ORDINANCE NO. 79-37
AN ORDINANCE AMENDING THE BASIC CITY OF GRAPEVINE
ORDINANCE , SAME BEING ORDINANCE NO. 70-10 , BY
AMENDING SAID ORDINANCE AS CODIFIED IN CITY OF
GRAPEVINE CODE BY DELETING MULTI-FAMILY DWELLINGS
AS PRINCIPAL USES FOR "C-1" NEIGHBORHOOD BUSINESS
DISTRICT AND "C-2" COMMUNITY BUSINESS DISTRICT;
PROVIDING A SEVERABILITY CLAUSE , PROVIDING A PENALTY
AND DECLARING AN EMERGENCY.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
GRAPEVINE, TEXAS :
Section 1. That Section 7-401 (1) of the Zoning
Ordinance of the City of Grapevine , the same being Ordinance
No. 70-10 and codified in the City Code of the City of
Grapevine as Appendix A, is hereby amended in its entirety
to read as follows :
" (1) Any uses permitted in the foregoing
"R" Dwelling Districts , except for Multi-family
dwellings which are specifically excluded. "
Section 2 . That Section 7-501 (1) of the Zoning
Ordinance of the City of Grapevine , the same being
Ordinance No. 70-10 and codified in the City Code of the
City of Grapevine as Appendix A, is hereby amended in
its entirety to read as follows :
"(1) Any uses permitted in the "R" Dwelling
or the "C-1" Neighborhood Business District , ex-
cept for Multi-family dwellings which are specifi-
cally excluded. "
Section 3 . Severability. If any section, article,
paragraph, sentence , clause, phrase or word in this ordinance ,
or application thereto to any person or circumstance is held
invalid or unconstitutional by a Court of competent juris-
diction such holding shall not affect the validity of the
remaining portions of this ordinance despite such invalidity,
which remaining portions shall remain in full force and
effect.
Section 4. Penalty. Any person violating any of the
provisions of this ordinance shall be deemed guilty of a
misdemeanor and upon conviction thereof shall be fined in
a sum not to exceed two hundred dollars ($200 . 00) and a
separate offense shall be deemed committed upon each day
during or on which a violation occurs or continues after
the notice period provided herein has expired. The Court
shall order removal and abatement of the nuisance .
Section 5 . Emergency. The fact that no present
ordinances of the City of Grapevine amend Section 7-401
of the Grapevine City Code relating to the zoning of
Multi-family dwellings in "C-1" Neighborhood Business
Districts and Section 7-501 of said City Code relating
to the zoning of Multi-family dwellings in "C-2" Community
Business Districts , creates an urgency and an emergency and
the preservation of the public health, safety and welfare
requires that this ordinance shall take effect immediately
from and after its passage and the publication of the
caption as the law and charter in such cases provides .
DULY PASSED by the City Council of the City of
Grapevine , Texas , this the 7th day of August , 1979 .
