IN WESTERN OAKS ESTATES,
SECTION II, IN THE CITY OF GRAPEVINE, TEXAS,
AS HEREINAFTER DESCRIBED; PROVIDING A
SEVERABILITY CLAUSE; DECLARING AN EMERGENCY
AND PROVIDING AN EFFECTIVE DATE
WHEREAS, the owner of a tract of land located in Western Oaks
Estates, Section II, in the City of Grapevine, Tarrant County,
Texas as more particularly described in Exhibit "A", requested the
sanitary sewer line easements, as hereinafter described, be
abandoned and vacated; and
WHEREAS, the sanitary sewer line easements, as hereinafter
described, are not needed for public use and will not be needed in
the future for public use; and
�,,, WHEREAS, abandoning and vacating the sanitary sewer line
` easements will relieve the City of Grapevine, Texas from the cost
and expense of maintaining said property and facilities.

NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY
OF GRAPEVINE, TEXAS:
Section 1. That the City of Grapevine sanitary sewer line
easements as recorded in Volume 81-62, Page 1281, and Volume 82-72 ,
Page 5�2, of the Tarrant County Deed Records, and as shown in
Exhibit "A", attached hereto and made a part hereof, are heieby
abandoned and vacated for public use and the same are hereby
abandoned and vacated insofar as all public right, title, duty and
interest in and to said described portion of said sanitary sewer
line easements are concerned. The City shall have no
responsibility for maintaining said easements.
Section 2 . If any section, article paragraph, sentence,
clause, phrase or word in this ordinance, or application thereto
any person or circumstance is held invalid or unconstitutional by
a Court of competent jurisdiction, such holding shall not affect
the validity of the remaining portions of this ordinance; and the
,a ,, City Council hereby declares it would have passed such remaining
portions of the ordinance despite such invalidity, which remaining
portions shall remain in full force and effect.

Section 3 . The fact that said sanitary sewer line easements
°"'� are no longer needed by the public for public usage and would
create a hardship or burden upon the City of Grapevine to keep open
and maintain such easements creates an urgency and an emergency for
�r the immediate preservation of the public health, safety, and
general welfare, which requires that this ordinance shall take
effect immediately from and after its passage, and it is
accordingly so ordained.

ab�ndonment of that portion of the above named Utility Easement
particularly described in Exhibit No. 1 , attached. In support of this
application, the undersigned represents and warrants the f.ollowing:
1 . The undersigned will hold the City of Grapevine harmless and
indemnify it against all suits, costs, expenses, and damages
that may arise or grow out of such vacation and abandonment;
2 . Attached, marked Exhibit No. 2 , is a plat or sketch of the
sought to be vacated and the surrounding area to the nearest
streets in all directions, showing the abut�ing lots and
blocks , and the addition in which the above described
portion of such is situated, together with the record owners
of such lots;

BEING a ten foot wide strip of land for a sanitary sewer easement
located in the G.G. Starr Survey, Abstract No. 1466, Grapevine,
�' Tarrant County, Texas; and being a portion of the WESTERN OAKS
ESTATES--SECTION II recorded by Plat Amendment in Cabinet A, Hanger
716 , Plat Records, Tarrant County, Texas; and being a portion of a
Sanitary Sewer Easement, recorded in Volume 8162 , Page 1279, Deed
Records, Tarrant County, Texas; and being five feet each side of the
following described centerline;
COMMENCING at the Southeast corner of the intersection of Western Oaks
Drive (a 64 foot wide Right-of-Way) and Heritage Avenue (an 80 foot
wide Right-of-Way) as per plat of Western Oaks Subdivision recorded in
Volume 388-180, Page 71 , Plat Records, Tarrant County, Texas;
THENCE South O1`52'56" West along the East line of said Heritage
Avenue, a distance of 230 . 00 feet to the beginning of a curve to the
left whose chord bears South 11' 34'39" East;
THENCE in a Southerly direction c�ntinuing along the East line of
said Heritage Avenue, and along said curve to the left having a
