HomeMy WebLinkAboutORD 1987-036 CITY OF GRAPEVINE, TEXAS ORDINANCE NO. g'7-36 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF GRAPEVINE, TEXAS, AMENDING THE CODE OF ORDINANCES OF THE CITY OF GRAPEVINE, TEXAS, BY AMENDING CERTAIN PROVISIONS OF CHAPTER 7, ARTICLE III THEREOF ENTITLED "ELECTRICAL ��� CODE" , BY ADOPTING AND AMENDING THE 1987 EDITION OF THE NATIONAL ELECTRICAL CODE; PROVIDING A SEVERABILITY CLAUSE; DECLARING �:}� . AN EMERGENCY AND PROVIDING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF GRAPEVINE, TEXAS: Section 1 . That Chapter 7, Article III entitled "Electrical Code" of The Code of Ordinances, City of Grapevine, Texas (the "City Code" ) , is hereby amended in the following particulars, and all other existing divisions, sections, subsections, paragraphs, sentences, definitions, phrases and words of said City Code are not amended, but shall remain intact and are hereby ratified, verified and affirmed: A. That paragraph (3 ) of subsection (a) of Section 7-43 is hereby amended by deleting said paragraph, in its entirety, and substituting in lieu thereof the following paragraph (3 ) , which paragraph shall hereafter read as follows: " (3 ) The other five (5 ) members shall be those regular members of the Housing and Advisory Board. Reference to the "Board" shall mean ��.... the Electrical Code Board of Adjustment and Appeals . " '°�°' B. That paragraph (4) of subsection (a) of Section 7-43 is hereby amended by deleting said paragraph, in its entirety, and substituting in lieu thereof the following paragraph (4) , which paragraph shall hereafter read as follows: " (4) The Building Official shall be a member of the board without voting privileges, and shall be the permanent secretary. " C. That paragraphs (5 ) and (6) of subsection (a) of Section 7-43 are repealed by deleting said paragraphs (5 ) and (6) in their entirety. D. That subsections (a) and (b) of Section 7-91 are hereby amended by deleting said subsections, in their entirety, and substituting in lieu thereof the following subsections (a) and (b) , which subsections shall hereafter read as follows: " (a) There is hereby adopted by the City of � Grapevine, Texas for the purpose of prescribing regulations , governing conditions hazardous to life and property that certain 1987 edition of the National Electrical Code, with the exception of such sections thereof as are hereinafter deleted, modified or amended and the same is hereby adopted and incorporated herein as if the same were copied in its entirety, and from the date on which this section shall take effect, the provisions thereof shall be controlling within the limits of the City with amendments as herein noted in Section 7-97 . This Article III shall be known as the "Grapevine Electrical Code" and a copy of said Code shall be maintained in the office of the City Secretary. (b) The Building Official is hereby authorized and directed to enforce all the provisions of this Code. For such purpose, he shall have the power of a law enforcement officer . " E. That Section 7-96 entitled "Conduit or tubing" is hereby repealed by deleting said Section 7-96 in its '""� entirety, and furthermore said Section 7-96 is hereby reserved for future use. � F. That Section 7-97 entitled "Amendments to National Electrical Code" is hereby amended by deleting said Section, in its entirety, and substituting in lieu thereof the following Section 7-97, which Section shall hereafter read as follows: "Sec. 7-97 . Amendments to National Electrical Code . The following are amendments to the 1987 edition of the National Electrical Code: (1) Article 310-14 is hereby amended in its entirety to read as follows: "There shall be no aluminum wire on the load side of the service smaller than a No. 2 thw. " (2 ) Article 210-8 (a) (3 ) is hereby amended in its entirety to read as follows: "All 125-volt, �:, ,. single-phase, 15- and 20-ampere receptacles installed outdoors and located within 6 feet, 6 inches � -:� above grade, earth or a grounded surface having permanent access, shall have ground-fault circuit-interrupter protection for personnel . (FPN) : See Section 215-9 for feeder protection. For the purposes of this Section, "direct grade level access" is defined as being located not more than 6 feet, 6 inches (1 .98m) above grade level and being readily accessible without entering or passing through a dwelling unit. " (3) Article 210-8 (a) (4) is hereby amended in its entirety to read as follows: "All undesignated, 125-volt, single-phase, 15- or ,,�,.,, 20-ampere receptacles installed in a basement shall have ground-fault circuit-interrupter protection for personnel and shall be so "�" identified. " (4) Article 210-63 is hereby amended in its entirety to read as follows: "A 125-volt, single-phase, 15- or 20-ampere rated receptacle outlet D9/0242a 2 shall be installed at an accessible location for the servicing of rooftop-mounted heating, air-conditioning, and refrigeration equipment. The receptacle outlet shall be located on the same roof level and within 25 feet of the heating, air-conditioning, and refrigeration equipment, as required by the 1985 Uniform Mechanical �,,;� Code. The receptacle outlet shall not be connected to the load side of the equipment disconnecting means . �`°" Exception: One- and two-family dwellings . " G. That Section 7-100 entitled "Inspection required" is hereby amended by deleting said Section, in its entirety, and substituting in lieu thereof the following Section 7-100, which Section shall hereafter read as follows: "Sec. 7-100 . Inspection required. On any electrical installation for which a permit is required, it shall be the duty of the person making the installation to notify the Building Official, who shall inspect the installation within forty-eight (48 ) hours, exclusive of Saturdays, Sundays, and holidays of the time such notice is given. " H. That Section 7-101 entitled "Covering wiring" is hereby amended by deleting said Section, in its entirety, �� and substituting in lieu thereof the following Section 7-101, which Section shall hereafter read as follows: �""`" "Sec. 7-101 . Covering wiring. When any electrical equipment is to be hidden from view or covered by the permanent placement of parts of the building, the person installing the equipment shall notify the Building Official and such equipment shall not be concealed until it has been inspected, approved or authorized by the Building Official . Where concealment of electrical equipment proceeds continuously, the person installing such equipment may apply in writing to the Building Official for periodic inspections, but concealment of such work shall not be done until the contractor has received notice that such permission has been granted. " I . That Section 7-102 entitled "Opening of covered work" is hereby amended by deleting said Section, in its entirety, and substituting in lieu thereof the following Section 7-102 , which Section shall hereafter read as � s� follows: "Sec. 7-102 . Opening of covered work . The Building Official shall have the authority to demand building contractors to open work that in any manner conceals electrical wiring that has been closed without the Building Official 's knowledge or permission, and in no case shall the Building Official issue clearance until he is satisfied that this work is in accordance D9/0242a 3 with the provisions of this Code. The Building Official shall also have the right to refuse to issue a clearance on any wiring that is concealed in such a manner that he cannot fully satisfy himself that it has been done in accordance herewith. " J. That Section 7-103 entitled "Inspection of new commercial and industrial building" is hereby amended by deleting said Section, in its entirety, and substituting in lieu thereof the following Section 7-103, which ''��" Section shall hereafter read as follows: "Sec. 7-103 . Inspection of new commercial and industrial buildings . The Building Official may be called upon as many times as necessary to inspect portions of new commercial or industrial buildings in the course of construction upon request, in order not to delay construction, and must inspect such work within forty eight (48) hours from the time notice is received, Sundays and holidays excepted. " K. That subsection (b) of Section 7-104 is hereby repealed by deleting said subsection (b) in its entirety. L. That Section 7-105 entitled "Courtesy inspections" is hereby repealed by deleting said Section 7-105 in its entirety, and furthermore said Section 7-105 is hereby reserved for future use. M. That Section 7-106 entitled "Approval for connection to installation - Generally" is hereby amended by deleting said Section, in its entirety, and „�, :> substituting in lieu thereof the following Section 7-106, which Section shall hereafter read as follows: �--k "Sec. 7-106 . Approval for connection to installation - Generally. (a) Upon the completion of electrical work and when notified by the electrical contractor, the Building Official shall make a final inspection and if found to comply with this Code, a written notice shall be given to the authorized electrical supplier indicating that the work has been done according to the provisions of this Code. (b) It shall be unlawful for any person to make connection to supply of electricity or to supply electricity to any electrical equipment for which a permit is required, or which has been disconnected by the order of the Building Official, until a notice or approval has been issued by the Building Official authorizing the connection and use of such equipment. " N. That Section 7-107 entitled "Same - Certificate of approval" is hereby amended by deleting said Section, in its entirety, and substituting in lieu thereof the following Section 7-107, which Section shall hereafter � read as follows: "Sec. 7-107 . Same - Certificate of approval . When the Building Official completes a final inspection of an electrical installation andfinds that it conforms with the provisions of this Code, he may, if requested to do so, issue a D9/0242a 4 certificate of approval authorizing the use of the installation and connection to the supply of electricity and shall send written notice of such authorization to the agency supplying the electric service. " 0. That subsection (a) of Section 7-108 is hereby amended by deleting said subsection, in its entirety, and substituting in lieu thereof the following subsection (a) , which subsection (a) shall hereafter read as follows: � " (a) If in judgment of the Building Official after inspection, determines any building or structure regulated by Chapter 7 of this Code that are unsafe or dangerous to persons, or property, the Building Official has authority to cause such wires or appliances to be disconnected from the source of electrical energy supplying these conductors or equipment and may at his discretion seal the control switches for same in an open or disconnected position whereupon he shall give notice at the site and shall also notify the electric utility company serving the premises . It shall be unlawful for any person to cause or permit electric current to be supplied to the electrical conductors, appliances or equipment so sealed until they have been made safe and the inspector shall have issued a certificate of approval to that effect. " Section 2 . If any section, article , paragraph, sentence, clause, phrase or word in this Ordinance, or application thereto any person or circumstances is held invalid or unconstitutional by a Court of competent jurisdiction, such holding shall not affect the validity of the remaining portions �� of this Ordinance; and the City Council hereby declares it would have passed such remaining portions of this Ordinance despite such invalidity, which remaining portions shall remain �"� in full force and effect . Section 3 . The fact that the present ordinances and regulations of the City of Grapevine, Texas, are inadequate to properly safeguard the health, safety, morals, peace and general welfare of the inhabitants of the City of Grapevine, Texas, creates an emergency for the immediate preservation of the public business , property, health, safety, and general welfare of the public which requires that this Ordinance become effective sixty ( 60 ) days from and after the date of its passage and it is accordingly so ordained. PASSED AND ADOPTED BY THE CITY COUNCIL OF THE CITY OF GRAPEVINE , TEXAS , this 7th day of Jul , 1987 .
